Recognize Life in Tennessee

On June 1, 2009 my son, Wyatt Nathaniel Finchum was born at 10:03 a.m. He had a faint heartbeat and was breathing, which was a miracle, as doctors advised us we would probably never see him alive. He died two minutes later. However, due to Tennessee%u2019s definition of %u201Clive birth%u201D, my doctor was not able to medically acknowledge his life. He was listed as stillborn. 

 

I won%u2019t deny the fact that my son was dying as soon as he was born, but he lived... he fought to breathe for those two minutes and his life deserves to be acknowledged. I would like to get Tennessee%u2019s definition of live birth amended to a more acceptable definition that recognizes life no matter how short it may be.

 

It currently states:

 

"...the complete expulsion or extraction from its mother of a product of human conception, irrespective of the duration of the pregnancy, that, after such expulsion or extraction, breathes or shows any other evidence of life, such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, whether or not the umbilical cord has been cut or the placenta is attached. Heartbeats shall be distinguished from transient cardiac contraction, and respirations shall be distinguished from fleeting respiratory efforts or gasps..."


I propose the definition to be changed to the State of Maine%u2019s definition which states:


"...the complete expulsion or extraction from its mother of a product of human conception, irrespective of the duration of the pregnancy, that, after such expulsion or extraction, breathes or shows any other evidence of life, such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, whether or not the umbilical cord has been cut or the placenta is attached. Each product of such a birth is considered live born and fully recognized as a human person under Maine (change to Tennessee) Law.%u201D

I personally believe that any action, whether voluntary or involuntary, that is a sign of life should be considered as a live birth. No matter how labored a breath, or slight a movement, if it an action that a healthy child would do when born, then it is a live birth.

That baby was born and was a live for a reason - maybe it was for the simple idea of getting this law changed. Maybe his reason and his deed was only for two minutes. Maybe that is all it took. His plan was fulfilled. God bless him and his family. He was alive. He had a heart beat while in his mothers womb. That ended after two minutes in this world - he breathed ! He was alive! It was short but to the parents it was sweet. God bless them!

A heart beat, is a heart beat. If someone was clinging to their life and their pulse began to slow down, then they would not be considered dead until the heart completely stopped. We don't count the "time of death" as when the heart starts to slow down, but when it stops completely. So, if there is a heartbeat, then there is life.
