ENUMERATED POWERS ACT

The Enumerated Powers Act, H.R. 2458, requires that all bills introduced in the U.S. Congress include a statement setting forth the specific constitutional authority under which the law is being enacted. This measure will force a continual re-examination of the role of the national government, and will fundamentally alter the ever-expanding reach of the federal government. For too long, the federal government has operated without constitutional restraint. In doing so, it has created ineffective and costly programs, massive deficits year after year, and a national debt totaling nearly $7 trillion. The Enumerated Powers Act will help slow the flood of unconstitutional legislation and force Congress to reexamine the proper role of the federal government. For these reasons, every Congress since the 104th Congress I have introduced the Enumerated Powers Act (H.R. 2270 - 104th, H.R. 292 - 105th, H.R. 1018 %u2013 106th, H.R. 175 %u2014 107th, H.R. 384 %u2014 108th). At the beginning of the 105th Congress, the House of Representatives took an important first step by incorporating the substantive requirement of the Enumerated Powers Act into the House rules. Today, the House must cite the constitutional authority for each bill in report language accompanying the legislation. However, the full effect of the Enumerated Powers Act will not be realized until it is incorporated into actual law. Our Founding Fathers believed that granting only specific legislative power to the national government would be a powerful mechanism for protecting our freedoms, while allowing us to achieve the objectives best accomplished through a national government. Congress should honor and abide by the principles embodied in the Constitution %u2013 no more, no less. Respecting the Tenth Amendment, which reserves all powers not granted to the national government to the states, or the people, will ensure that the Constitution continues to truly guide our nation.

You might add a clause to overturn any bill voted into law, when not ONE single member of congress actually READ THE BILL! Like the recent Cap and Tax bill. Are we to become a dictatorship because the Congress rubber stamps whatever our current dictator sends down to them?

Requiring congress to site the Constitutional basis for their laws is not asking for too much. All people in power should need to show evidence that what they are doing is legal. Why is congress so afraid of that?

All 3 branches of government are out of control, seizing far more power than was intended by our Constitution. Government, both national and local, has become too large and involved in our personal lives and restricting personal freedoms. A person who escaped from (what once was) a communist country to the USA stated that he escaped from communism and now the US is becoming communistic. We need to return to the values the Founding Fathers used to draw up our Constitution. I urge all members of Congress to pass this legislation and then refocus on running this country in accordance with our Constitution and Bill of Rights.

We need to save the few organic, small farm, and diversified food options that we currently have. The large corporate farm operations have been responsible for numerous food contamination outbreaks in the past - we need less biased corporate oversite of farming.

The idea that such legislation is now necessary to halt the usurpation of the rights and privileges reserved to the several states, and the people respectively, is shameful. However, passage of this bill is far more important to the survival of our once free nation than any pork-laden stimulus package, or any other bill that has been brought to the floor for a vote in the past several decades. Passage of a bill such as this, with its simple language, is LONG overdue. It is time for our legislators to take a stand, either for the federal government established by the Constitution, or for a continued rapid slide into despotism and tyranny. Cowardice is the only excuse for not bringing this bill to a vote in the houses of congress, and disdain for Liberty is the root cause for any vote against the passage of this bill. Therefore, I urge that this bill be brought before both houses for a vote, and from thence sent to the White House to see whether our nation's chief executive is a champion of Liberty or whether he allows the continued Oppression of the States and of the people at the hands of a federal government run amok.
