  • Eminent domain is a weapon used to threaten and harm individual property owners.

  • The government should not be in the business of taking away private property rights, which are sacred in Idaho.

  • Children and the elderly won’t be safe biking or walking around the neighborhood.

  • Which business or neighborhood will they come after next?

Dear Mayor Smedley and Burley City Council Members,
The City of Burley began discussing building an exit road to Wal-Mart over ten years ago. When neighboring business Franklin Building Supply pointed out the obstacles to conducting business that such a road would create, it seemed as though the city had backed off. Neighbors in the Wauna Vista area also let down their guard.

So imagine everyone's surprise when, last April, the city renewed its plans to seize private property belonging to the Franklin lumberyard to forge ahead with the road. City officials gave no consideration to how Burley has changed over the past decade and the public was refused any chance to weigh in on issues of community safety, private property rights, and more.

Now the city is planning to use eminent domain to take possession of the back of Franklin's lumber yard, cutting off its ability to do business and placing an undue burden on the neighborhood. Together, we can support local businesses and protect private property rights against this dangerous government overreach.

Update #26 years ago
The City of Burley is trying to change existing code so they can move forward with their eminent domain lawsuit. They are going to ask Planning and Zoning to sign off on a law that would set a very dangerous precedent and, if they are successful, would mean no one's property will be safe. Please show up to the P&Z meeting on Wednesday, January 10 at 7pm at Burley City Hall to show your opposition. For more information, please visit out Facebook page: Burley Neighbors Against Eminent Domain.
