The officers turned themselves in at the Brooklyn district attorney's office Tuesday. The indictment had been handed up by a grand jury last week.
Defense attorneys say the officers didn't do anything wrong.
"We don't know what the people's proof is, but as far as I'm concerned my client is not guilty," said Kern's attorney, John Patten.

Police said the three officers approached Mineo on Oct. 15 outside a subway station because they believed he was smoking marijuana. Hynes said Tuesday that Mineo fled into the station and jumped two turnstiles before he was pinned down and handcuffed.
Mineo, a 24-year-old body piercer, claims that during the struggle his pants were pulled down and one of the officers sodomized him as he screamed in pain. He says he believed he was violated with the antenna of a police radio and that the assailant was Cruz.
But a transit officer called as a grand jury witness early last month testified that he saw Kern holding a baton near Mineo's buttocks, according to law enforcement officials.
Mineo was given a ticket for disorderly conduct and released. The district attorney said police threatened to arrest Mineo and charge him with a felony if he reported the episode to anyone.
Mineo's attorney, Kevin Mosley, said he was thrilled by the charges, particularly with the count alleging hindering prosecution.
"A message has been sent: The police cannot hinder and cover up bad cops," Mosley said.
Mineo was hospitalized for several days. Hospital discharge papers show he was diagnosed with "anal assault."
The attack has rekindled memories of the case of Abner Louima, a Haitian immigrant who was sodomized with a broomstick in a police precinct 11 years ago. That case ignited racial tensions in the city and led to convictions against the white officers.
But the reaction to the Mineo case has not been as intense. Mineo is white, and the officers are white, Hispanic and black.

I had a top health Food Business, but my local police( of my business location) liked my business insurance policy better than my vitamins. I was warned to keep my mouth shut. A judge came to my place of business and told me that these guys are just a gang with a badge and would have me murdered if I pursued it! It was all over the news. I need an attorney . These guys got away with a lot of money and the presiding judge disallowed the wife's confession that the " guys did it because they felt sorry" for her and her husband. I contacted the justice department and they told me to contact....MY LOCAL POLICE DEPARTMENT. They ruined my business, got away with 1.2 million. I was followed, harassed and warned " keep your mouth shut!". They tried to get me on criminal charges for something I did not carry so they could insure that they would win my business insurance policy. When they found out that I did not carry the product, somehow the name of the product mutated to something I did carry. The emergency room and the pathologist admitted that what the wife brought in was the other product, even though the Sargent who had a stroke did not have anything in his system.I contacted the FBI because of the false charges and harassment. When the police department found out that I knew that the Sargent was running on his day off, the police department switched their story to say that this Sargent was " researching terrorist activities" ...on his day off. The FBI told me in no uncertain terms that this was not true. ...The police department wanted it to look like he had a stroke while working on the job and taking something from my health food business. It never happened. I was told later that the wife devoiced her husband and married the attorney. They ruined my business. I paid my taxes and obeyed the law! The district attorney's office tried to discourage me from pursuing justice. Even the local mayer kept telling me every day that he would help....for 2 years until I found that the statue of limitations was over! Yes, we need a citizen review board that does not have any police, or chief of police. In my case , a Sargent admitted that the Chief of police told him what to say. This was disallowed in court. Until we have a citizen review board I ask myself" How many America's are there. I guess it depends what news channel I tune into. We need a citizen review board. And an investigation for every complaint with a receipt. If any complaint process is interrupted by intimidation of a police officer, there needs to be a follow up. It must be the law that there can be no intimidation and there must be a receipt number for every complaint which must be followed up by the department of Justice. No exceptions. Hay If you get a receipt for making a complaint at Penny's , Coco's ,or the USPS, Why not get a complaint receipt when our rights are violated?????? We need to wise up! It's time for a paper trail. Now!

Police abuse is happening in EVERY CITY! The police these days are BIAS, DISCRIMINATING, Lazy in doing a through job of investigation. We have nothing but young punks working for US. There must be a seperate and well funded investigating police complaint group. People are afraid to file complaints because of retaliation. STOP POLICE ABUSE.

The defence attorneys for the Police Officers and the Police Officers themselves who think they have the right to abuse people and encourage it at the same time to their co-workers the way the do should be in jail for a long time.. Do you really think each one will ever change as a person? Perverted Sexual Attacks on innocent people, set ups to cover the truth of crime within their Department, Racist Vicious attacks on minorities, Hate and disgust for anyone who is standing up to them? The injustice of so many officers in this country makes us all feel as though the streets are more dangerous with than without them. Better judgment. and psychological screening tests need to be used in the hiring process, or a rebellion will certainly be on the horizon.
The police (they can be any race not just white) that are attacking innocent civilians need to stop these senseless acts of violence. The police are supposed to protect innocent people (no matter what race they are) from the true criminals out there and not harm the innocent and cause innocent civilians to mistrust the same people who are supposedly trying to protect them! END SENSELESS POLICE BRUTALITY NOW!
