Welcome to the Cape Hatteras Access Preservation Alliance or CHAPA. CHAPA was formed by the Outer Banks Preservation Association, along with the Cape Hatteras Angler's Club and the North Carolina Beach Buggy as Charter members.
CHAPA was formed in the hopes that the access privileges of all the different user groups for Hatteras and Ocracoke Islands could be represented and not just the needs of the fisherman.
CHAPA believes in "Free and Open Access" for all users and is working diligently to unite fisherman, surfers, kite boarders, wind surfers, shell seekers and all other forms of beach goers, so to protect their access on Hatteras and Ocracoke Islands.

On April 30, 2008 4th Circuit District Court Judge Terrance Boyle accepted a consent decree and the voluntary dismissal of a law suite and request for temporary injunction filed by SELC, on behalf of Defenders of Wildlife and National Audubon Society on October 17, 2007 and February 20, 2008, respectively.
The newly approved consent decree will guide the resource management of Cape Hatteras National Seashore Recreational Area (hereafter referred to as CHNSRA) for the next three years. As demonstrated below the consent decree:
1. does NOT qualify as a special regulation for ORV use, thus, does NOT remedy the violation of Executive Order 11644, as amended by Executive Order 11989,
2. violates a variety of Congressional Acts (including but not limited to NEPA, Federal Administration Act, Federal Advisory Committee Act), and
3. represents a unconstitutional delegation of Federal Authority.
Furthermore, Judge Boyle%u2019s numerous detailed discussions of appropriate ORV controls will likely influence the final special published by the Park Service. Based upon the above, the only remedy that will ensure that CHNSRA is managed as intended by Congress and the Constitution is for Congress to enact legislation authorizing ORV use as has been practiced over the past several years and in compliance with the 2007 Interim Protected Species Plan (hereafter referred to as Interim Plan) until such time as a final special regulation governing ORV use is finalized.

We, the undersigned citizens of the United States of America, believe in Free and Open Access to beaches on the Cape Hatteras National Recreational Park and do request with due importance of economic impact, tourism, the pursuit of happiness as stated in the Constitution of the United States and with regards to the Cape Hatteras National Recreational Park be put back in the hands of the National Park Service from the Consent Decree that was placed on April 30th 2008 by Judge Boyle, that the consent decree be lifted immediately.

Access to the Outer banks by ORV is very important my family because of my wife's arthritus in her hips which makes it impossible for her to walk onto the beaches to fish. We very much enjoy our time spent surf fishing on the outer banks and do not want to lose our oppurtunities to do so

I love going to the beach in hatteras! My uncle was a long time surfer off the shores of North carolina and when he passed away, they had a surfers memorial at sea for him. The only way we could get their was by driving the beaches to the meeting grounds. Everyone that went did and still does their share in protecting the dunes and shoreline of the beaches in carolina. I hope that this will help and that I will still be able to drive year after year to the spot that we said our final goodbyes to a great waterman, my uncle.

Keep the OBX beaches open

Our family has been vacationing in the Outer Banks for 15 years. We drive past the Jersey, Delaware and Maryland beaches because they have replaced a wonderful Ocean experience with an artificial, commercial, and urbanized experience. Going to the Ocean there is more like going to the Mall or Disney World. We love the ability to observe nature, to drive family members who have been in wheelchairs to the beautiful Point of Hatteras, and to be surrounded by so many others who love wildlife, nature, and respect it.
We treasure being able to directly experience nature at the Outer Banks, and especially Hatteras Island. We fear that it will taken away from us, just like it has been by development or by creating completely separate isolated spheres for nature and recreation on the Northern beaches of other states.

Now the 'do-gooders' have taken away a place that I can fish. We, the people that can't walk due to physical problems, enjoy being out of the beach. We fish, watch dolphin and even somedays take a dip in the ocean. We love to talk to the other fishermen - they always have a tip for us.
I have been to places that the only access I had was to the end of a sand mat -- me and 6 other people crowded and in each other's way. That isn't what accessibility means to me.
Keep open the beaches -- there are many places for the birds, there are not many places like the Outer Banks Beaches for us humans.

I vacation annually from living two blocks from the beach in Virginia to the Outer Banks area to enjoy their beaches and give my family the experience exploring the beaches while enjoying the local habitat. We as all my friends who we vacation with are very conservation minded and never disturb any wildlife and would help at any given chance. Most every one out on the beach would not only report the disturbance of any habitat or closed area but would stop the offenders immediately. Please keep these beaches open for my daughter’s generation to enjoy as many past generations have.

I strongly support the "Free and Open Beach Access at Cape Hatteras National Seashore Recreational Area". I am a taxpaying citizen. I exercise my right to vote in local and national elections. I have a say in how my tax dollars are spent. What's wrong with this picture? You mean a judge decided that I could not drive on a public beach? ... one that is supported by my tax dollars and vacation spending money... and in a "Public" Recreation Area. I live in West Virginia but my tax dollars help to fund "National" Parks. I visit Ocracoke Island each spring and fall, enjoy the beautiful seashore and the great fishing, spend lots of money that helps support the local economy. Where is my voice? I demand to be heard.

I have been fishing the outer banks since I was in the Marines at Cherry Point in the 70's. It has always been a peaceful place to visit and is why I take my grand children there these days. It is far safer then any other places due to the respect it is given by the same people that are being banned from it. The impacts on the enviroment and wildlife is not caused by the fisherman and other visitors but are effected by mother nature {high tides & storm surges} and other wildlife. {otters, feral cats, raccoons, possums and predatory birds} The OBX is federal land financed by the very peoples hard earned money that these closings are effecting and in a sense, punishing. That is completely opposite of how are laws are set up what should be done. I hope that the people these same people that are being punished voted for can see through all the false information fed by these high dollar activist groups who a majority of have never stepped foot on the OBX and have no idea of what they are talking about, and do what is right for the hard working U.S. citizens, residents and business owners that your decisions effect directly. Because they do not effect the people complaining about ORV access or the enviroment. We have been accessing OUR beaches for many years without enviromental repercussions and should be able to enjoy OUR federal parks for many years to come. Thank you,

The beauty of the beaches and the phenomenal recreation and sportfishing should never be impeded. My families vacation to the area would never be complete if we did not get to spend at least one day on the beach fishing. Fishermen contribute more to the environment than any other group through their conservation and licensing dollars. By eliminating the participation of fishermen, the vast majority of funds needed to maintain this environment are eliminated. This is NOT the way to solicit environmental partnerships. It does the exact opposite... it alienates the diverse interests of the users. But it readily identifies the group(s) who desire to establish power & control over others.

ORV beach access is important to me as a surf fisherman. I have been going to Ocracoke NC for 10 yrs., fishing all the ramps, during day and night. It has heightened my respect for what a special place it is and the need to be responsible for my actions. The observation I can make is that is also the attitude of the overwhelming majority of folks who come and enjoy the privilege of driving on the beach to fish their favorite hole. I am favor in keeping access open to all creatures whether human or animal.
