Humphrey- How will our Country be judged if we do nothing to stop the national travesty of Abuse and Financial Exploitation of our most vulnerable citizens.
Elder abuse is on the rise and our Protective Agencies and Services who should be protecting vulnerable American too often fail to do so. Instead of dealing with cases of abuse, vulnerable citizens and their families are often sent to a Probate or similar Court where a guardianship can ultimately cost a vulnerable person, and their family or friends, tens if not hundreds of thousands of dollars; sometimes for no reason other than greed and because the ward is unable to object and does not have the right in guardianship to protect their own assets.
There seems to be too little concern about the cost to the vulnerable ward. After all, when the money runs out, the American Taxpayers will just pick up the tab in Medicaid and Social Security Dollars for the care of the indigent ward. The opportunity to get rich quick is tempting for perpetrators within the guardianship systems in our State Courts who know how to play the game.
Professionals and private citizens who abuse and exploit vulnerable citizens in the guardianship system give a bad name to those who are trying to do the right thing. Strangers are often appointed to take over the person's life and family members, who can end up separated from their own loved ones, dare not to speak out for fear of losing the right to even visit them at a time when they are most vulnerable. Often a ward is placed into an end of the line nursing home as their homes and lifelong possession sold at auction for the money to be chewed up by exorbitant and unnecessary legal fees and fee-for-service guardian fees. In the meantime, these dear citizens, can lose all of their civil rights and end up with fewer rights than a prisoners on death row.
Regardless of why or how a guardianship case gets started, there is simply no excuse for the enormous cost and abuse that can be doled out in Adult Guardianships (by unethical attorneys, unprofessional guardians and uncaring judges in this dysfunctional system with inadequate oversights in our courts) to family members and friends who truly care and are desperately trying to help someone dear to them who is in need. No one is exempt from abuse in this system.

No one should have to go into guardianship if they have capable loved ones who are able and willing to care for them. My dear friend has had her Mother ripped out of her home by a "Senior Guardianship Assistance Program" in Beaverton, OR. The judge has sided with the guardian, the guardian has put a restraining order on my friend and her brother so they can't see her Mom. Her Mom has told everyone (guardianship, foster home, family, court) that she does not want to be there to no avail. THIS CASE IS SO EGREGIOUS, IT'S SICKENING! These guardianships and the judges are in cahoots and I've read about many cases of this happening on www.stopguardianabuse.gov. STOP THIS ABUSE OF HUMAN RIGHTS!

Please take good care of our elderly people who gave so much to us and our world. They deserve respect and good care. Don't let unscrupulous lawyers and judges abuse and take advantage of them under the guise of the "law". I have seen great abuses by lawyers and judges in divorce and family court, just to give you an example of how dishonest they can be. Judges and lawyers are gouging the public and taking advantage of the law. Judges make it very hard to represent yourself, they want to make sure that the system works to make the lawyers (such as themselves) wealthy. Not sure what can be done about it, since they like to threaten people with jail.
Lawyers and others took advantage of my father while he was on a morphine drip and under a Do Not Resuscitate order that were started when his cancer ruptured his stomach just hours before he died. For many years the bar and judiciary have obstructed legislative efforts to bring about needed safeguards. They argue, for example, that it would violate your constitutional rights to permit you to declare in advance that you insist upon the courts voiding by summary judgement any financial or legal document that you sign while on a morphine drip under a Do Not Resuscitate order, even if you were to appear before the court to validate this declaration in accordance with a procedure like the one established by Ohio Revised Code 2107.081 - 2107.085. In other words, the bar and the judiciary argue that the Constitution denies you the right to make choices while you are healthy and not susceptible to being exploited so as to preserve for you the right to sign such documents when your health is such that you are the most susceptible to being exploited. My 85-year-old Mother has been displaced from her own home into assisted living by her son, a 51-year-old alcoholic who is unable to keep a job. He has been arraigned for possession of an illegal explosive, a live grenade which he admitted in court to assembling in my Mother's house without her knowledge. He has lived with Mom for 15 years like a parasite without paying any room and board or utilities, even taking money from her checking account to pay off the loan on his SUV. The courts have failed to protect my Mom. It appears that the fact that the bomb squad had to remove a live grenade from Mom’s house and explode it simply doesn't rise to the level of an order of protection. It’s of no concern to them that the CNAs I hired to work with Mom in her home quit for the obvious reasons after the grenade was discovered, and I was unable to hire anyone else to help her after that. I could not even enroll my Mom in the church daycare program due to concerns that my brother would come there and create problems, so I was left with no alternative for her own safety but to place her in assisted living. The facility allows both of my brothers to visit Mom, but they do not allow the alcoholic son to be alone with her in her apartment because they have noticed the negative effect of his visits on her demeanor. I have both durable power of attorney and a temporary conservatorship for Mom, but my brothers are fighting the conservatorship, and the attorneys are dragging the case out for more money. More than that, the attorneys expect that all their fees will be paid from Mom's estate! I can’t allow that to happen, therefore all costs will have to come from my retirement fund. Mom needs her money to pay for her own care. I believe Mom is being over-medicated by her doctors who have no time to listen to the concerns of family members. I definitely support this petition. We are so concerned with the safety and well-being of children in this society -- as well we should be -- but what about the vulnerable elderly?
My mother's life was stolen by a guardianship agency who didn't even bother to notify next of kin. She is not even allowed to receive phone calls. Her pastor was even denied visits. She was declared incompetent by mental health professionals who never even saw her. So much for her best interests.
Please act on this NOW as my friend's mother is being abused by a guardian and she seems to have power that surpasses the family and their wishes.

My mother was placed under a Guardianship with a county social worker. She was "thrown" in a nursing home with no concern for what was actually in her best interest. They have so much power and it can all take place in less than an hour. We need to make changes so this does not happen to other people.
My disable son has an conservatorship in the DC Superior Court, funds are being swindled he has more than one social security number created under a guardian named Renee I Fox it was issued in Arizona years ago. The conservator was nominated by Ms. Fox. Now the conservator is trying to take my son who's 24 years old and his new home, it's more to our story. Please Help......

My father is a WWII vet and the estate he and my late mother spent a lifetime building is being pissed away by his conservator at a rate of over $20k a month, spending over $250k to "care" for him in the first year. As I fought to keep this from happening they convinced the court that I was the bad guy and limited my visiting to only 3 hours a day. I see now that the majority of the family/friends that oppose the conservator quickly get demonized by any means possible. This system is prosecuting people that are trying to do the right thing while these corrupt conservators are made to look like a Hero for disolving huge estates and leaving that person pennyless.
There are other ways to solve problems without stripping a person of his or her civil rights. We must find solutions and do better!
At Autumnwood Rehab in Livonia Michigan USA, the employed there are giving me a hard time about seeing my father on specific times. His temp. guardian that put papers through the court threatened me and have given me a hard time. My father, needs help, because they are petitioning for guardianship over my father through a professional guardianship to over take my father and what costs they can pocket. They are going to court 25 January 2010. They are frauding my father, and hurting our family. This is not supposed to be a professional business and they doing this, truthfully, to the vulnerable. My dad needs his attorneys. Maybe, my brother, with some wealth and legal pull as an attorney can help our dad. Charles Paul Thomas Phoenix, my brother, may be able to get him out of guardian care.

I CALLED SOCIAL SERVICES AND THEY TOLD ME TO FILE A GUARDIANSHIP CASE AND I DID NEXT, I FOUND OUT MY BROHTER KNOWS THE JUDGE AND THEY CORRESPOND ON THE TELEPHONE, I HAVE ACTUALLY WITTNESS THEM TALKING IN THE PAST. NEXT, THE TRIAL IS COMPLETELY BIAS AND I AM CONCERNED - MY MOTHER WANTED TO FIRE HER COURT APPOINTED LAWYER BECAUSE THE LAWYER IS NOT PAYING HER BILLS, I AM AND THE JUDGE DID WILL NOT APPOINT A NEW LAWYER. I have sister(94) in San Antonio kidnapped using probate court. She died under confinement and milliions gone to will obtained by deception. Wife(82) kindapped in Van Nuys, CA. Well over a million in legal extortions plus my attorneys. The probate codes are all pro-conservatorship and penalize objections. Kangaroo court must be abolished.
Elder abuse is increasing and is terrible. I watched abuse happen to my grandmother and break my mother's heart and I could do nothing until my grandmother was on her death bed and a do not resuscitate order was placed on my grandmother by her "attorney guardian" The attorney never came to the hospital just spoke and directed by phone, he only had guardianship for 8 months.

my husbad is getting wiped out by the guardian and the judge signs off on the bills and i an going to court on the 22 to fight it also applying for guardianship of the person. the guardianship sprnds time degrading me and i am the one who takes care of my husband.
Senior citizens are our most vulnerable citizens. It is intolerable that they be subject to abuse by government officials.
The courts are taking away the rights of senior citizens. They disregard the objections of family by not allowing them to respond to allegations without legal representation. Fair representation is not possible unless you can afford to hire an attorney. The court appointed attorney for the victim refuses to interact with the victims family and agrees to all recommendations of the DCF and their attorney. It is a scam, petitions and court orders are finalized before the actual court appointment date. Appearing to enter a defense is a waste of time as the court and attorneys have it all mapped out ahead of time and refuse to give due process.
