 We the undersigned are asking that Thomas Arthur be allowed DNA testing that could conclusively prove his innocence.  Thomas Arthur recieved 3 last minute stays in 2007 & 2008. His last stay July 31, 2008 came after he had already been denied a stay. A person confessed to the crime and he recieved a last minute stay. A hearing is scheduled in the Jefferson County Circuit Court April 14, 2009 to determine if he should be allowed to DNA test the crime scene evidence and the evidence be presented in a Court of Law. We are demanding that Thomas Arthur be allowed the DNA testing of evidence that includes blood, hair and semon that was recovered and still exists, but it has never been DNA tested!!!  DNA testing of the evidence evidence can conclusively prove Thomas Arthur is innocent and was never at the crime scene, as he has proclaimed for 25 years. Yet the State of Alabama not only REFUSED to DNA test the crime scene evidence--but has refused to allow Arthur to have the evidence DNA tested at HIS EXPENSE!!!  If the State of Alabama is refusing testing because they know Thomas Arthur is innocent--then they are not seeking to execute him---but to LEGALLY murder him.  We are asking that the State of Alabama allow Thomas Arthur a new trial so that he may present ALL of the evidence that can prove his innocence.  There is a signed confession with details of the murder and location of the murder weapon.  There are two eye witnesses placing Arthur 75 miles away when crime was committed. Testing of the semen can prove Arthur did not have sex with Judy Wicker prior to or after the murder as she claimed. It could confirm that the person who signed the confession did have sex with Judy Wicker as he claims. Hairs found inside the wig worn by the killer could be tested to compared to Thomas Arthur & the man who signed the confession to confirm the identity of real killer.  No physical evidence links Arthur to the crime!!!  State witness testimony was used to convict Arthur. Judy Wicker was already in prison for the murder of Troy Wicker(her husband) and was released after 10 years to testify against Arthur.  Prior to her release, she had stated in 7 sworn statements and under oath, that Arthur did not have anything to do with the murder.  Other witnesses were either given something in exchange for their testimonies or strong armed to testify. DNA testing was not available in 1982 when the murder was committed. However, hair and fingerprints found at the crime scene did NOT match Arthur. DNA should be mandatory. What is the problem people? It would be so simple to allow DNA tested in this case and prove his innocence. Isn't that what the law is all about? If DNA proves he is guilty, then he is guilty but why don't you give him a chance? This is a big problem to me. It should not matter who is in office or who wins a case. What matters is the truth whatever that may be. What are you people afraid of? That you have been wrong? That you know you are wrong? Give the man a chance and do the DNA testing. Alabama is my home state and I am ashamed.

I am all for capital punishment. I believe that people should be executed for their crimes. If more people were executed, the jails were be less crowded for other crimes. BUT INNOCENT PEOPLE SHOULD NOT BE EXECUTED AND IF DNA PROVES THEM INNOCENT, THEN SET THEM FREE. IF IT PROVES THEM GUILTY, THEN EXECUTE THEM.

DNA testing should be mandatory in ALL capital murder cases One other thing: I answered the phone in Gary Alverson's law office the morning after he was elected District Attorney. His client, Ms. Wicker, was calling to see if he had won. Wonder why?

I am against capital punishment(sp). People shourld have to live with the consequences of their actions.

I believe it is fair and the right thing to do...if you have the right DNA. No one should be held accountable for crimes they didn't commit, and when the justice system would rather execute innocent people instead of take the time to find the right person, who's to say those people shouldn't be held accountable for the crimes.

Once again if it is the right person for the crime committed then it is accepable but putting a man/woman on death row for something they didn't do is first of all wrong, and those who sentenced him should be tried for murder, second it's just lazy police work and its unfair.

If there is DNA evidence in capital murder cases it should be mandatory testing.

I am against the death penalty in all cases. I don't feel it is a deterrant but is just revenge. I also am a prolife proponent at all stages of life.

DNA testing should be mandatory in all Capitol Murder Cases. The idea that the government and judicial system are incapable of mistakes is not only ridiculous, but harmful to any law abiding citizen. Thomas D. Arthur is innocent, and should be proven as such through DNA testing. Mistakes can be made, and any chance to correct mistakes should be taken.

The Death Penalty is cruel, it is unusual, and it is expensive. Capitoal Punishment should be replaced with a sentence of life without any oppurtunity of parole, "which costs millions less and also ensures that the public is protected while eliminating the risk of an irreversible mistake, the money saved could be spent on programs that actually improve the communities in which we live." Although it is a cliche, "an eye for an eye and the world would be blind" fits in perfectly with this argument not only because it is the truth, but because a death for a death solves nothing, just creates a vicious cycle and brings the entire system of humanity down to the level of barbarians and killers. Rising above it is not out of the question.

I feel that DNA testing is an extrordinary key element in all criminal cases, especially murder, and without a doubt should be done. I also feel that having very skilled law enforcement officials working for our state is essential when crime scenes are being investigated. If things are not done properly from the start of an investigation it could result in serious consequences for someone given they are innocent. While reading this particular case it was very hard for me to even think for a second that this man was guilty, and what is wrong with our state when it comes to taking depositions, and testimony? Did you never recall the prior testimony given by Judy Wicker? Please, she found herself a way out.

Capital Punishment is there for certain crimes, but not where someone is innocent. At least let someone go the full route before taking their life. I mean if there is damaging evidence (other than someone's word). I can't comment on this because I am 50/50, in some areas it should be considered, but based on the evidence. I have small children, and if someone was to hurt them, I'm not going to lie I would want them to pay the ultimate price for hurting any of my children. Capital punishment would depend on the type of crime committed, and something more than circumstantial evidence. The evidence would have to be "overwhelming", and not Gov. Riley's theory of overwhelming evidence. I have read a lot on this case, and I personally don't understand where they are coming from. To rely on Judy Wicker's testimony soley is obsurd....I wish you and your family lots of love...

I find it ridiculous and against what our justice system claims they try to do that six states, Alabama included, do not allow for post-conviction DNA evidence. If there is proof that will show to a 99% certanty someone did not commit a crime can we really ignore that and take their life? Thomas Arthur has suffered enough, and if he is proven innocent I believe the woman who falsly accused him for the sake of herself should be punished for purgery.

It is ridiculous and bizarre, even, that the courts refused to test for DNA. Absolutely, an infringement on Mr. Arthur's rights.

I do not believe in Capital Punishment. I think we should all move past the "eye for an eye" state of mind.

I agree to manditory DNA testing. Upon a "no match" result, release the inmate and save public tax dollars.

My position on Capital Punishment is ABOLISH NOW! In 2009 the capital murder trial court system remains broken. The scale of justice are not balanced. Therefore, fair trials remain questionalbe. We as a global society must regard human life as sacred. Animals rights are better protected. It's barbaric and inhumane to cage a human daily for 23 hours. Perhaps establishing a "Capital Life Sentance", continue to house inmates individually, revamp and preserve the appeals process. Proudly applaud our system when inmates can be proven innocent. Not execute when there's full knowledge of strong evidence that can exonerate.

I feel that Mr. Arthur's DNA has to link him to the murder; otherwise, it is morally unacceptable for him to be executed.

I believe in capital punishment in the case of serial killers and child murderers. The others I'd have to decide on a case by case basis.

A DNA test is crucial and I think he should be allowed to prove his innocence.

Death Penalty is a serious thing and should be used wisely.However,it is being used left and right. The result is million innocent lives are taken during this process.Corruption is very common, so it´s easy to fake evidence and testamonies.Therefore, I´m totally against Death Penalty!

To execute a person with out even allowing all the tools that we have to find out the truth is criminally irresponsible. DNA testing is the least we can allow.

Thou shalt not kill. Even if a person has committed a crime, to kill that person is still killing a person, and that is wrong. Moreover, capital punishment has often been responsible for killing innocent people. We as a society are so anxious to have someone punished for a crime that we do not always make sure that we get the right person.
