Harsher Sentence For Toddler's Rapist

Judge Marc Kelly, a Judicial Officer for the Superior Court of California in Orange County, sentenced Kevin Jonas Rojano-Nieto to only 10 years in jail after Rojano-Nieto was convicted of raping a 3-year old girl. According to Kelly, Rojano-Nieto's crime was not that heinous, because the pedophile acted with "no violence or callous disregard for (the victim’s) well-being". Rape is always 100% disregarding the victim's well-being. Judge Kelly further said "Mr. Rojano did not seek out or stalk (the victim). He was playing video games and she wandered into the garage. He inexplicably became sexually aroused but did not appear to consciously intend to harm (the victim) when he sexually assaulted her". There are so many problems with this statement. First, no one should be allowed to act on their "inexplicable sexual arousal" without the other party's full consent, which a 3-year old cannot provide. Further, sexual assault IS conscious intent to harm. There is no separating "assault" from "harm". Finally, the Honorable Marc Kelly seems to be disregarding that Rojano-Nieto held his hand over the mouth of the victim when the victim's mother came looking for her, so that the little girl could not cry out to her mother for help. Raping a child is an unforgivable act, and deserves the maximum penalty allowable by law, every time. There are no exceptions to this. Judge Marc Kelly, do the right thing and re-sentence Rojano-Nieto with the fullest possible punishment.
