Miscarriage of Justice in Arizona: Free Anant Tripati


We draw your attention to a miscarriage of justice and ongoing civil rights abuses in the State of Arizona and, ask you to intervene in the case of Mr. Tripati who has been imprisoned in Arizona for crimes that he did not commit.

As described by the international human rights organization Fair Trials International, Anant Kumar Tripati has been denied due process and access to legal counsel by Arizona State employees, in contravention of international human rights standards.

Case summary:
In 1992, Mr. Tripati was arrested and charged with fraud relating to a bail bond that he was uninvolved with. He maintained his innocence but based on witness testimony, was subsequently convicted and sentenced to serve a 52.5 year sentence without any possibility of parole. To date, he has served 17 years of his sentence.

The witnesses who testified against him have recanted their testimony, subsequently admitting in affidavits that they were coerced into falsely testifying against Mr. Tripati, and that he is in fact innocent. Official Arizona Department of Corrections memos indicate there is a deliberate policy to deny Mr. Tripati legal access and prevent him from making legal calls or posting legal mail, as well as other civil rights violations.

In cases where the Judiciary proves unwilling to even hear such strong evidence in an appeal, it is crucial for the executive and legislative branches of government to step in to preserve the integrity of the criminal justice system.

THEREFORE, we the petitioners respectfully call for:

1.      The immediate and unconditional release of Anant Kumar Tripati. We request that he is granted a pardon. This can be the only just response to a man who has served 17 years in jail for a non-violent crime, with ample evidence that his conviction was unsound.

2.      The treatment of Anant Kumar Tripati be thoroughly reviewed in a manner
consistent with the provisions of the UN Charter and the International Covenant on Civil and Political Rights, to which the United States is a signatory. The United States is now a member of both the Human Rights Committee and the Human Rights Council. In light of this, we ask that the government also investigate the conduct of judges and state officials involved in repressing evidence of his innocence.
