Once symptoms of an invisible disability became exacerbated due to a toxic work environment, a government employee (terminated after 3 years of exemplary reviews) followed due process to address her complaints.
Government employees conduct all preliminary investigations, so when Labour Board admin staff stonewalled the process over 250 days (avg is 48) and Human Rights Commission stalled 2 years to start its investigation (avg is 8-10 months to conclude) clearly government should not be investigating itself. Besides the legal issues, there is a moral obligation to do the right thing.
It is well known that women with intellectual disabilities have a very difficult time bringing a complaint forward. MB Justice should be commended for its pro-active response in accommodating a victim's or criminal's mental disability needs. However, this is not the case, with the Labour Board and HRC. Most surprising, since it was originally started to give access to justice to those most vulnerable and unable to articulate / comprehend or, did not have the financial means to go through the courts, hence it's nickname -- "Discount Justice".
In the case of the Labour Board and MHRC, the investigative authorities acted more like collaborators with the accused in bullying a victim further and into submission. It allowed biased authorities (who were also personally named in the complaint) provide hearsay and contradicting information, accepted as evidence. Together they caused lengthy and unreasonable delays in responding (often not at all); provided misinformation, and refused to allow the inconsistencies be addressed at a hearing.
The undue hardship suffered by the person with a disaibility leaves that person so traumatized that they are unable to enjoy and partake in every aspect of life: family, community, church, work and of course--health. Life expectancy with bipolar is reduced 10-15 years, depending on stress.
