I will die in prison without an operation!

  On October 21, 2002, Jerry Wayne Mooney was shot during a stand off with Ivrine, Texas Police.
A former bodyguard for recording artists with Universal and Paralaxs Records. He had no history of violence, and claims that he was suffering a bi-polar episode. Here is his story told in his own words:
 
  On October 21, 2002  I had a bi-polar episode. It was about 10:00 p.m when I left my home that night and in my muddled state I wanted to end my life. My family called 911. I had my Glock 19C pistol and my SKS rifle. I went  to a friends house but he had already gone to bed, so I left my rifle there and with my pistol in my pocket I headed for another friends home. While in my friend's yard I watched the cops pull up next door and Officer Vanderin walk into the yard as I stepped out of the bushes to commit suicide by cop.


  My depression plummets and I hear a voice that tells me, "You have to die, you have to die," so as Officer Vanderin walks into the yard I thought, who needs this anyway and I did as the voice said. I stepped out of the bushes and held my arm at a 45 degree angle, away from the officer, and started pulling the trigger. I squeezed off what I felt to be 8 rounds. At that point something snapped in me and I realized I was really messed up. So I threw my pistol behind me into the yard and I laid down on the ground without ever having to be told. As I was laying there Officer Vanderin had no intention of taking me into custody and he began shooting at me.


  I was laying there unarmed and was struck 4 to 5 times with .40 caliber rounds, and then there was a pause in his gunfire. Then 5 or 6 more rounds tore through my abdomen to shred my intestines and one tore into my left lung. Later I would understand that this is when Officer Orr  began firing at Officer Vanderin muzzle flash, thinking it was me.  A certain amount of time goes by as I distinctly remember hearing myself moaning and remember the dirt in my mouth and my wind pipe, from the massive breath I finally drew in, after being hit with nine  .40 caliber slugs.
I also remember the distinct taste of decomposing leaves. They taste just like they smell.


  Anyway, as I was laying there moaning I feel more bullets tear through me. Like a horse kicking you over and over, burning and ripping through you. One bullet shattering my left femur. Then I heard a voice say, " I think he's had enough. " Then I hear another voice ( Officer Orr ) say, " Aw let's give him one more. " Then the last bullet was cycled into my back just on the left side of my spine. This bullet would leave me paralyzed for some time.


  I was told they left me laying on the ground for about 45 minutes before be placed in the ambulance. My wallet, social security card, drivers license, phone numbers, and other important information never made it to hospital with me.


  For the next month and a week I was at Parkland Memorial Hospital. I spent like thirty days in I.C.U. intubated, sedated, and tied to a bed so long I now have a sizeable scar on my left wrist, and my lungs collapsed, and have several notations of suspected HYPOXIA (over 41 min-duration).

  After being let out of I.C.U. while still in the care of Parkland, my parents witnessed a nurse stating the he would deny me my prescribed morphine if he wanted. In fact, on several occasions he did just that stating that, I need to think about what I had done! I know I was released a month too soon and I should have remained there and been on  the morphine drip.


  When I was loaded up to be taken to jail the hospital orders were that I was to be given aid with walking. I was forced into a 1 ton van that sits really high up and they made me climb out on my own. I expressed how I couldn't and was given instructions to climb out and fell on my face with a huge hole in my abdomen and a broke leg. My leg is still messed up.

  The treatment at the jail wasn't any better. I came-to in a wheelchair, and while I awaited the booking procedure, I couldn't even ask for water or my colostomy bag to be tended to. I don't even know how many hours I spent in that wheelchair with only one paper cup of water.


  The discharge instructions from Parkland were if I had any of a number of symptoms that I was to be brought back to the hospital emergency room, things like high fever or "any worsening of my condition." Instead I was stripped and placed in a solitary confinement cell with nothing. No blue lumpy mat, nothing! I had a high fever and felt as if I was freezing to death, I would have rather froze to death than suffer all the pain I was about to suffer.


  I was denied most of my pain medication and even my appointment with the trauma clinic. The day after I arrived at jail I was taken off suicide precaution, but would still be denied everything and kept in solitary confinement for over 60 days. I would be forced to clean in horrific unsanitary conditions. All the while not being properly bandaged properly for open bullet wounds caused a festering skin graft, which in turn may have caused me a staph infection. There's no telling where I got the staph infection but it was one of the worsting conditions that I was never taken to the emergency room for!


  My stomach became recessive and began bleeding as well as DERMA deterioration. At one point the judge was going to release me on a P.R.bond but was met with huge opposition by the Irvine Police Department and the Channel 11 News that was brought into the mix. They showed up because the Irvine Police Department said the judge was letting out a COP KILLER. I was denied the bond!

  About a month later I was kicked out of jail inexplicably. The P.R. bond had found it's way back into the system. I was let out on a Friday afternoon, we called my lawyer to thank her and she said it was mistake. Monday I was told there was a warrant for my arrest.


  A friend suggested that I leave the country but I thought justice would prevail, it did not! I knew if I didn't turn myself in the Irvine Police SWAT Team would finish the job. I also thought that turning myself in would go favorably for me, and show that I was a person who cared about doing the right thing, and it did not!


  When it started coming time for trial it would always come up that I wasn't capable medically. It never came up from a mental standpoint. Close to the trial my lawyers went to my family and asked them how I should plea and they said, not guilty. Well that wasn't the answer that they wanted to hear so they came to me with all of the reasons that I should plea guilty.


  My lawyers told me that they had talked to Judge Francis and he says he knows your not a threat to society and if you come to court and plea "OPEN " then he is going to give you 10 years. The assistant D.A. is the most ruthless prosecutor  I've ever seen, she says she is going to give you 99 to life. What can you say to 10 or 99?


  Anyway I went into the court and answered a bunch of questions that I can't even remember. I also heard a bunch of lies. I told my lawyer that they were lies, and I was told, too late, you already plead guilty.  I was then sentenced to 45 years in prison!


  I didn't shoot at or shoot anybody. If this case had gone to trial I could have proved by ballistics that the bullet that stuck Officer Vanderin were fired from Officer Orr's weapon! Over and over I'm living proof GOD still works miracles. The number of bullets that I was hit by well, I should not have survived. Over the last six years my pain and suffering is more than I can endure, and my health is deteriorating, and I need an operation or I will die, one that is being denied to me by the State of Texas.   Justice For Us, is appalled by the lack of medical care and services that Mr. Mooney is receiving from the State of Texas. They try to claim that he is faking this whole condition, and the proof of his condition is this photo of him, NO ONE SHOULD HAVE TO LIVE LIKE THIS! It is bad enough to be in prison for the next 40 or so years, but to be in this condition of human suffering is a crime itself!  The State of Texas has no compassion for this person, or probably anyone else within their custody!

I can't believe the excesses of the American authorities. Give this man a new trial and give him his freedom. Allow him the medical treatment he needs, with pain killers. Stop calling him a cop killer and try, for once to deal with a case in a reasonable and calm manner, rather than the American norm of hysteria!

This is disgustingly inhumane. The Texas justice system has a very, very bad track record. But I've never ehard of anything like this. In Virginia we have a state motto that I think applies to the Texas justice system. Sic Semper Tyranus, "Thus always to tyrants." For more information see our flag.

Well seems like the police are doing a lot of covering up for the officer who shot both of these men..Firstly Jerry needs to be admitted to a hospital and given the treatment he deserves as a human being. Secondly the officer who shot the other officer needs to be taken to the prison and locked up himself. I have heard of a lot of Police coverups but this one is the most disgraceful I have heard of.

Dear Lord in Heaven! Is everybody in Texas that is involved with this BRAIN DEAD? This man obviously needs an operation and he is being denied it? Why? Did anyone do a ballistic test on the bullet that stuck the officer to asertain if it came from the suspects gun? Did they check the other officer's gun? Only in Texas! I have heard horror stories about their system of justice and this is one more case to add to the ever growning injustices perpetrated by Texas. That is one state I will stay out of for sure. It is appparent that this man needs surgery. This man is not mentally well if he is bi-polar. He needs treatment and medication which is something that the prisons in Texas seem unable to understand. Next time before people start shooting at one another, take the time to get to the bottom of the problem. One shot to disable, yes but the behavior of these police officers was in excusable. They sound like facists to me.

It is appalling that my "home" state denies basic medical care. It is appalling that he is even in prison. Those "officers" must have been trying to cover up their own mistakes and are using him as a scapegoat. The hospital should be investigated for any other patient abuses, because they did abuse and were negligent with Jerry. Who knows how many other people have suffered like this? It doesn't matter, because even one is too many.
