These children are then thrown into a court and sentencing system designed for hardcore adult criminals. Mandatory sentencing does not take into consideration the past non-violent social history or the effects strong prescription drugs have on young minds. The results are ruined young lives. TO: THE MEMBERS OF THE SOUTH CAROLINA LEGISLATURE

PETITION TO THE SOUTH CAROLINA LEGISLATURE INVOLVING CHILD SENTENCING REFORM IN THE SOUTH CAROLINA JUDICIAL SYSTEM

We the undersigned, do hereby petition the South Carolina Legislature to immediately and without delay open a joint discussion on the juvenile justice system.

We the people support judicial discretion for the punishment to fit the crime in every case. Judges should determine appropriate sentences based on the facts concerning juvenile cases that come before their court.

Judicial discretion is "American Justice". Congress built departure authority into the sentencing system when it passed the Sentencing Reform Act in the 1980's. Departure power is necessary to guarantee a fair and just criminal justice system.

Mandatory minimums established for adult sentencing deprive judges of the right to dispense juvenile justice on an individual basis. Prosecutors and mandatory minimums currently dictate sentencing which is often inappropriate for crimes committed by children.

South Carolina judges should have their authority restored enabling them to dispense fair and just sentences to the children of South Carolina in the juvenile justice system.

WE THE UNDERSIGNED, DO HEREBY PETITION THE SOUTH CAROLINA LEGISLATURE TO SUPPORT AND PASS INTO LAW;

CHRISTOPHER'S BILL (THE JUVENILE JUSTICE REFORM ACT)

1. NO CHILD UNDER THE AGE OF 14 MAY BE SUBJECTED TO MANDATORY SENTENCING.

2. CHILDREN UNDER THE AGE OF 14 WHEN CHARGED WITH A CRIME SHALL BE SUBJECT TO THE POSSIBILITY OF PAROLE OR RELEASE AT THE AGE OF 21.

3. CHILDREN WITHOUT A HISTORY OF PRIOR CRIMINAL BEHAVIOR SHALL NOT THE TRIED IN AN ADULT COURT.

4. REHABILITATION WITHIN THE JUVENILE JUSTICE SYSTEM MUST INCLUDE COUNSELING AND EDUCATION.

5. CHILDREN UNDER THE AGE OF 14 MUST HAVE AN ATTORNEY OR GUARDIAN PRESENT BEFORE THEIR MIRANDA RIGHTS CAN BE READ.

6. CHILDREN UNDER THE AGE OF 14 MUST NOT BE QUESTIONED BY LAW ENFORCEMENT WITHOUT AN ATTORNEY OR GUARDIAN PRESENT.

7. ANY CHILD UNDER THE AGE OF 14 WHO COMMITS A CRIME WHILE UNDER THE INFLUENCE OF A PRESCRIBED MIND-ALTERING DRUG MUST BE TRIED AS A JUVENILE IN THE JUVENILE JUSTICE SYSTEM.

8. ANY MENTALLY ILL OR MENTALLY DISADVANTAGED CHILD UNDER THE AGE OF 14 WHO COMMITS A CRIME MUST BE TRIED AS A JUVENILE IN THE JUVENILE JUSTICE SYSTEM.

9. THIS BILL IS RETROACTIVE FOR 10 YEARS FOR CASES INVOLVING CHILDREN THAT WERE UNDER THE AGE OF 14 AT THE TIME OF THEIR ARREST AND LATER TRIED AND SENTENCED AS ADULTS.

Kids don't belong in jails. They belong in Rehabilitation Centers. My view of it is that adults today are afraid that these kids are the ones who are going to run the country in the future. But haven't some of us, at some point, committed a crime in the past even though we never got caught? I'm not afraid to admit that I have but I turned my life around just in time to prevent myself from getting caught. I matured and figured out that I was making the wrong choices in life. Now I am in college trying to get a Criminal Justice degree to fight this cause from the inside. Without our kids, we have no future.

Senator Drummond, Christopher Pittman IS innocent! Several years ago, I had to be taken to the emergency room because of a reaction to an anti-depressant that I was taking. I was stuggling with absolute rage and suicidal thoughts. I was absolutely, positively not in control of myself, hence the emergency room. All of the commercials for anti-depressants make sure to include warngins about suicidal thoughts and often state that they are not for those under the age of 18. Christopher was not responsible for his actions. The zoloft psychosis had complete control of him. He is NOT NOT NOT a criminal and does not belong in prison. There is so much medical evidence to support Chris' innocence. Please, can he get someone to review his case again and grant this young man a new trial. Thank you.

I learned of Chris' story tonight on Investigation Discovery, and could not believe what I saw! I'm not one who usually buys into different types of insanity defenses, but this was clearly an instance when someone is not in their right mind at the time of a crime. As a woman, I have been on a couple contraceptive pills, and one in particular completely altered my thinking and actions. I was depressed, irrational, and had suicidal thoughts. As a child, my husband was on Ritalin and he experienced fits of rage that were so bad he opted to just deal with ADD. If these adverse effects can be experienced when taking a medication not designed to alter your mood, it seems plausible that an anti-depressant can have even more severe effects on certain individuals. The two jurors, who went along with a guilty verdict just to appease the other ten, changed this boy's life forever. He deserves a retrial.

I have taken different anti depressants off and on my entire adult life. Luckily, I have had very conscientious doctors who monitored me closely. One of the first ones ever prescribed to me actually had a very negative affect on me. I was no longer depressed, but wanted to lash out instead, which is definitely not a characteristic of mine. I refused to take them. I would rather be depressed,ie; mad at myself, than furious at others. I was an adult and recognized the drug was dangerous. A twelve year old child wouldn't even be able to realize that their thots were not their own. He should not even be in prison.

I saw Chris' plight on "Investigation Discovery" on TV tonight, and and I was appalled that the medical profession prescriped Zoloft to Chris. I personally was prescribed Zoloft, and it altered my personality while I was on Zoloft. Doctor thought I was stressed/depressed. I told the doctor that something was not right, but he told me to keep taking Zoloft. Yes, the drug made me very aggressive and caused abnormal thinking. I was lucky that I did not get into any trouble. Despite the "good doctors" advice, I decided to quit taking the drug, and I was better. This happened ten or so years ago when I was in my 30's. Zoloft, and other SSRI's, are NOT a drug to prescribe for any reason! True, murder is wrong, but is it Chris' fault that his doctor prescribed this poison while it is not recommended for children? Chris' doctor, and Pfizer needs be held accountable for ruining Chris' livelihood. Chris has a lot to live for; not stuck in prison and letting life pass away. I am sure that his departed grandparents will understand that it was not his fault. My prayers for Chris' release.

It's truly shocking that in the United States over 2200 children have been sentenced to life in prison WITHOUT the chance of parole. It is a disgrace that our judicial system can let this happen. A 12 year old boy is a child. They do not have any other adult rights so how can we justify them being tried as an adult. I have worked with at risk youth and also have earned an Associate's Degree in Criminal Justice-Corrections. This story is so heartbreaking and unjust. The system definately needs to be revamped. It is cases like this that make the American people lose faith in the Justice system. There is no justice in punishing a young child for actions beyond their control.

I have been working with at-risk youth for over a decade now and know first-hand the effects of anti-depressants like Zoloft can do to a child. I believe that this young man (who was pre-adolescent at the time) could have been rehabilitated. I am shocked that he was found guilty and given that amount of time at just 12 years of age. I pray that he gets another chance at life before his 42nd birthday.

FROM LOST BOYS TO FOUND MEN There's a population of prisoners within the United States prison apparatus that were waived from the Juvenile court system into an adult system and given lengthy prison sentences. These men have been incarcerated for the past 10-15yrs, and for alot of them they have another 10-15yrs to complete before they are even eligable for parole. This specific population of prisoners have successfully transformed from lost boys to found men despite the prison enviroment's relentless promotion of malfeasance. Just as you and every other mature adult has, these men have shed their adolescent skin, nature/time has freed them from their myopic cages, that was, their adolescent brains, leaving no resemblance of the child that came through the prison gates 10-15yrs ago. These men are, fundamentally speaking, completely different people, just as you are fundamentally different today than you were in high school. I thoroughly and intimately know these men, for I am one of them, and I walk amongst them. We represent a small proportion of the prison population but our lights shine brightly within this cave and our hearts pound in rhythm with everything positive behind these cold walls. We want the world to know that we are here, that we exist. For waivering it's hildren into the adult prison system and giving lenghty sentences is a fairly new American trend, which makes our existense within the U.S prison population a new phenomena. So we want to give our voiceless existence a loud clear message and our invisability a form. We are the portion of the prison population, the only portion, that are well into our adulthood though we never committed a crime as adults, yet we are being forced to pay with our lives for a childhood mistake. I have been praying for Christopher since I first heard of this tragedy. I will still wake up in the middle of the night to pray for him. When I see commercials on TV for anti-depressant drugs and they issue their warning about children under the age of 18, I will pray for Christopher. I have shed many, many tears over this travesty of justice. I did not know this site existed until a friend of mine told me today. Christopher was so young when this tragedy took place...a 12 year old little boy under the influence of mind-altering prescription drugs that were given to him by people who were mistakenly convinced by the drug company, that they were helping him. As a result of these drugs, he had absolutely no control over his actions, yet was tried and convicted as an adult. How this could happen to a 12 yr. old is something I will never understand. My cousin recently hung himself while on an antidepressant! He was 39 years old, leaving a wife, 1 yr old, twin 8 yrs old. I am also on meds for depression, I can't get off of them and I to have several suicide thoughts, I even went to the extreme of trying to use the pills. The laws need to be changed with the insurance companies and the doctors. I'm not talking about this new idea of "one insurance through the government. PLEASE GET SOMETHING ELSE DONE!

I am a grandmother who has legal custody of my 15 yr old grandson. He was found at age 16 months living in sqalor in a third floor tenement, unheated with no hot water. He was standing in his crib with only a diaper on. His mother was entertaining 2 men. Here in New England it is quite cold in November. So we wre granted custody. My grandson is still depressed, has ADHD and other psycological issues steming from this trauma AND ABANDONMENT BY BOTH parents. With grace of God and a lot of love and patience He excells today. He has been medicated since age 4. In preschool some very good teachers that noticed that he was inattentive for age and hyperactive. There our search began for help. Fortunately we have good pediatric mental health facilities. After many trials with medications(7 yrs of trials) we finally got the medications that worked. He was twelve.He in under constant supervision and goes to a special school. I can tell you 1st hand how my child was damaged. He was damaged by abandonment and neglect. He has been suicidal and a very big behavior problem. God pray that the judge sees that Chris should not be tried and convicted as an adult for he suffers from not getting what EVERY CHILD NEEDS ---NATURING! If I can be of any help please contact me. Oh I have been an RN in RI for 25 yrs. The Judge Jerimiah chief of family court is also very knowlegable and an advocate of neglected children.

My 14 year old son at the age of 13 was charged as an adult with 2nd degree murder in his fathers death.He also has psychological and emotional problems along with several developmental disabilities since birth. This child was severely and mentally abused, medically neglected and denied the medication he needed at the hands of his father for years.While removing him from this abuse was unsuccessful, charging him with this crime was.

A 12 year old child with know psychiatric problems should never have been tried as an adult. What could be accomplished by puting this young boy in jail.
