Four years ago Sean Goldman was abducted to Brazil by his mother Bruna Bianchi Goldman and her parents Silvana Bianchi Ribeiro and Raimundo Ribeiro. After her recent death, the man recently married to Bruna, João Paulo Lins e Silva, was shockingly awarded custody by a Brazilian court. Ever since the kidnapping, David Goldman has waged a legal battle to have Sean returned as required by U.S. law and an international treaty signed by both the U.S. and Brazil.

On June 16th, 2004, Bruna Goldman traveled with her son Sean from their home in New Jersey to her native Brazil. The next day, she informed her husband David Goldman that their marriage was over and that she and Sean would be living in Brazil. This unilateral action was a violation of the Hague Treaty on International Child Abduction, a treaty signed by many countries including both the United States and Brazil.  It states that Sean should have been returned to the United States for a joint custody hearing.

Instead, Bruna Goldman was granted custody by a local court in Brazil. According to the United States Department of State and the Brazilian Central Authority, this decision was also a violation of the treaty. However, the Brazilian Central Authority which oversees the treaty is advisory only. As a result, David began the appeals process, which in Brazil can take years to complete.


In August 2008, Bruna died tragically in Brazil. After Bruna's passing, David Goldman assumed he would finally be reunited with Sean. Unfortunately, David finds himself in the midst of another custody battle, this time with Bruna's new husband, João Paulo Lins e Silva.  Mr. Lins e Silva has also filed to replace David Goldman's name with his own on a birth certificate issued for Sean in Brazil, claiming socio-affective paternity which would effectively erase the child's true paternity.

Since 2004, David Goldman has fought a desperate and expensive legal battle for custody of his son, first with his wife and now against João Paulo Lins e Silva, a prominent lawyer specializing in international family law. Since the original abduction, David has never been permitted to see Sean and just this past October, Mr. Lins e Silva failed to make Sean available for a scheduled visitation with David and still has not been held accountable for violating a federal court order in Brazil. According to the Hague Convention on the Civil Aspects of International Child Abduction, Sean should have been returned to the United States within six weeks of the abduction for a custodial hearing because his habitual residence had been established in the United States.

O Sr. João Paulo também abriu processo para retirar o nome de David Goldman da Certidão de Nascimento Brasileira da criança e substituir pelo seu, alegando paternidade socio-afetiva. Isso, na verdade, apagaria a verdadeira paternidade da criança.



Desde 2004, David Goldman luta desesperadamente pela custódia do filho, primeiro com sua esposa e, agora, com João Paulo Lins e Silva, um renomado advogado especializado em Direito Internacional da Família.




Desde o sequestro, David não recebeu permissão de visitar Sean, Como exemplo, em Outubro de 2008, o Dr. João Paulo não entregou Sean para uma visita marcada pela Justiça Federal e ainda não foi processado por violar uma decisão da justiça.

We the undersigned state the following:


We believe it would be unconscionable to grant custody to a non-relative when a parent of good character has continuously demonstrated a desire for custody.

All claims for custody of the Lins e Silvas are a direct result of the illegal abduction of Sean by his mother Bruna.

We believe that it is in ANY child's best interest to be raised by his natural parent unless that parent is declared to be unfit. Further more, it is a God given right of parents and children to be together whenever possible.

We request that Minister of Justice Tarso Genro take all appropriate actions to ensure that Brazilian judges understand and respect Brazil's commitment to honoring the intent and spirit of the Hague Treaty for all cases of child abduction.  Additionally, we ask that he appeal to the appropriate judges to therefore grant David Goldman's request for the immediate return of Sean Goldman.

We request that all elected and appointed Brazilian and American officials work to ensure and expedite the return of Sean Goldman to his father, David Goldman.


Finally, we request that the Brazilian and American media recognize that the ban on publishing this story instituted by the 13th Civil Court of Rio de Janeiro is not intended for the protection of the minor child as claimed, but for the protection of Lins e Silvas from the consequences of their unethical actions and that therefore this order is unconstitutional. We ask that these organizations join in giving this outrageous and tragic story the international attention that it merits.

Seria um ato irresponsável entregar a custódia de uma criança a uma cidadão sem relacionamento sanguíneo algum com a mesma, sendo que um dos pais, de caráter inquestionável, demonstra, continuamente, seu desejo de recuperar a custódia de seu filho.


Qualquer demanda de custódia por parte da Família Lins e Silva é um ação resultante do seqüestro de Sean Goldman, efetuado por sua mãe Bruna Bianchi Goldman.


Nós acreditamos que o melhor para uma criança seria a educação recebida por seu pai natural, a não ser que o mesmo não se encontre em condições para tal. Alem disso, a união entre pai e filho é um direito dado por Deus.


Nós solicitamos que o Sr. Ministro Tarso Genro tome as ações necessárias para garantir que os Juízes Brasileiros entendam e respeitem os compromissos do Brazil perante as intenções da Convenção de Haia para todos os casos envolvendo sequestro internacional de menores. Adicionalmente, solicitamos que o Sr. Ministro apele para o Juiz indicado garantir a execução da solicitação de David Goldman para o retorno imediato de seu filho Sean Goldman aos EUA.

Nós demandamos que toda e qualquer Autoridade, eleita ou apontada, brasileira ou americana, trabalhe para o retorno imediato de Sean Goldman a seu pai, David Goldman.


Finalmente, demandamos que a imprensa brasileira e americana reconheça que a proibição de divulgação do caso, instituído pela 13a. Vara Cível do Rio de Janeiro, não tem como objetivo a proteção do bem-estar do menor Sean Goldman. Ao invés, tem como objetivo proteger os interesses da Família Lins e Silva resultantes de sua falta de ética no caso acima mencionado. Pedimos que tais órgãos da imprensa dêem a cobertura merecida a essa história trágica.

I truly understand your heartbreak in this case. I think it is appalling that a country is rewarding a kidnapper by allowing a non blood relative to continue to have this child. That attorney and his now deceased wife kidnapped this child. He cannot have a vaild relationship with his Father because of those people. How can they be rewarded for this action. To me this is the equalvalant to a stranger kidnapping your child for 5 years and then getting to keep them because well that's the only person they have ever known. That would never happen so why is this situation any different because it was a parent that kidnapped the child. Please return Sean to his real and only parent so that he can build a relationship with him and hopefully get past these events with his biological family he has been torn away from.

As a teacher & a U.S. citizen, I say this is a travesty. Why is OUR government not doing anything to help? Sometimes I think that mostly women's parental rights are cared for & acted upon. How about a FATHER'S rights? How about a CITIZEN'S rights? How about HUMAN rights? How about some JUSTICE? I do not know this man personally, but hearing of his plight, makes me realize the INJUSTICE of it & the helpless he must feel, since it seems that he is not being helped by our government. There has been a profound injustice done to David Goldman and his innocent son, Sean. To live your life without a Dad is so hard. To live your life without your Dad because of a legal system that prevents him from having access to you is simply unforgivable. Please, please end this insanity and return Sean home. He deserves that, and so does David.
