Motorcyclist jailed for State Trooper's death
     James Joshua Carncross is doing 7 years in State Prison for aggravated criminally negligent homicide, after a New York State Trooper drove his Chevy Tahoe into a tree at 100 mph.  The Trooper was speeding to a 911 call, when he decided to chase a motorcycle, driven by Joshua, that pulled out in front of him, instead.  After a 7 mile chase, the motorcycle was long gone.  But the Trooper ignored signs that read 30mph, slow, children at play, to drive 100mph through an intersection and into a tree, and killed himself.  Did he ever really have a chance to catch a motorcycle in a truck?  Most think not!  Because he was chasing the motorcycle, does that make the motorcyclist responsible for the reckless way the Trooper was driving?  Of course not!  Then why was he given two to three times more of a prison sentence than others.  Nobody knows and we can't figure it out, but we know it's not right!  In central New York there were 32 others convicted of vehicular manslaughter.  Most were DWI, some were predicates.  They all killed someone while driving a vehicle, and they all recieved sentences of 1-3, or 2-4 years in jail.  Josh got a straight 7 year sentence, and he wasn't even driving the vehicle that crashed.  DOES THAT MAKE SENSE?  If you don't think so, kindly add your name to this petition, thank you.  He's already been in State Prison for 3 years.  Thats long enough!  We'd like to get him out, so he can be back home with us,  where he belongs. I believe it was a case of the D.A. grand standing for his own political good. I drive that road almost everyday and for anyone to think they could drive thru there at 100 MPH is just insane. Why Mr. Carncross is spending time in prison for this is hard to believe.

It justs goes to show what i have always known.Once they put on that uniform,they think they become superman.Who in their right mind would chase a crouch-rocket motorcycle with a chevy tahoe????? I believe carncross got a bad deal just because one of our superman,tried to do something,even a 18 year old would no not to do.We need to take more tests for police to see how compent they are.

As I followed the Carncross case through to James' conviction, I became enraged and lost all the faith I'd had in our criminal justice system. The defense attorney, though too apologetic, said most everything I might have, while the prosecutor did nothing but blow hot air. I can't understand how anyone of sound mind could have decided that James was guilty of anything but speeding. Mass hysteria, encouraged by the news' repeated use of the word 'killed' to describe the trooper's demise, must have prevaile over justice. I do not condone the idea that an example should be made of anyone unless the punishment fits the crime. In James' case, the state decided to exact revenge on a citizen for an accidental death. This is the only real crime that was committed in the course of events, and the prosecution should be found guilty of promoting a total injustice. For anyone who can rationalize this boy's conviction, I propose the following two questions. What if the speeder had been a husband rushing his pregnant wife to the hospital? What if the trooper had killed a bystander with his reckless driving? There should be no need for such imaginative excersises, but I wonder how many citizens and officials would have taken a different approach to this case had they considered the possibile causes and effects of that accident. We need to make an example of this conviction so that it will never so easily happen again. There should have been a notable public protest during the trial, and I should have been there, but I can still say, today, FREE JAMES CARNCROSS NOW!

It's too bad that the justice system decided to make Josh's case a "special" one. It's not like he twisted the trooper's arm to go 100 mph - that was his own fault. What about all the police that caused accidents and killed someone - what did they get? Certainly not 7 years and probably not 1 or 2. My prayers are that Josh will be released.

Face the facts...(1)The only law that Carncross broke was speeding.(2)If Carncross hit the tree,the troopers would have said he didn't know his limitations and got what he deserved.(3)In this case,the "cowboy/hotshot" trooper didn't know his limitations and got just what he deserved.(4)A seven year prison term for speeding is wrong and I feel the judge and district attorney made a mistake and should serve the remainder of Carncross's term. These Bozos, along with a poor jury,just plain screwed up.I've been on jury duty and have been pressured by them to "get the right verdict".(5)Carncross didn't even know he was being chased as he had a huge lead on this jerk who was busy trying to get turned around on narrow rt.91 and race through Pompey(by now on the wrong road)at 100 mph. (Jeff Gordon couldn't get around that turn at 100 so what would make anyone think some loser trooper could).(6)Carncross will probably have to serve his full sentence as he's going to serve as an example that cops are above the law and never wrong.(7)The only good that will come out of this is that we got rid of a real jerk so he can't cause anymore problems down the road and possibly kill some innocent family trying to make a name for himself and inflating his ego! (8) Carncross never should have turned himself in.

I do not mean to disrespect the dead, but a lack of skill and good sense (HORRIBLE SENSE -- RECKLESS DISREGARD FOR PUBLIC SAFETY) on the state troopers part used as an excuse to "make an example" (SCAPEGOAT REALLY) of this poor boy is NOT RIGHT. I feel that a trooper with training should be knowledgeable enough to make safe driving choices no matter what the purpose of his 100 mph chase. I am very familiar with the crash site as I drive through there daily and would never even consider driving faster than 45 miles per hour due to the windy road.

I feel that both parties acted recklessly and both are at fault. Punishment for fleeing from an officer, had he known he was being chased was deserved, however 7 years, that is just not right; how about serving the community and sentencing him to volunteer with various organizations? I feel that law enforcement officers need to act responsibly as well and going over 90 mph to chase someone is reckless and negligent; the trooper put other citizens at risk. The trooper also should have realized his SUV wasn’t able to handle speeds at which he was traveling; perhaps he let his ego get in the way of good judgment. My feeling is the district attorney was going to make an example of this young man, did he succeed, probably not, there are always going to be senseless, unfortunate accidents. God Bless both families.

Both were being reckless with their vehicles and both are responsible for the outcome. Neither can be blamed for the actions of the other. 3 years is long enough, Josh has paid his debt. Let Carncross out of prison and open a space for a more guilty criminal.

As many have said, two wrongs don't make a right. Has Josh being in jail brought the trooper back to life? Is it REALLY a comfort to the trooper's family to know Josh is in jail? They really didn't Know for sure who was being chased...and I recall one witness stating that he looked at her (Josh) and she could see the color of his eyes...NO WAY. I don't know how anyone could feel Josh should be in jail. FREE JOSH

As a retired NY State DOCS employee (Auburn and Butler prisons) the traffic infraction..Josh committed..cutting in front of a vehicle or speeding..in my opinion does not mandate so severe a punishment as 7 years in state prison. I suspect even State Troopers recognize this is unfair and the officer should bear some responsibility for his suicidal behavior.
