Kinship care givers are forgotten in the child and safe family act put into law by former President Bill Clinton, it puts an estimated 1.35 million children each year in the United States in jeopardy. This law gives the children in foster care for 15 of the most recent 22 months the rights to be adopted and terminate the parental rights.  'Great Law' for 'them', however it forgot the 1.35 million children who live with grandparents or relatives  for years because of abuse or neglect and sometimes just abandonment.  These caregivers want to adopt these children and terminate the parents rights. This oversight in the wording of this law makes the parent able to get the child returned to the unsafe or unstable environment that the child has been safe from by living with the grandparents or relatives. This is not to mention the 'abandonment'  by the parent for years.  When these people approach the courts to adopt and terminate parental rights the court system WILL return the child to the birth parent just for the asking and make the grandparent or relative caregiver pay for the birth parents lawyer fees.  We need to change three words in this law to state "and kinship care"  then start getting these children back into the only home they have ever known. All that the 'kinship caregivers want is three words added to an already established law' because  3 little words will save 1.35 million children each year in the United States!  It will save YOU the taxpayers,  millions of dollars in court involvement, welfare benifits, hospital bills,  therapy for the child ...

UPDATE: This specific child mentioned below, is now one of 5 children living on welfare with her biological mother who admitted in court to being mentally unstable and disabled. Because she was the birth mother the child was returned to her mother after 4 long years of being forgotten!

It is a long story. Kinship caregivers have been left out
 of the law 'child and safe family act' by former president
 Bill Clinton, it forgot to protect the 1.35 million children
living with relatives whom would adopt them if the Court
 would follow the same laws established for fostercare
 situations. I live in Michigan and this last week on
 May 17 2006
I had to put her into a state workers car and buckle her
in the seat while she cried 'mama I don't want to go away
 with him, I want to go home with you and daddy'
We lost my granddaughter whom I had for 4 of her
4 1/2 years and 2 1/2 of these years I had custody from
the State of Georgia stating if mom did not petition the
court within 2 years and show significant changes, then I
 was to seek permanency in my state. These papers
 expired 9 months ago while waiting for my court date.
I tried it and the judge returned the child to the mother
even with my lawyer proving her to be unchanged and the
mother admitted it. The judge returned the child to
her mother and ordered me the grandmother to pay the
 mothers lawyer fees! This child does not know who her
 mother is and only seen her for maybe 10 hours in the
past 3-1/2 years and she still did not know who this person
was. I get no visits and lost my 'child' to the city life her
mother is living and she now has two smaller children...
 bringing me to you and all the readers for help.
I have my state representative willing to help change
the wording in that law to help all of us who are raising
 relatives children with no real legal safety. I found that
 if I can get each person who agrees with me that the child
 should have remained with me since the mother did not
comply before the 2 years was over with significant changes
and that the court should have terminated her rights and
allowed me to adopt her, then maybe we can get this
 judge removed and then get this child returned to us
where she wants to be and needs to be.

My husband and I are currently having my two year old half brother placed in our home. My father and the child's mother have made no moves to regain custody of him in the entire two years the baby has been on this earth. The placement is supposed to be permanent, with us able to adopt him after so much time has passed. There is absolutely no way I'd send him back to them. There are SO many things wrong with my father raising a child, and unfortunately, the baby's mother is mentally unstable. We need these laws amended to include families like ours. Please sign!

I have had custody of my niece for 5 1/2 years now and in the process of adopting her. Thank God her biological parents are doing what is right for her. If they wanted to fight me they could and would probably win. The laws don't protect the best interest of the children. The parents are not always the in thier "BEST INTEREST". Most of the time they are the complete wrong choice. I think if they want to get their children back they should have pay for the time they didn't have them. They surely didn't come free all that time. Someone had to make sacrafices they didn't make while they were out living "high".

It is grossly unfair for grandparents caring for grandchildren to be put through emotional and financial turmoil at the whim of the child's parents (who are often our own children) and the courts. The law needs to be changed so that children stay in loving, caring, consistent environments and not be returned to parents who are unstable.

I am going through a situation trying to adopt my granddaughter but I do not have a suitable income that meets DSHS requirements. I have custody of three of her siblings and they are tearing our family apart. I have sent letters to every one I can think of even the meida and no response, NO-ONE cares. Not that this petition would help in our sitation, but I hae a 9 yr old Grandson who is now in the custody of his Father, My Son a US Marine. His mother was busted for having a meth lab, left my Grandson with a homeless man she had judt met and pick up aff the street that day. Since being in my son's custody, he has also reported that his mohter's boyfriend used to beat him with a leather belt. He was too young to know how to count so he doesn't know how many times a day it would happen. She was ordered to stay away from this man, we know a recently as Dec. 06 she has been with him. Last Friday, 8/10/07, she was given back all rights except for phisical custody, my Grandson must now inititate all phone calls to her because it is long didtance, she with holds contact with his father and the FOC Ref sclodes my son because it is his choice to be inthe military and his choice to move from MI. Yes it is his choice to be a Marine, but I don't know where she gets the idea that you can dictate to the Federal govt where you're gonna live. I bet all our troups on the ground in Iraq are please to know that they chose their duty station.
