JUSTICE!! Seeking Justice for Freedus Warren Wilton II

On January 27, 1997 a crime was committed on the island of Maui. On April 13, 1998, a jury found Freedus Warren Wilton II guilty of this crime. The following offenses are what Freedus was charged with: Burglary in the First Degree, Robbery in the first degree, Attempted Murder in the First Degree, Place to Keep Firearm, Carrying or Use of Firearm in the Commission of a Separate Felony and Use of Deadly or Dangerous Weapon in the Commission of a Crime. 

Freedus Warren Wilton II was wrongfully convicted and he should be pardoned of these charges.
The sentence he received was life imprisonment without the possibility of parole based only on circumstanial evidence. This sentence is not only wrong but unfair for a number of reasons including, but not limited to the following:
 
  • At original trail Freedus was not represented fairly. He was told by the lawyer not to testify (which is why he gave up his rights to do so), the lawyer did not present any evidence/witnesses proving his innocence or to counter the circumstantial evidence supposedly identifying him as the perpetrator, the fact that my cousin has MS (and can not run as the assailant was chased by a security guard and two young men)  was not brought up at the trial (which is significant).
  • The description of the perpetrator differs significantly from the description given by the security guard and victim's own sons. (Blonde hair VS brown and height, weight and ability to run)
  • When the police arrived at the scene of the crime, a baseball cap was recovered as well as a .38 caliber. The gun was registered to Freedus however was not used in the crime. The baseball cap had hair samples that were tested and experts could not identify the hair samples as those of Freedus.
  • Extensive testing for fingerprints, DNA, no blood, fingerprints or other physical evidence linking Freedus to the crime could not be proven.
  • His bicycle that he used for transportation and his apartment had no evidence of a stabbing which is hard to believe had he committed the crime.
  • Despite the overwhelming argument that the conviction was unjust, it is further argued that the sentence was too harsh for the charges.  In reviewing the crimes committed by others with life without parole, actual murders were committed and in several occasions there were 7 victims.

Freedus applied to appeals and once again mishaps in the system and Freedus' lack of knowledge/experience in the process prevented any success.
 
Freedus has been a model inmate during his time in prison. He has engulfed himself in learning more about God, the law and anything to keep his mind from growing stale and negative. He is a very respectful person who still believes in the judicial system and doing what is right no matter what the circumstances. He has served in the US Navy and has a deep commitment to our country. 
 
Freedus was a young man when this all occurred. He is an important part of a large family that includes 60 first cousins.  Many years have passed and he has missed out on numerous family events.  Most recently, the death of his mother.  It is our hope that he would spend time with his aging and ill father (who has cancer and heart problems) before he too reaches the end of his life.  
If Freedus was to be pardoned, he would have the full support of our family to be an ideal citizen. Additionally, Freedus' health is not good.  He suffers from symptoms associated with MS and he recently had a hip replacement limiting his mobility.  In this condition, he will certainly not be a threat to society. 
 
Freedus' has already served a great portion of an unjust sentence for a crime in which he always maintained his innocence.  He has done it in a peaceful manner without any further disciplinary actions while incarcerated.  As his health condition continues to deteriorate, we SEEK JUSTICE
WE,  the undersigned call upon the President of the US to realease and exonerate Freedus Warren Wilton II. He is an innocent man, incarcerated for life without parole for a crime he did not commit.

Dear Mr. Obama,


This letter is in regard to Freedus Warren Wilton II (A4006196). He is serving a lifetime sentence without the possibility of parole in Aiea, Hawaii. I dont really know where to turn. I dont even know if this letter will ever be read. I just have to try because it's someone's life and it is about justice. I created this petition to get noticed by you because I understand you recieve thousands of letters everyday. The petition showed me that others (not just myself) still believe in the American way, of justice for all.


This is a plea, a request to Pardon an innocent man. Too much time has passed without justice being served. Something needs to be done.


On April 13, 1998, a jury found Freedus Warren Wilton II (A4006196) guilty of the following offenses are what Freedus was charged with: Burglary in the First Degree, Robbery in the first degree, Attempted Murder in the First Degree, Place to Keep Firearm, Carrying or Use of Firearm in the Commission of a Separate Felony and Use of Deadly or Dangerous Weapon in the Commission of a Crime.


The sentence (life without parole) for attempted murder is too harsh. Then, tack on the fact that a jury based their findings on circumstanial evidence, no motive and NOT hearing crucial information that proves (due to MS) Freedus cannot outrun three adult men as assilant did. Freedus was NOT represented fairly or if at all. If you read the court transcripts (Wilton VS The state of Hawaii) online, you will clearly see this.


Extensive testing for fingerprints, DNA, no blood, hair samples or other physical evidence linking Freedus to the crime could not be proven.


Appeals have been filed but once again mishaps with law/system prevented any success.


Please help in this matter. Please find it upon your heart to investigate this and see that justice is served.
