We the undersigned are writing and signing this petition on behalf of death row prisoner Larry Swearingen, #999361, Polunsky Unit, TX.  Larry is scheduled to be executed on January 27, 2009 for a murder he did not commit. He was in Jail while the murder in this case occured and the DNA (blood and hairs) excluded him as the biological donor. He was in no position to have committed this crime.
 
Evidence was withheld from medical examiner and the jury; leading the medical examiner at the time of trial to a wrong time of victim's death that erred in the jury coming to a death sentence. The medical examiner reviewed the case in 2007 and reversed her opinion on the date of death, with now four forensic pathologists independently reaching the s ame conclusion - that the victim got killed and her body dumped in the woods while Larry Swearingen was in jail on unrelated charges.
 
We ask that you please stop the scheduled execution of Larry Swearingen based on these facts as far as Texas law allows, and urge a reopening of the investigation, as there is other evidence that points unambiguously to actual innocence. Please show clemency to a father of five kids who is NOT guilty of the crime he was convicted of, and save him from death.

I was pen wriiting with Odell Barnes executed at Hunsville despite the fact that neither Robert Badinter who was heading the Justice Department when Death penalty was abolished in 1981 nor the President of the Frenc Human Association found ANY PROOF of his guilt ! Jack Lang who was heading the Foreign Commission to the French Parliament went to visit Odell on Death Row and wrote a paper in le Monde : " saving Odll Barnes !" I first read about this case fairly recently in one of Lisa Falkenberg's Houston Chronicle reports. I certainly am not a LEO or DA or even a defense attorney...just someone who is concerned about our Harris County Justice system. Back then around the time Mr Swearingen was accused, tried and convicted has been shown to be a black-eye time upon, not only our CRIME-LAB, but also the DA, Houston police and investigators, who ALL seemed to 'possibly' CONTROL and keep funded that crime lab. I don't trust ANY of the convictions between whenever DNA testing started in HC...and whenever HC started getting (CAUGHT) DNA and lab test overturns and reversals of convictions due to crime lab "problems". (I have conflicting reports when that seems to have happened) Nonetheless, we DO have a problem that has been, not only reported on, but substantiated. I think the best possible solution is to FULLY examine and study the new DNA evidence...at the least a new trial should be in order as apparently Mr Swearingen is not shown to be the biological donor of the DNA which was found. You can hate the man for his past all you want but IF he did not commit the crime then the REAL criminal is possibly still free and preying on victims without worry. IF Mr Swearingen is INNOCENT of THIS crime, no matter what kind of person or other crimes he may or may not have committed...the state of TEXAS will execute an innocent (probably, again). How do you sleep at night with this possibility on your conscience? Marie Rogers

Too many innocent have walked the death walk, take one moment and imagine yourself, innocent but condemned anyway, nobody cares, nobody helps you. You are sentenced to die on a certain day or night and you can do nothing or say anything to make these men believe you. You are going to die and you know you are innocent. If you were really able to feel what they feel inside, you would stop this insanity. Compassion, please bring it back.

I truly believe that at least 25% of all individuals in prison in the United States are innocent. The reason for this is the use of public defenders for the poor. The average time spent by a public defender is one to two hrs. on a poor persons case. Years ago people got way two little time for crimes. Now days it is a business and when poor folks get in trouble its almost guaranteed that they will go to prison AND THE KEY TO GET OUT WILL BE THROWN AWAY. THE UNITED STATES HAS MORE PEOPLE IN PRISON THEN ANY OTHER COUNTRY.

No matter what your opinion of the death penalty, even if you agree with it, then one must realize there will be mistakes. Larry Swearingen is one of these 'mistakes'. The evidence of his innocence is overwhelming, please, please at least examine the forensic evidence. Listen and research as much as he has - this is someones LIFE. The most precious thing we have on earth. One life has already been lost, I beg you not to make the count go to 2 unnecessarily.
