International petition for Fernando Eros Caro

Mr Fernando Caro was born in 1949 in a farm worker family in California. His mother was a Yaqui native and his father Aztec. Fernando was arrested in 1980 but always claimed his innocence. His trial was flawed by many irregularities and serious mistakes were made. Now, Mr Caro is waiting for a new trial in 2008.

To be on death row for 25 years must be one of the worse punishment inflicted to a human being. That is why we organize this petition and to show our support to Fernando Caro.

Fernando is a very caring person and people who know him can testify that he is a very peaceful man.

This petition is for the next jury but it will be given to Fernando's lawyers.

We the undersigned, citizens of the world, friends and supporters of Fernando Eros Caro, would like to ask each member of the jury, to take into consideration and to examine with great care each of the following facts, in this new trial of March 2008:

Mr Fernando Caro, a 57 year-old Yaqui indian, following his arrest in 1980, was sentenced to death in 1982 then transferred to St Quentin’s penitentiary on death row in California where he is still being held to this day.

During this time, his execution date has been rescheduled 3 times.

In the year 2000, the Supreme Court reversed the sentence of death penalty for Mr Fernando Caro. Despite this reversal, Mr Caro remained on death row awaiting a new trial in 2008.

So far, Mr Caro has spent 25 very long painful years on death row.

We wish you to take into account not only the decision expressed by the Supreme Court, but also the Eight Amendment of the American Constitution which clearly condemns “the use of cruel and unusual punishment”.

During those 25 years Mr Fernando Caro has shown to possess remarkable and undeniable human qualities. He has become an accomplish artist, expressing a very deep sensibility in his paintings, writings, poetry and correspondence to people worldwide.

We hope that each of you, member of the jury, will take all those facts into account, and we are begging you not to bring another death sentence for Mr Fernando Eros Caro.

This is so wrong,Fernando Eros Caro,should not be on death row and most definitely should not be in prison. The DEFENSE ATTORNEY,which is supposed to be someone who helps and supports their defendant/s.Not in this case! this so called DEFENSE ATTORNEY,did not help Fernando what so ever he did not reveal any vital info that should have been presented in the trial.The DEFENSE HEALTH EXPERTS,were purely ignorant and obviously didnt care about Fernando,because if they had they would of assessed him and presented their findings to everyone involved in the trial.If they had done so Fernando probably would have been freed, as an article i found states this:To be justly punished for a crime,a defendant must be found to have actually committed the offense in question and to have had the mental capacity to have committed the act consciously,knowingly and purposefully.It must be clearly proved that,at the time of committing an act,the person accused was laboring under such a defect of reason,from disease of the mind,as to not know the nature and quality of the act he was doing,or if he did know it,that he did not know he was doing wrong.A person is not responsible for criminal conduct if at the time of such conduct,as a result of mental disease or defect,he lacks substantial capacity either to appreciate the criminality (wrongfulness) of his conduct or to conform his conduct to the requirements of the law. A court-appointed PSYCHIATRIST,which advised Fernando to commit suicide,excuse me but i would say that this PSYCHIATRIST needs help! The PROSECUTOR,mislead and lied to the jury,belittled Fernando's mental health,poverty and physical abuse,undermined defense expert witnesses,added irrelevant extras which had nothing to do with the case and withheld crucial exculpatory evidence. The TRIAL JUDGE,failed to record facts,failed to inquire into Fernando's mental state despite knowledge of history,allowed uncharged and unproven allegations,allowed a witness under hypnosis!the TRIAL JUDGE was subsequently investigated himself by prosecution and defense trial attorneys as to his competence to judge and ordered unnecessary shackling during trial in presence of the jury. Fernando Eros Caro should be freed from prison as his rights have been totally violated and the Human Rights act has been violated aswell.
