Urge Ohio Gov. Ted Strickland to Give Clemency to Jason Getsy

Jason A. Getsy - Ohio State Prisoner #A330-121

The Ohio Parole Board with seven (7) members participating, by a vote of five (5) to two (2) recommends to the Honorable Ted Strickland, Governor of the State of Ohio, that executive clemency be GRANTED in the form of a Commutation to Life without the possibility of parole for Jason A. Getsy #A330-121.

The following factors were said to be pivotal to the majority's recommendation for executive clemency:

1. Four defendants participated in the offense. Mr. Santine, the person who organized the murder plan, exerted considerable influence over the co-defendants. It is noteworthy that at Mr. Getsy's trial, the state minimized Mr. Santine's influence; at John Santine's trial, it was the state's primary theory of guilt - his influence over the other defendants. It is clear that neither Hudach, McNulty, nor Getsy would have engaged in the behavior that led to the tragic death of Ann Serafino in the absence of John Santine's direction.

 

2. More than one justice (judge) has assigned Mr. Santine a greater level of culpability than Mr. Getsy.

 

3. John Santine was acquitted of hiring Mr. Getsy, yet then, 19 year-old Getsy was convicted of being hired by Santine.

 

4. Mr. Gesty's original jury was limited in their ability to consider Getsy's psychological history and any influence it may have had upon his decision to comply with the direction of Mr. Santine.

 

5. Mr. Getsy has continuously expressed remorse for the victims and their family and has an excellent institutional adjustment, and would likely do well in general population.

 

6. In imposing a death sentence, it is imperative that we have consistency and similar penalties imposed upon similarly situated co-defendants.

7. After careful consideration of all facts, the majority of the Ohio Parole Board recommends that Executive Clemency is warranted in this case

Governor Strickland has received the Parole Board's recommendation. He may concur with it, issue an order of executive clemency, and commute Mr. Getsy's sentence from death by lethal injection to life imprisonment without eligibility for parole.

If you wish, you may encourage the Governor to agree with the majority recommendation of the Parole Board and commute Mr. Getsy's sentence to life imprisonment without eligibility for parole.

I feel Mr Getsy`s sentence was harsh compared to his co-defendents. Why did he recieve the death penalty while the other defendants involved recieved lighter sentences? Please correct this injustice before its to late. Can you live with the sentence this man recieved? If this man is put to death, wont that be heavy on your conscience at all?

Monsieur le Gouverneur Strickland, je ne cherche d’aucune manière à excuser le meurtre d’Ann Serafino, ni a minimiser les souffrances qu’il a engendrées, mais je me déclare catégoriquement opposée à l’exécution de Jason Getsy. Au moment des faits, Jason Getsy était très jeune alors que John Santine l’instigateur du crime était un homme adulte responsable et beaucoup plus âgé qui a exercé une influence considérable sur Jason. En 1998, la cour suprême de l’Ohio a reconnu que M. Getsy n’aurait jamais participé à ce crime sans John Santine et qu’il était sous son influence. Elle a en outre relevé que Jason Getsy, d’après les déclarations filmées faites à la police à la suite des évènements, « avait peur de Santine et craignait qu’il ne le tue s’il ne faisait pas ce qu’il voulait ». En 2007, au cours de l’appel fédéral du sixième circuit, six juges fédéraux se sont opposés à la condamnation à mort de Jason Getsy, aux motifs que : « John Santine, qui avait ordonné le crime avait été condamnée à perpétuité » et que donc « les deux jugements sont incompatibles et irrationnels ». De plus dans une déclaration faite sous serment en 2008, John Santine a confirmé qu’il avait un pistolet dans la main lorsqu’il leur avait ordonné de retourner exécuter son projet. Il a indiqué « Parce qu’ils avaient peur de moi, je savais qu’ils tireraient sur Chuck Serafino si je le leur ordonnais » Le 17 juillet 2009, l’Autorité des libérations conditionnelles d’adultes de l’Ohio a reconnu les injustices qui caractérisent cette affaire en votant par cinq voix contre deux, en faveur d’une mesure de clémence pour Jason Getsy, en citant un certain nombre de raisons ayant conduit à leur décision : «influence considérable par John Santine sur Jason Getsy » ; que plusieurs juges avaient « attribué à M. Santine un plus grand degré de culpabilité qu’à M. Getsy» ; et que Jason Getsy avait « exprimé sans cesse des remords envers les victimes et leur famille ». Alors s’il vous plaît Monsieur le Gouverneur Strickland permettez à Jason Getsy une commutation de peine en approuvant le vote de l’Autorité des libérations conditionnelles.

I am not seeking to condone the murder of ann Serafino or to down play the suffering caused. I express my opposition to the execution of Jason Getsy. I note Jason Getsy's youth at the time of the crime and the Ohio Supreme Court's recognition that he was in fear of John Santine and would not have committed the crime but for Santine. I note that six federal jucges opposed the death sentence on the grounds that the person who initiated the murder received a life sentence and giv en the irreconcilability of the juror finding in the Getsy and Santine trials, this is a grave cause for concern. I welcome the Adult Parole Authority's recognition of the injustices in this case and its recommendation for clemency; if Santine was acquitted of paying the "murder for hire' money, how can Getsy be convicted for receiving it? I call on Governor Strickland to commute Jason Getsy's death sentence.

i have known jason all his life. the trial and situations that he was exposed to would be a heavy load for anyone to come through unscathed.it is my belief that clemency should be granted.
