The National Defense Authorization Act of 2012 (NDAA) was passed by Congress on December 15, 2011 and signed by the President in the late hours of New Year's Eve.  The majority of the bill deals with defense spending, but sections 1021 and 1022 allow for American citizens to be taken into military custody without charge or trial for the "duration of hostilities" in the War on Terror.  The NDAA includes language that is in stark contrast of:

1.    Habeas Corpus (the right to a trial)
2.    The Posse Comitatus Act of 1878 (prevention of the use of military on American soil)
3.    Amendments Four through Eight of the Bill of Rights (regarding the rights of accused persons to protection against "unreasonable searches and seizures," protection against self incrimination, the right to a speedy and fair trial, and the right to a jury of peers)

States can cancel federal laws they deem to be unconstitutional.  We, the undersigned citizens of New Jersey, support New Jersey's efforts to undo this federal violation of our civil rights.
