Abandonment Laws

Target:
Everybody
Sponsored by:
I think no doubt there should be laws and timelines for parents that decide not to be part of a childs life. After an amout of time that a parent either stops seeing the child supporting the child their rights should be taken away. You should not be able to come in and out of a childs life whens its fits your life. Its about the child and when do we start putting them first?

We the undersigned appreciate you taking time out of your life to read this.  This is very personal to me. I'm fighting for a child that i've been raising for almost six years thats is biologically is not mine. The father has rights even though his never been a part of this childs life. Where are my rights? What about the child and whats in the best interset for them. When are things going change and the courts see that being blood related or sharing the same genes does not make a partent. Anybody can make a baby it takes a real woman or man to step up and be a parent. Thank everyone that reads this just you taking a mintute out of your life might change someone elses.

I completely agree with this. My father tried to do that. No way would I let him in!

I personally yhink thier should be no take backs in an adoption case. The paternal Mother has nine months to change her mind, and that should be all the time she gets. Taking a child away from the only parent it knows is wrong.

i agree that there should be a law in place about child abandonment. my fiance and i are raising his daughter and her biological mother is going through phases of seeing her and not seeing her i think that after a certian point in time that it should be abandonment and she should have her rights as mother terminated

my child's father is a deadbeat and only has anything to do with her when it is convenient in his life which is basically never. my husband wants to adopt her so bad and she calls him daddy. my ex is basically just the sperm donor and he should not have the honor to be called her father

i am signing this petition because i agree with all my heart i have a 9 year old son who has seen his father less then a hand full of times throughout his life he comes around only when he feels he has a reason like showing his son off to family friends or a new girlfriend n as soon as he is done making empty promises or buying him gifts for his services he bounces right back out leaving my son with the question why? wondering if it is something he has done wrong...the last time he has seen his son was when he was 6 which this fall will of been four years ago i have pondered the question on wheither or not to try to contact him again but i know it would only break my sons heart even more now that he is older he pays no childsupport sends him nothing and never calls on his birthday and he only lives a half hour away...my son will be 10 soon and we have done well without him he is an allstar athelet a A-B student and very healthy and outgoing makes friends where ever he goes and has become such a little man helping out with his brother n sister...but i know in his heart he does not understand why his father is not here to cheer him on in life but i also know he feels the support n love from me his siblings and grandparents...i grew up without my father too n it just hurts to know that my child is going through the same disappointment i did growing up...that is why i am signing this petition to stop other children from growing up wondering why...i do not believe that once a man or women for that matter has walked out and turned their back on something so amazing that they have been able to have a part in in making, a child someone who is there to love u unconditional and who is so inoccent from the worlds many flaws should ever be able to enter back in and out as they please because what ever the fix might be that they are enduring themselves in that small time frame of trying to be the perfect parent they are only taking from that childs happiness...i love my son isaiah, i love all my children i am a single mother and i do everything for my children and there is no way i could walk away from them not even for a second, they are my world....

My daughter whose oldest son is 9 has seen his father maybe three times since birth. He has no Idea what his child likes is allergic to, what sports he plays etc. He probably could not pick him out of a line up of 3. But if something should happen to my daughter I would have a fight on my hands to have custody of her children like she wants.

A person is not a parent when the only participation is the blood line that connects them. A child needs the participation and love from their family not from someone who choses to love them when it's a convenient moment.

My sister has a beautiful daughter that she has raised by herself since day one. I really feel that the 6 month abandonment law NEEDS to be put in place and USED! My sister's ex hasn't seen or paid child support in over 3 years.

I am in a situation that my ex hasn't seen my daughter for 3 years. I have hesitated to go back to court because our relationship was so abusive. I left him knowing I had a little baby girl to think for. I do not think it is right that if something were to happen to me my daughter would go to someone she doesn't even know. She only knows my family. Children are precious and we need to protect them. It is also not right for a parent to go in and out of a child's life I have watch what happens to children and that is not fair.

First off: I love our son more than anything in the world. In our case the 'donor' is a bum, drunk, and all-around useless individual. He didn't help at all during our pregnancy, unless you count a few phone calls in which he was absolutely vile towards the mother. He called over a year after his birth to threaten us with legal action. No questions about his well being or a happy birthday or anything of the like; just pettiness and selfishness. I have been around since the beginning, and I will be here till forever. I don't care about taxes or benefits anything like that; I just don't want our child to experience this individual in any form. There is no revolving door policy when having/raising a child. It sickens me that people who actually care and actually have a child's best interests in mind are trumped by an outdated black-and-white legal system that lets these scumbags claim parental rights out of spite or similar reasoning. Things need to change.

I am the mother of a beautiful fifteen month-old boy. Even though when my pregnancy was accidental, by no means was it unwanted. I loved my son from the moment I knew he was there. I was 22 when I found out that I was pregnant and I loved my son enough to stop smoking, to get a good job and I spent the whole nine months preparing for his arrival to make sure that he would have everything he would need. His biological father did nothing. For the past two years he has never held a permanent job, address, or phone number. He continued to drink and do drugs and to keep the company of unsavory people to say the least. In the meantime a wonderful man who knew that my son was not biologically his stepped in and helped to take care of us. He is my sons father. He gives him hugs and kisses everyday, he baths him, changes him, helps me discipline him and supports him,a nd I know he loves my son as his own. This happened because his biological father has not been around or heard from for a year. And know he pops in and says, " I am ready now." I resent this. My fifteen-month old does not know this man. He is a stranger to him. He is a stranger to me now as well. By this man's own choice, he wasn't there. Now, because he insists on going to court me and my husband may lose everything we worked so hard for our son. A stable and safe lifestyle being one thing. And now the man who did take this child into his heart has no say. It is disgusting. Parenthood is not a revolving door.

My granddaughter is six years old and has not had contact with her biological father since she was three days old. My daughter has since married and her husband wants to adopt my granddaughter, this is the only daddy she has known, but they are unable to because the biological father will not relinquish his rights.

I have a 6 year old daughter whom I had when I was 17. The last time her biological father saw her, she was 3 months old. Since then, I have raised her with the help of my family and my wonderful husband whom she knows as her daddy. Now that we want him to sign over his rights, he is refusing and saying he wants to see her- and because of Wisconsin law, since he has been paying child support he has the "right" to request that. Something HAS to change.

My husband who had sole custody of my children left them with me 3 years ago. SInce that time he has taken my son back for 6 months and then decided he didnt want him again. Now, since i dont have custody and never charged him with abandonment, cuz he threatned me, I'm about to lose both of my children again. He just gave the police authority 3 days ago to put my 15 year old daughter in a home with a 23 year old and her husband who she had just met 4 days ago. All because my daughter lied to him and said life was miserable. My daughter is a manipulator and cps know this, but with no actual custody and never turnin him in for abandonment, scared of him or not, i have no say in the matter. And now hes about to come and take my son out of my home in a week because he just feels like it. No money for a lawyer, I'm just a poor single mother of two tryin to make it. We have a home food and things we need. And to me, thats a family

"Teri Jendusa-Nicolai's case demonstrated the need for legislation like this, and I thank the family for joining us here today."The bipartisan legislation won final approval in the Senate within days of a Wind Lake woman's abduction and near fatal beating. On January 31, Teri Jendusa-Nicolai went to get her daughters at the home of her ex-husband. A day later, she was found beaten, bound, stuffed in a garbage can, sealed and locked in a Wheeling, Ill., storage unit rented by her ex-husband. David M. Larsen, accused of domestic violence in the past, now faces state and federal charges for the abduction and near fatal beating.Teri Jendusa-Nicolai is recovering at a Park Ridge, Ill., hospital, but members of her family attended the bill signing ceremony. The Governor welcomed them and thanked the lead sponsors of Assembly Bill 279, Representatives Terese Berceau and Don Friske and Senators Carol Roessler and Fred Risser. The Governor said the new law puts the interests of children first, undoing a change nearly five years ago in the child custody law. Language tucked in a state budget at the last minute with little notice gave precedence to joint custody and placed the interests of children second. While undoing that, the new legislation incorporates other changes recommended by the National Council of Juvenile and Family Court Judges. In all, the changes place Wisconsin in the first wave of states reforming child custody laws with an eye to preventing domestic violence and child abuse. Under the new law, a judge can deny joint or sole custody, if there is evidence of domestic abuse. The new law presumes it is against a child's best interest to award custody to a parent who has committed a serious act of spousal abuse or engaged in a pattern of abuse.A parent can overcome or rebut the presumption by successfully completing a certified program for batterers and convincing the judge that allowing placement or visitation is in the child's best interest.Among other changes, the new law requires court-appointed guardians and mediators to receive training in domestic violence awareness and, as they handle custody disputes, look for evidence of domestic violence. They are required to report their findings to the court.finally, if a judge decides to place a child with a parent who has a history of domestic violence, the judge must take steps to ensure the safety of the child, as well as the other parent, during exchanges. Supervision by a third party may be necessary. The incidence of domestic violence cases in Wisconsin exceeds 27,000. At least 9,000 children suffer abuse and neglect in Wisconsin every year. ???????!!!!!!!!!!!!???????????!!!!!!!!!!!!!!!!!!!!!??????? Steven Richard Rohow was giving the child a bath May 19 when he said the youngster kept getting out of the tub. Rohow was taken into custody after being interviewed by an Isanti County investigator. He appeared before Judge James Dehn Monday, May 20 where bail was set at $20,000 cash or bond and he was formally charged with:felony malicious punishment of a child; two counts of felony assault in the third degree; misdemeanor domestic assault in the fifth degree and misdemeanor assault in the fifth degree. i have had custody of this baby for 10 months, baby is 20 mo old.DHS was going to take him because mother was on drugs, after i got him the mother missed 2 and half months without seeing her baby, during this time she has missed about 3 times about 1 and half months each, then now she missed over a month.i recieve no support or help from baby's grandparent,my sister,we go to court in march,my daughter and son in law love this baby very much and want to adopt this baby.Mother always comes on the scene and her comment makes me mad she compares a person going into the army and being away from their children the same thing!

There should be some sort of stability put in place for children. Coming and going of a parent in a childs life is very hard emotionally for a child and leads to further problems mentally down the line. My father did this for a few years to our family and eventually we never saw him again until we were adults and contacted him ourselves. The impact it had on me was huge and to this day I still get counseling for it.

My father went to parts unknown in 1968 when I was 5... He was never found again, nor did he ever pay child support, ad left my mother with the house and all the bills... To make matters worse, it took my mother 7 years before she could go to court to have him be recognised as "Legally" dead...
