Have the U.S. Supreme Court Declare SF 340 Unconstitutional

In July of 2009 the Iowa State Legislator passed Senate Floor 340. This law now sets a tier system for Sex Offenders. With this law now if someone has been convicted of a sex offense they now are either a Tier I annaul registration, Tier II biannaul registration, Tier III quaterly registration. This law was put into effect due to the federal goverments mandating of the Adam Walsh Act.
 What you don't know is that this law does not only effect those who have been recently convicted but it is retroactive to those who already have been sentenced and have completed the requirements of thier sentance. The people many who were considered to be at the lowest possible risk to reoffend are now classified in with the worst possible people like Roger and James Bentley as sexaul predators. This is happening because their victims were under 18. Now they face longer registration requirements, living, employement restrictions, as well as they have to provide personal information internet usernames and email addresses, They also have to personal information of those in the household who have not commited a crime but are required to provide the information because they are living in the home.
 This law is in violation of many rights that can be found in the bill of rights, first amendment freedom of speech, fifth and sixth amendment rights, no due process of law, our miranda rights as well as double jeapordy. This law is supposed to proctect children and families from quote on quote sexaull predator when all it does is group offenders under one big umbrella and does not give account to the treatment programs that offenders must complete. It also does away with the risk assement that has been used for years and has work. The truth is that only a handfull of sex offenders reoffend again they are those who have had multiple victims or who when they were on probation or in prison who just went through the motions of the Sex Offender Treatment Program.
The Sex Offender Treatment Program was set up by the NavCom Brig in laymans terms the United States Navy and it truly works. The military uses this program for those who are in military prisons and it is used in the civilian world as well. This program requires that offenders must revail every detail of thier crimes thoughts and mindset. They are not allowed to withhold any detail about thier lives no matter how small or insignificant it may seem. They are in group treatment and are not allowed to blame thier victims for their crimes and are not deemed successfull until they take full responsiblity for thier actions. They are taught about victim awareness, empathy, and sympathy. They are also taught about appropriate sexaul behavoir as well as relationship and dating skills. Offenders learn a lot about themselves and their victims when they go through this program and it helps them to reenter society and be safe. These are the results of the majority of offenders.
 There are a few offenders like Roger Bentley and his brother James Bentley who are sick and unfortantly will never be cured and they are placed were they belong locked up for life. I bring these two up to remind you of their victim Jetseta Gage she was molested and photograhed by James Bentely and raped and murdered by Roger Bentley.  While it is a tragedy that Jeseta was murdered and forced to endure such horrible abuse. There is a little known fact about this case that has been hidden from the public. Her mother knew these men were offenders and she knew that Roger had multiple victims and was a high risk. She knew what James was doing to Jetseta and she allowed her to go to his home and she dated Roger.  I have sympathy for the family of Jeseta her brothers and others who loved her deeply. Because of the actions of the Bentley brothers other offenders in Iowa must endure tougher laws many who will never reoffend again.
  We need to have the current law declared unconstitutional and a new law put into place that takes into account all aspects of what would make an offender reoffended again. Risk assements and the treatment program must be consireded when determining what Tier an offender must be.
