Humphrey- How will our Country be judged if we do nothing to stop the national travesty of Abuse and Financial Exploitation of our most vulnerable citizens.
Elder abuse is on the rise and our Protective Agencies and Services who should be protecting vulnerable American too often fail to do so. Instead of dealing with cases of abuse, vulnerable citizens and their families are often sent to a Probate or similar Court where a guardianship can ultimately cost a vulnerable person, and their family or friends, tens if not hundreds of thousands of dollars; sometimes for no reason other than greed and because the ward is unable to object and does not have the right in guardianship to protect their own assets.
There seems to be too little concern about the cost to the vulnerable ward. After all, when the money runs out, the American Taxpayers will just pick up the tab in Medicaid and Social Security Dollars for the care of the indigent ward. The opportunity to get rich quick is tempting for perpetrators within the guardianship systems in our State Courts who know how to play the game.
Professionals and private citizens who abuse and exploit vulnerable citizens in the guardianship system give a bad name to those who are trying to do the right thing. Strangers are often appointed to take over the person's life and family members, who can end up separated from their own loved ones, dare not to speak out for fear of losing the right to even visit them at a time when they are most vulnerable. Often a ward is placed into an end of the line nursing home as their homes and lifelong possession sold at auction for the money to be chewed up by exorbitant and unnecessary legal fees and fee-for-service guardian fees. In the meantime, these dear citizens, can lose all of their civil rights and end up with fewer rights than a prisoners on death row.
Regardless of why or how a guardianship case gets started, there is simply no excuse for the enormous cost and abuse that can be doled out in Adult Guardianships (by unethical attorneys, unprofessional guardians and uncaring judges in this dysfunctional system with inadequate oversights in our courts) to family members and friends who truly care and are desperately trying to help someone dear to them who is in need. No one is exempt from abuse in this system.

No one should have to go into guardianship if they have capable loved ones who are able and willing to care for them. Too many guardianships involve the improper seizure of a loved one's valuable assets. Enforceable laws are needed to end this practice.
To Whom It May Concern: My closest friend is under the guardianship of her mother--my friend is almost 46 yrs. old--she is legally blind and has problems w/memory due to a surgery in 1989. Actually, I have known my friend since 1978 when I was her middle school guidance counselor. She is an intelligent young woman who used to love life (even w/her disabilities) until her entire family schemed together and removed her from her apartment where she had lived for 12 yrs. w/o any of their help. They rarely had contact w/her. Since my friend was taken away by her family and placed into an elderly and disabled apt., they all then began having her mom petition for guardianship which was accomplised in Sept., 2006. My friend and I found out that the mom/guardian was stealing approx. $500/month from their joint checking acct. (basically the majority of her Blind Pension). Greed was the motivator for this mom/family in taking my friend away from her life of freedom and happiness. One yr. ago, the mom/guardian was successful in getting an order of protection against me by perjuring herself as well as the rest of the family members. The 1 yr. order is now expired, but I am still not allowed to visit,call or even send cards/letters/gifts to my friend. My friend is alone at least 95% of the time--she might as well be in prison as she has no rights. I have been working for the past 3 and one-half yrs. to obtain legal help for my friend in order to try and have the guardianship terminated, but so far I've had no luck. I will be meeting w/ the 4th attorney is 1-2 wks. to see if we can prove financial exploitation and thereby remove the mom from guardianship. I don't have alot of hope though. My friend is in desperate need of help--she is like a younger sister to me as well as another daughter to my mother. Why in the world are the local courts allowed to ruin so many people's lives--why is there no oversight regarding the guardians of so many disabled and elderly people--they might as well send them to prison--actually, felons have many more rights than those under the guardianship system. When I read the letter prior to signing this petition, I was amazed that the letter seemed to wanting to protect the families of the wards--as if somehow the families were getting the short end of the stick--please know that it is usually the families who gain the guardianships over their disabled or elderly family members and it is the family whose GREED is the motivator for them stealing money from their own mother/father,daughter/son, sister/brother--and once guardianship is given to a family member, it's as if NOTHING can be done to terminate the abusive guardianship. I truly support this petition due to all violations I've gone thru with the courts in Nevada fighting for my grandfather. The court system is definately for the money and making you feel your a criminal...... We need to put more passionate women judges in the guardian courtrooms because the men don't have a clue what to do with most of the cases, it's all black and white decisions.
Hi, I am pleased to sign the petition as a parent of a young adult with disabilities who one day will require guardianship. I am also an advocate in the State of Texas working with many families who have been affected by Guardianship Abuse. We have addressed our concerns to our Senate Jurisprudence Committee and our Lt. Governor's office. We have been told that there will be an interim study on the Guardianship Abuse in the State of Texas coming up in spring of 2010. I would like to see that legislation would address the application process of the filing of guardianship. I believe that legislation in Guardianship should include that all applications for guardianship should require successor guardians listed to the application, it should also be a requirement that the Probate Courts are accountable to contact the successor guardians on the applications by certified mail and should be required to prove that they have made any and all contacts for successor guardians to take guardianship prior to the Courts making the decisions on revoking and placing the incapacitated into the custody of the state. Also, according to the Texas Probate Code, a guardian may WILL their incapacitated loved one to a successor guardian. However, at this time, the successor guardian will also have to apply to become a guardian before the courts. The judge still has the opportunity to make the final decision on the successor guardian. I believe that this is also a violation of our Constitutional Rights even after we are dead, if the court has the authority to ignore our choice as written in our LAST WILL AND TESTAMENT. I along with many Texas famillies are working effortlessly to improve our protections by the Constitution and our civil rights to end the Guardianship Abuse in our state. I support this National mission along with all of you.
Many articles and studies have found over the past 20 years that Guardianships often deny citizens their constitutional rights under The Fourteenth Amendment of to their property and due process under the law. The stories we hear everyday make that message ring true for many of us who have been the eyewitness and secondary victims of guardianship abuse.

My mother is involved in a florida guardianship that is so out of control and there are many attorneys and judges that are just sitting back and permitting it. I am very concerned of my mother's money. It is not going to her care but to guardian's and their appointed attorneys. This system is set up to fail for the ward. I want to see change now!!!!!
My mom is 86 years old & has Alzheimers. A vicious predator used undue influence to con her out of all of her money & everything that she has ever owned. He used his own attorney to pose as my mom's atty & that is how my ex fraudulently acquired my mom's lakefront Bratenahl, OH home for a fraction of its value. Even with a letter and video testimony from my mom's physician that stated that she was not only incompetent but could not have even appeared competent, along with a lot of other evidence including bogus real estate appraisals (where the appraiser ignores the existence of Lake Erie & the beach) I cannot get these people prosecuted criminally. The best I could come up with is a trial in Probate court and although the ruling was for my mom to get her house back, the ruling also suggests that the predator be reimbursed his initial "investment" of $97,000 (minus a few self dealing expenditures of that money) that he supposedly paid my mom for her home (which was never for sale in the first place but it is actually valued at over $400,000). The catch is, he never paid my mom the money-he put it in her bank account, yes, but it was a joint account with him! Now how is it justice for my mom to have to pay him back money that she never received & never had any say in how it was spent? Why should a criminal be reimbursed money that was invested in commission the commission of a crime? Is this what Probate court considers a "making whole solution"? We need to get exploitation of the elderly recognized as a crime & prosecuted as such.
This is way too common! I am a nurse, I work in a nursing home (always have) I love working with the elderly; even though it is heart breaking at times, they are great to work with. They are funny and are full of history, most of which they have seen first hand. Our United States have no respect or put any value of our senior citizens. These men and women defended our courtry. They should be held in the highest regard with the highest respect. When I look at them I do not see frail, old, useless people; I see what they were from the stories they tell me. I would not work any place else. I have set with them when they cry, because their family never comes to visit. They have moved from having thier own homes that they have worked and paid for, to move to half of a room and able to bring the minimal of cherished things. Too many have been financially abused, they have nothing. There are some that treat their parents as they should be treated, take them out on Sundays, visit, buy them clothes, bring them special treats. Sadly they are the rare group. I have heard childen tell their parents, "Get used to it Mother/father you are going to die right here". I have to stand by and listen, I cannot say a word, I cannot follow them out to the parking lot and tell them what a wonderful parent they have. It is a hard job, but very fulfilling.
My grandmother is a victim to two lawyers that are attempting to take control of her estate from me. My mother her only child died 33 yrs ago. I am her only living grandchild and cared for her after her stroke for 7 years while maintaining a full-time job and raising two children to adulthood. It is appalling the lies and personal assumptions that these court officers have try to come up with. I never thought that I would be protrayed as such a villian for trying to give my grandmother a good life in the last years of her life. She had lost the ability to do this for herself. I know that they will have to answer to God one day for the evil they have committed in thier lives. I will never be sorry for extending myself to her. I will use everything in my power to make sure that she will have what she wants and needs in these final years. I know that God will deliver us as a family in our time of need.
We need a family members bill of rights - i can not see my mother. Her guardian has refused to let me vsisit her after baker acting her, then forcing her into an ACLF (locked ward). There were not documented reasons injstituionalize her. the gauridan has refused my mother acess to her perosnl pysican of 15 years. My mother has the fincancial means to have 24 caren in her home and this is written into her trust. By the way - I have stage 4 cancer and do not beleive I will see my mother before I die. The guardian has way too much power "because she says so".
my cousin daughter is always screaming @ her mother and calling her names. she recently spent time in jail for phisical violence . she is now out and my wife and i think she is up to her old tricks again. was over there yesterday and she was ranting and cusing her mother in the yard. i was looking on line for ways to help my cousin get free of her abuser
I suspect that we as a group, seiors, often reap what we sow as well, not in a willful manner, but situational, we havent instilled positive values in our young, no crime there per se, our western culture has become selfish and over worked, time is used up chasing a career or groceries, survival creates this sorry situation, we have all been, many generations herded by a mentality of money worship not merely neccessity..false value systems, conformity to a set of norms created for us by the eleites who are obscessed with the first dollar they ever made and care not what itrigues theyuse to get them all everyone for themselves.. inequalities grow..we are hypnotised by the daily media mantras..aquire, spend spend and be socially accpetable..have every credit card available..make sure our mortgageis bigger than the rest braggin around the lunch room tables across north america..its insane..parenting skills nearly none existant.. memes run rampant to beguile us..now we reap the rewrds of the pursuit of ealth at the expense of all else especially our childrens understading of basic humane living..takes 4 generations to escape the mistakes or compliance of the previous generations.. so we are in social and cultural decline..morality, suffers..logic has fled the scene..we are adrift ina sea of stupidity thrust on us ever so cleverly.. slowly over generations we have become willing slaves to our appetites and avarice..the exceptions are too few to acknowledge..if that were not so we would not be in these difficult run amok times..not our natural ways.. most unnatural ways now.. and we can turn it around..with admittance we gain power over what we have decided to ignore or deny.. the effects of manipulation used by the establishment to control the masses..we are little different from factory chickens producing eggs bereft of the meanest considerations of welfare.. Hind sight being 20 20..what now ? Bear trapped by the good ol boys and our children are no differently affected..save the few rebellious who are ground down just as thoroughly as we and and our elders..the good news is , it is all crumbling down. People who abuse seniors deserve much harsher punishment, just like people who abuse children. To steal their money is bad enough, but the people who physically assault an elderly person, someone who can not help themselves (just like children can’t), those are the most repugnant people who deserve to be put away forever. We live in the greatest country on earth, yet we let rotten, abusive people get away with too much. Our country will not be great forever if we continue to allow so many people to abuse and take advantage of the people who built this country, as well as those who will inherit it from us. We spend so much time worrying about what goes on in other countries, and not enough about protecting our own citizens, young and old. This starts at home - quit worrying about the small crap and teach your children respect for every living being, and they won’t grow up to be the kind of people who do these things.60
My uncle and aunt are in there 80s,there great niece is power of attorney they are abusive to my aunt and uncle,they have spent all there savings,retirement money and also are spending there monthly checks.they dont even have money left to bury themselves.i am very concerned about my aunt,the poa and her husband keeps her upset to the point her blood pressure stays really high,she has alzheimers desease and her health is not good.my aunt and uncle have been together for 60 years.the poa has sent my uncle to a nursing home and will not let him even see his wife,they claim my uncle is incompetent,and says there is nobody to care for them at there home.we have many family members who wants to take care of them so they are able to remain living in there home.my uncle is very much compitent.he was only sent to the nursing home for two weeks of tharapy,the poa signed him in as long term care.this eldery couple will not make it without each other.the poa is not in good health herself,she is not capable of caring for my aunt or uncle.the poa went six months without giving my aunt a shower.or even trying to find someone who was able to give her a shower.everytime family members called to check on them,the poa would claim they were fine.my uncle became sick and put into the hospital,that is when family members noticed everything that was happening.the poa shoved her grandmother down to the floor,and left bruises on her,this happened right in front of my aunt and uncle.they are both afraid of what they might do to them.not to mention what they have already done.we have wittnesses to everything that has happened.i have called adult protection,to try in find someone who could protect them.and they will not do anything to help me.i have tried everything you can imagine to keep them safe.and can,t get the help anywhere.i would greatly appreciate any advise,or places i could contact to recieve help.

Father 83 yrs old being given drugs that cause deep burning pain in his stomach. Combined with his blood thinners cause him to loose alot of blood and not surprisingly exhibit symptoms of Alzheimers in addition to physical weakness. His Wife 72 with OCD. Has taken guardianship of him and is now preventing friends or family from seeing him. I can't legally get him the care he needs. She continues to give out this "medication" whenever she feels she needs to get her way. She gives this same medication to another elderly person living on the beach so that she can be there to support her and take care of her.
This has happened to my grandmother by her two of her own sons. She has Alzheimers and one of her sons was in a cult so he can get into her head easier. She sits in her 20% of the home (she paid for 67%) on the chair why her son covers the couch becuase he has the smaller T.V. I really wish you would do somthing about this.
I would like to see a law put into effect when a new power of attorney, change of life insurance beneficiary or adding names to CD's over a certain amount and executor of will for a person over a certain age. I feel this law would help to exploit these crooks and possibly deter them from their acts. If this information was put into a system to alert elderly abuse agency's to check on the person if indeed they are being abused. If the bank was lawfully obligated somehow when these things happen it may avoid later problems. I am totally against this abuse and find it happening on a regular basis. I only have a high school education and retired from BellSouth with over 30 years...but would love to be involved somehow in helping this put to a stop and prosecute these people who heartlessly steal. Yesterday, I shared my story with Kelly Matheson. My mother was in a care home--she had alzheimers. One morning she was not being watched by the owner of the care home, she got up and went to the kitchen got near the stove and burned her arm, hand and torso. The owner who was supposed to be watching her saw her put her in a cold shower and later called my sister stating that she had hurt herself on the bedrail but was fine. My sister later came and found she had been badly burned. The caretaker lied again. My mom was later taken to the emergency room where she was diagnosed with third degree burns and was hospialized for a few weeks. She could not advocate for herself, she was a vunerable victim to the awful neglect and abuse. My mother was never able to stand again--the trama effected her in so many ways. The Police were called no criminal charges were filed and the owner of the facility had no insurance, she had the home in someone else's name. She continued to run her care home with absolutly no consequences. We later learned from the attorney we hired that another elderly woman had fallen off the porch at night; she was not being watched--again they lied about the truth.
There is a small group of 'professionals' engaged in racketeering to fleece the elderly in Walla Walla, Washington. These include at least one Superior Court judge (now retired), two attorneys and one guardian ad litem. These individuals finally drove our elderly father to his grave on October 3, 2009. The felon who originally brought the charges, claims to be an adopted son and is now suing our family to remove me as the personal representative and challenging our father's will to take over his estate. The guardian ad litem (GAL), Lorraine Mastin, visited our father just two times in eight months, yet spoke several times each week with the petitioner and reported over 50 lies to the court under penalty of perjury. The GAL was chosen out of order from the roster by the petitioner's attorney. The petitioner's attorney was a niece to the attorney representing our dad. Yet the attorney did not inform our father of this fact. Our dad's attorney threatened him and repeatedly told him not to come to the hearing that was to establish guardianship over him and his estate. Our dad, my two sisters and I have searched everywhere for help and have spent nearly $200,000 in medical and legal fees trying to protect our father, yet the saga goes on. The petitioner's are now challenging our dad's will based on his alleged incapacity. I beg you to investigate these facts and change the laws so that they really do protect the elderly instead of lining the pockets of attorneys, doctors and guardians.
