Carter Justice Campaign

To raise awareness & support for David Carter, who is currently being held in a Georgia prison unjustly and unfairly.  David was being sexually tormented, abused and raped by an evil man who ultimately lost his life in a battle for David's freedom.

The District Attorney asked for the courts to sentence David to 20 years/ serve 12.  The Parole Boards own guidelines recommended that he serve 84 months (7 years) and they deviated from that by an additional 60 months (5 years).  David has now completed 12 1/2 years, with an amazing prison record, no disciplinary actions, has gained huge respect from his peers and officers and even the upper administrators of the Department of Corrections...

In September of 2009, four months after the Parole Board started its review, they have once again deviated from their own guidelines and "set-off" David for yet another 60 months (5 years). In the meanwhile, the Georgia Department of Corrections is at 106% capacity, triple bunking men in 8x10' cells and releasing offenders with multiple convictions, poor disciplinary records, and non-rehabiltated lifestyles. What's wrong with this picture?
We, the undersigned are calling for the Board of Pardons and Parole to reconsider the personal file of Mr. David A. Carter and release Mr. Carter on parole from prison immediately.

We believe that David Carter was harshly and unjustly sentenced by Judge Samuel Ozburn of the Alcovey Judicial Circuit, State of Georgia in 1997 without regard to his upstanding social history and the aggravating circumstances that led to David accidentally taking the life of Ronald Pettyjohn.  The District Attorney's office requested that Mr. Carter be sentenced under a plea bargain to 20 years, serve 12 and the court instead chose to sentence Mr. Carter to the maximum sentence at its disposal, effectively punishing Mr. Carter for choosing his constitutional right to trial.

After suffering four plus years of sexual assault, rape, blackmail and emotional trauma, the court failed to recognize the deep emotional and traumatic result of Mr. Pettyjohn's actions upon the life and mental stability and health of Mr. Carter.

In 1998, in a blatant and un-explained deviation from its own guidelines for time served, the Parole Board chose to require an additional five years served from Mr. Carter prior to reviewing his file for parole athough legal statute and their own guidelines afforded Mr. Carter a consideration for parole at seven years.  Now, as of May 2009, having served twelve years the Parole Board has denied our request for parole and is requiring service of yet an additional five years.

Mr. Carter has served every day of those twelve years taking responsibility for his actions, recognizing and correcting the flaws in his character that led to those actions, maintained a completely perfect institutional file and behavior, and earned the respect of countless peers, administrators and officers who encounter him.

For the State Board of Pardons and Paroles to continue to require incarceration of Mr. Carter is unjust.  To release other offenders with similar crimes and multiple convictions is unfair. To continue holding Mr. Carter in prison when by their very own guidelines and countless statistical data says that he should be released with supervision is just wrong. Mr. Carter has done everything he can to rehabilitate himself, taken every class the system has offered, and has every standard of support waiting on his release.  There is nothing more the Board of Pardons and Parole can ask of him that has not already been provided.  A home, a vehicle, a job, a church family and his own extended family.
