I am writing this letter today to bring your attention to what USA Today named the 11th largest mortgage servicer (6/26/08), PHH Mortgage, with headquarters in Mt. Laurel, New Jersey. What is a mortgage servicer? Perhaps you could shed some light on that. But more importantly, why is a company still in business with three lawsuits and a class action lawsuit against it, 125 Better Business Bureau (BBB of NJ) complaints against it, and hundreds of complaints against it on various websites? I understand that we made a commitment to pay our mortgages but we were never given a chance to choose who would service the mortgage and we certainly did not choose PHH Mortgage. Plus, I have yet to find a way to switch my mortgage servicer as I would my cell phone provider.
Please for a moment think of our consumer society. We can choose among a few cell phone carriers and we can decrease or increase our monthly plans when needed. We can choose between cable, satellite, or antenna for our television watching. We can choose to decrease our cable channels to save money. We can decrease our grocery intake, electricity usage, and traveling to save money. We also expect to be able to adjust our mortgages if needed.
I understand that in years past, the banks would just take your house or car if you didn%u2019t pay for it. But, we are in a completely different era now. We are in the era of the AIG and bank bail-out controversy. We have seen Wall Street rewarded time and again for breaking our trust and making money because rules were not there and their moral compasses were broken. We were fooled and we deserve regulation, honesty and fairness.
I am a victim of PHH Mortgage%u2019s bad business practices and I am not alone. When the taxpayers bailed out AIG and banks, the situation generated plenty of media and congressional attention. Shouldn%u2019t mortgage servicers such as PHH Mortgage receive the same amount of attention? After all, what are they? What do they do? What rules do they play by? Why can%u2019t we choose and switch our providers? PHH Mortgage and others like them are doing damage to many Americans by placing a scarlet %u201CF%u201D for Foreclosure in their credit reports. Don%u2019t we deserve more from a company that can harm us so much?

These crooks miscalculated my payments and tried to prematurely foreclose on me. They also posted my escrow incorrectly and lost $911.00 of mine beside lose a payment! BEWARE! CHECK YOUR COUNTY RECORDS! The loan modification that I signed was changed by them before they recorded it. I think this is called fraud. They kept the page that had my signature but changed the name of the bank, dates and descriptions of my lot! The loan modification was a joke – they added $22,000.00 to my note charging me for attorney fees and others unnecessary costs. This servicer/bank take our tax money to stay afloat but meanwhile they are padding it on to their assets. Isn’t that like being on welfare and working under the table? Why are they allowed to continue on with so many complaints? Wake up WASHINGTON! It’s happening right before your eyes! Nobody is listening or paying attention. It has been a total nightmare! This company has created fraudulent documents and recorded them in the county records! They mailed it in so that is MAIL FRAUD! Prior to the loan modification, they made 36 error to my account since 2005. I could go on and on…. somebody please – investigate this company! I complained to the State of Michigan about them beginning around June 2008 and they tell me that they are still reviewing my complaints! They continue to lie to the state but I have had proof of everything they have done. I just don't know how many lies that they are allowed to tell and get away with it. I have contacted the FBI and they claim it is definately fraud. Look up PHH… you will see that we are all experiencing the same situations. They have caused me so my stress in my life! After the loan modification, I owe $22,000.00 more on my note and my payment is higher than before. UNBELIEVABLE. I didn't even want a loan mod. I just wanted them to find my missing payment and find $911.00 of missing escrow they lost somewhere... If I didn't sign the loan mod - they were taking my home. I signed to save my home but I am not stopping until somebody stops them from stealing our homes! |

After going through Hurricane Gustav and being hit by a drunk driver and disabiled, and contacting an executive at USAA,you would think that I would qualify for a forbearance plan, or that PHH would allow me to have a face to face meeting with them like I requested, but all I got from them was a letter from one of their attorneys asking me to take down usaamemebers.com, and that they want the domain name as well. I was using the site to list my complaints about USAA and PHH mortgage online. I have asked for certified copies of my original mortgage papers and proof to show the loan is valid. They have denied me at every turn and given me nothing but a hard time and automated phone calls everyday asking for their money. They have done nothing for me lately, and I plan to file a civil suit.Has anyone out their filed any civil suits against them? If so could you send me a copy at webmanstudios@gmail.com |

PHH Mortgage has done nothing but lie, cheat, and drag their feet to insure we are trapped by them forever!
Just today, after 36 minutes on the phone getting the run around and being passed to 4 different people to speak with, the last person said they were transferring me to a voice mail where I have to give my name, address, loan numer, and someone will call me back. After all of this mumbo jumbo of these people not having a clue to answer basic questions, the voice mail message never beeps and simply hangs up when I'm leaving a message. So I have to call back and go through the entire process over, which results in nothing. & people involved on the phones and they accomplish absolutely nothing. It's pathetic. They don't seem to want to help, yet they took our money in interest, as well as were very on top of it regarding this bogus loan that was jacked up in price one year after getting.
PHH sold the second mortgage to Green Tree 60 days into a reuqest for a Short Sale.

PHH will not let us pay our mortgage because they sent us a forebearance package. If we reject forebearance now they can foreclose now.

On May 13, 2009, I submitted a letter explaining all the circumstances surrounding my mortgage payment increase. As stated in that letter, PHH violated the Real Estate Procedures Act, Truth in Lending, and failed in their fiduciary duty as a lender. On May 14, 2009, I was contacted by a PHH Supervisor of PHH Mortgage company explaining the delay in getting back to me. He was attempting to get some sort of resolution to the mortgage matter. The PHH Supervisor did agree the problem arose out of an error by PHH. On May 19, 2009, the PHH Supervisor contacted me indicating the company would extend the payback of underpaid taxes to three years instead of one bringing my mortgage amount to $2156, then after the three years to $2093. I received the mortgage statement for June 2009 and it showed my mortgage payment will be $2290.50. This discrepancy in the proposal given to me by the PHH Supervisor is just another example of how inconsistent and unfair your company is operating. Regardless of whatever the amount is to alleviate the unpaid taxes, anything above what I originally agreed upon in my 30 year fixed loan is totally unacceptable. They are still penalizing for something their company did.
Other than get us frustrated and give us the run-around and cost us valuable time, absolutely nothing!
