reverse 15 year conviction for being gay in missouri

tim guerra was convicted in 1996 for 2 counts of promoting child pornography in the first degree for video taping his 17 yr old lover in a sex act. he received 2 15 year sentences and served appx 13 years in prison. after almost 4 years in prison he discovered that he had been lied to about the actual legal age in missouri for his crime. instead of the legal age being 18 as they told him, it was 17. there was in fact, no crime committed. he was convicted knowingly by the state just for being gay in the wrong place at the wrong time! now, the state refuses to allow an appeal of the conviction because he did not discover his innocence until after the time limit for appeal was up. he currently has a petition filed in cole county circuit court but the state is not arguing that he is actually guilty of anything, only that he is out of time.

This is an outrageous miscarriage of justice. How can it be justified to spend tax monies to keep an innocent person who is NO danger to society, in jail? on a mere technicality?
