Let Ginger Live!

As some of you may know, our Labordoodle Ginger was taken away by the Livingston County Animal Control on Friday December 2 with a petition for Euthanization. We quickly hired a lawyer and motioned for Ginger to be moved to a local boarding facility where she is receiving far better treatment. Since then we have gone to court for a pre-trial on December 20, at which point the prosecutor refused a plea agreement twice, and a trial date was set for February 17. However, our final pre-trial was postponed to Friday February 24 due the judge being sick, and now our trial date has been set for Friday March 16; again the prosecutor refused a plea agreement. In the meantime we have been gathering expert witnesses (including employees of the boarding facility), and had Ginger's behavior/temperament assessed; she does NOT display aggressive behavioral traits and is a puppy in need of training.

The incident in question: In Oct. 2011 she got out of our house through the front door, because the individual using it was not paying attention, and she was not immediately grabbed and brought back in the house. Upon hearing children in the sub, and being used to playing with my cousin's kids, she ran to play/check it out. She ended up nipping a little girl on the butt. I truly believe this was an accident, as does our dog trainer/witness, among others who know Ginger. Again she was safely around my cousin's kids ranging in age from 2-13, and never harmed them; not even when the 2yr old would tug on her ears which are very sensitive. We are fully prepared to have her trained immediately (released to the trainer) if she is allowed to live. In fact are willing to do anything short of Euthanization, and have offered as such for a possible plea. Unfortunately for Ginger, she was accused of biting once before, in April 2009, by our backyard neighbor, however there is no proof of that incident and the neighbor's story has changed multiple times; most recently he claims to have been on our property uninvited which means Ginger is within her rights. At this point we have been advised to pack our side of the courtroom with support for Ginger and our family. As well as, to do what we can to show the Judge that Ginger is a puppy, a good girl who made a mistake, and should not be put down.
