 I totally support this petition and wording, the support to SAVE SMOKEY'S life and give him a fair chance at life!..That is the only morally just thing to do. SMOKEY if love could penetrate the prison you are now being held in, if it could penetrate right through to your heart, you would know SO MANY OUT HERE LOVE YOU and would NEVER HAVE HURT YOU and we are so sorry you have had to live the horrors only YOU and those who abused you know of.......we would do and will pray for whatever it takes to give you that chance, to heal in your broken body and spirit and to know the touch of a gentle hand, and kind words and patience and understanding. XENIA ~ Smokey the dog's chances to avoid euthanasia may have improved Friday, Aug. 20.

The black-and-tan, 5-year-old Rottweiler/collie has gained a measure of fame due to media reports about him facing death after a Fairborn couple were charged with beating him with a baseball bat and hitting him with a car.

The dog with a history of aggressive behavior toward people will spend the weekend in the Greene County Animal Control building before county officials meet Monday to determine their next move.

Animal Control Director Harold Brown said he%u2019ll meet with the county prosecutor%u2019s office about legal issues and no decision on Smokey%u2019s fate will come before Thursday, Aug. 26.

%u201CPublic safety is our No. 1 mission,%u201D said Brown, adding that Smokey will never be eligible to be adopted in Greene County. %u201CThere are many cases where these dogs do go to sanctuaries, and I%u2019m not opposed to that as a possibility.%u201D

Smokey%u2019s owner, Ellen Barney, re-filed a form Friday from requesting euthanasia to a release to Greene County. Barney said her nephew suffered a lacerated nose that required surgery from an unprovoked bite from Smokey Memorial Day weekend. That incident was documented by Dayton police. The dog was healthy when it was quarantined for 10 days in Montgomery County.

Brown said Barney gave the dog to her niece, Chasity Elliot, 20, and Elliot%u2019s 44-year-old boyfriend Robert Proffitt, to give away.

The pair admitted to police they hit the dog with a Louisville Slugger baseball bat and a car. After media reports, Smokey had a Facebook page created for it by a woman from Australia. There are at least two online petitions signed by more than 1,400 people around the globe asking for Smokey to be saved.

%u201CThere are animal-rights activists calling us left and right and sending us hate e-mail,%u201D one Animal Control staff member said. %u201CThey say it%u2019s not just about this animal, it%u2019s about the big picture.%u201D

Elliot had reported to Fairborn officials that Smokey had bit her. Animal Control officials questioned the truthfulness of the bite report. That office worked with Fairborn police to determine that Elliot and Proffitt had injured the dog.

Elliot and Proffitt plead not guilty to animal cruelty charges Aug. 19 in Fairborn Municipal Court. Their next hearing is Aug. 31.

Brown, a licensed veterinarian and former dog trainer, said Smokey seems fully recovered from his injuries, but that he does not have the temperament to be a pet. He emphasized prosecutors have charged Elliot and Proffitt with the maximum crime possible.

A similar case in Toledo led to a dog named Sarge being moved to a sanctuary in Utah, where the dogs from the Michael Vick dogfighting case went.

UPDATE: as of Aug 17 I received an email from the director at Greene Co Animal Control Harold Brown, who said many things that did not show any compassion for SMOKEY and in fact has said that he found the original owners of Smokey (relatives to those who had him and beat and ran over him in their car), and she has released him to be killed, and he has said he agrees it is the right thing to do, to KILL SMOKEY..he claims Smokey is aggressive, how would anyone be after all this abuse?  A plea has been sent out to allow him to go to a qualified rescue for rehabilitation...Please continue to sigh while work is being done to try to secure a plan to present to him to save SMOKEYS LIFE!..Thank you for helping and caring...

To Whom it May Concern, We the undersigned, the people of the World, of civilized society, of Ohio,  of and for all living beings, ask that Smokey be given a chance at life, something he has never had considering the home he has been forced to reside in, being neglected, abused, then tortured and those he lived with trying to kill him. No one has any right to beat an animal then run them over. He nows sits like a prisoner fate unknown suffering great physical and mental damage while he is innocent!...And those who have committed horrific CRIMES against are free.
