Constitutional Amendment for the Right of Recall

We the People by virtue of the First Amendment of the Constitution of these united States, do hereby petition for the vote of recall on the body-elect of any and all federal  elected offices.

In accordance with the given authority of We the People, thus founded in the United States Constitution by virtue of the First Amendment, put to written word this petition to the Legislature of these united States. The legislature are requested to lay to vote a constitutional amendment thus setting to legislation the people's right and duty to recall by direct vote any and all federal officials.

Section 1. The body-elect shall cease with the duties of any office, or remainder thereof upon the issuance of recall from such office upon the enactment of such article.

Section 2. Any constitutional citizen of these united States shall have the right to set forth the motion of such recall through State executive body.

Section 3. Within 30 days after the date any recall petition is filed with the executive authority of a State under this article, the executive authority shall determine if the petition bears valid signatures in a number not less than 20 percent of the number of votes legally cast in the most recent Presidential election by persons who are qualified to elect such bodies who the petition requests to be recalled. On the date of any determination that a petition bears such number of valid signatures, the executive authority shall deliver a certified copy of the petition to the body-elect who the petition requests to be recalled. Within 7 days after any such determination, the executive authority shall call for a vote of constitutional citizens elect the body-elect on the question of whether such body-elect shall be recalled. Such question shall be the only question posed to such persons during the vote. The vote shall be held within 30 days after the 60-day period beginning on the date the executive authority calls for the vote.

Section 4. The executive authority of a State shall certify the results of any vote taken in the State under this article. If a majority of the persons who participate in any such vote choose to recall the body-elect, the body-elect shall vacate such office on the date of any such certification. If a majority of the persons who participate in any such vote choose not to recall the body-elect, the body-elect shall not be recalled during the remainder of the term of office in which the vote was taken.

As set forth in the Constitution, the Legislature of these united States shall have the accountability and responsibility to uphold and defend such article, by virtue of constitutional legislation, any and all constitutional provisions of said amendment.
