On May 12, 2011, the Indiana Supreme Court ruled 3-2 that Indiana residents have no right to resist the unlawful entry of police into their homes:
"We believe ... a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence," said Justice Steven David.
Justice David said that a person may be arrested following an unlawful entry and will have to avail themselves of the court system just to exercise their God-given rights. Additionally, the Justice asserted that police may conduct random searches of homes for the greater good without a signed judicial warrant, in stark contrast to common law and common sense.
We hereby request that you censure the Justices who voted in favor of this ruling and that you immediately introduce legislation to overturn this contemptible and gross violation of the rights of the People of Indiana.
As fellow Americans, we believe that right to property, privacy and freedom from search and seizure is fundamental to a free and just society.
The State of Indiana is bound by the U.S. Constitution to respect not only the 4th amendment protection from search and seizure but also the due process clause of the 14th amendment.
It is the duty of the Governor and the Legislature to protect the rights of the People of your State now and not shrink back from honor, decency and love for Liberty.
We impress upon you the great need and urgency of this cause for our fellow Americans whom you serve in the distinguished State of Indiana. We will not rest until we see Justice done for our brothers and sisters in the Hoosier State.
