  We the undersinged are asking that the State of Alabama grant Thomas Arthur a new trial. We are also asking that additional DNA collected at the crime scene be tested.  July 10, 2009 DNA test results that were ordered April 15, 2009 in Jefferson County Circuit Court by Judge Pulliam, were turned in tho the Judge. She has issued the test resluts as "sealed" and has issued a Court Order to the defense and to the state that the test results not to be disclosed under any circumstance.  Hair and finger prints found at the crime scene did not match Thomas Arthur. No physical evidence links him to the crime.  The states key witness, Judy Wicker, the wife of the murder victim, Troy Wicker stated under oath multiple times Thomas Arthur beat her up and raped/had sex with her after killing her husband.  DNA testing was done on the panties Judy Wicker was wearing the morning of the murder. From this samadhi state he spoke the Medicine Buddha Dharani.[1] namo bhagavate bhaiṣajyaguru vaiḍūryaprabharājāya tathāgatāya arhate samyaksambuddhāya tadyathā: oṃ bhaiṣajye bhaiṣajye mahābhaiṣajya-samudgate svāhā. The last line of the dharani is used as the Medicine Buddha's mantra. Medicine Buddha Sutra, as a bodhisattva who made 12 great vows. On achieving Buddhahood, he became the Buddha of the eastern realm of Vaidūryanirbhāsa, or "Pure Lapis Lazuli". The Twelve Vows of the Medicine Buddha upon attaining Enlightenment, according to the Medicine Buddha Sutra[1] are: To illuminate countless realms with his radiance, enabling anyone to become a Buddha just like him. To heal beings born with deformities, illness or other physical sufferings. To help relieve the destitute and the sick. To help women who wish to be reborn as men achieve their desired rebirth. To help heal mental afflictions and delusions. To help the oppressed be free from suffering. To relieve those who suffer from terrible hunger and thirst. To help clothe those who are destitute and suffering from cold and mosquitoes. Oṃ Tāre Tuttāre Ture Svāhā - Tara, whose name means "star" or "she who ferries across," is a Bodhisattva of compassion who manifests in female form. "She Who Saves." In particular she represents compassion in action, since she’s in the process of stepping from her lotus throne in order to help sentient beings. 1. Tāre represents salvation from mundane dangers and suffering. Tara is seem as a savioress who can give aid from material threats such as floods, crime, wild animals, and traffic accidents. Tara is therefore said to protect against ordinary worldly dangers. 2. Tuttāre represents deliverance into the spiritual path conceived in terms of individual salvation. In traditional terms, this is the path of the Arhant, which leads to individual liberation from suffering. This is seen in Mahayana Buddhism as a kind of enlightenment in which compassion does not figure strongly. Tara therefore offers individual protection from the spiritual dangers of greed, hatred, and delusion: the three factors that cause us individual suffering. 3. Lastly, ture represents the culmination of the spiritual path in terms of deliverance into the altruistic path of universal salvation – the Bodhisattva path. In the Bodhisattva path we aspire for personal enlightenment, but we also connect compassionately with the sufferings of others, and strive to liberate them at the same time as we seek enlightenment ourselves. Tara therefore delivers us from a narrow conception of the spiritual life. She saves us from the notion that spiritual progress is about narrowly liberating ourselves from our own suffering, and instead leads us to see that true spiritual progress involves having compassion for others. By the time we have been liberated from mundane dangers, liberated from a narrow conception of the spiritual path, and led to a realization of compassion, we have effectively become Tara. In Buddhist practice the “deities” represent our own inner potential. We are all potentially Tara. We can all become Tara. Svaha, according to Monier Monier-William’s Sanskrit Dictionary, means: "Hail!", "Hail to!" or "May a blessing rest on!" We could see this final blessing as symbolizing the recognition that we are, ultimately, Tara. Her mantra can therefore be rendered as something like "OM! Hail to Tara (in her three roles as a savioress)!" Om Tare Tuttare Ture Mama Ayuh Punya Jñana Pustim Kuru Svaha Mama means "mine" and indicates that you’d like to possess these qualities of long life, merit, wisdom, happiness, etc. You can of course choose to wish these qualities for someone else — perhaps for a teacher or for a loved one who is ill. Ayuh is long life (as in Ayurvedic medicine). Punya means the merit that comes from living life ethically, and this merit is said to help one to live long and happily. Jnana is wisdom. Punya and Jnana are known as the Two Accumulations. In order to become enlightened we need to accumulate merit (that is, to develop positive qualities through living ethically and meditating) but we also need to develop wisdom through deep reflection. Wisdom cannot arise without a basis of merit, but merit alone is not enough for us to become enlightened, meaning that becoming a nicer person isn’t enough — we have also to look deeply into ourselves and the world around us and to see the impermanent and insubstantial nature of all things. I beleive it should be there for some cases but the crime must be fully proven. not as in this case where it is obvioulsy a cover up by the state. It would be better to keep them in hard labour all their lives to suffer.

If DNA evidence is available then testing of the accused should be done immediately with results furnished to defense and prosecution. The cost of testing should be part of investigation.

The taking of a human life is not right whrther it is an individual or the state. Anyone convicted of murder should spend the rest of their life in jail with no parole. I would suggest that a prison in the wilds of northern Canada or Alaska would be an appropriate place for their incarceration.

This kind of thing is out rages. In a country that where you are so easly convicted. Letting you have the chance to prove innocents should be a normal part of the prosses.

Only when DNA proves guilt. Not when other everdince is used. And never with a jury. A jury should have to be made up of people that score highest on iq test. To many people are found guilty by those that don't understand what they are doing.

If someone is convicted with DNA, there needs to be a mandatory retesting by an independent lab. There is too much room for error.

DNA testing should be done on every piece of material that it can be found on. Try to get all of the genetic testing done and find the real perpetrators! Too many people are in prison and on death row for something they didn't do and then the courts have the nerve to not grant them a new trial or exonerate them. Some justice we have!

I don't think anyone should be put to death because what if you have the wrong person on death row and after that person is executed, you find that they are innocent. Then what? You can't bring someone back to life after you have killed them.

I believe that it should be madatory that all DNA evidence be tested and the expense paid for by the Defense team. All DNA tests should be required to be tested by a professional, highly qualified scientific laboratory whom has proven to be able to test any and all DNA presented to them with 100% accuracy, honesty and integrity. It should be the right of a defendant to have any and all DNA that has been collected in their case to be tested, results made available to all sides in the case, and that Judges should not have the right to "seal" anyone's DNA results. If there is DNA present at a crime scene, test it and prove your case. This particular case is purely 100% unjustified!

I do NOT believe in Capital Punishment. It makes no sense to me to play God! If someone is found guilty of murder, it makes no sense to walk in the murder's shoes and murder! Two wrongs do not make a right. Dumb is Dumb no matter how you try to spell it.

How can people be expected to respect the law when justice is not always the final requirement?

I'm against it b/c of the impossibility of it being conducted fairly. I don't believe the evidence is at all persuasive that there is a deterrent effect. DNA should be considered especially in a capital murder case. Since I am a certified paralegal, perhaps one of the attorney's that is familiar with the appeal process, will get the ball rolling. Certainly, they will consider filing appropriate motions requesting the judge set aside his original ruling and consider the new evidence. I have seen a l0t of total miscarriages of justice, and as far as I am concerned it stinks. see Harrington VS. State of Iowa (suggestion)

I agree that DNA should be used in all capital cases. Given the consequences if found guilty, there needs and should be a higher standard.

While I believe in capital punishment, I am against it in this country as I do not trust the system to do the right thing. Too many cases have been found out later to wrongly convicted (State of Illinois). The judges are more interested in protecting themselves and fellow judges than they are with justice (see the Terri Schiavo case). Only in America can you take two of the most despised professions, lawyer and politician, combine them and you're forced to call them "your Honor."

I think using DNA testing is very helpful in exonerations and in convictions. However, I am concerned about those who have been wrongfully convicted and DNA testing does not play a role in getting their convictions overturned, such as the case of Edward P. There should be absolutely no doubt about a person's guilt before execution is considered. Executions cost the states more money than incarceration for life. There muse be some way to override procedural laws when it is clear to all that a person is innocent. Thomas Arthur deserves a new fair trial!

DNA testing should be done. They say if you did it there will always be some thing left behind, if they are competent to obtain and secure the crime scene. But there are problems with that too, cause it may have been some one you knew and visited their house, but you never killed them.We have a very flawed judical system and a lot of lazy, ignorant people in the positions.

Against capital punishment!!! Just as they want to put some one to death for a murder, they themself becomes a murderer and try and justify it.
