Accused of inducing the infamous Shaken Baby Syndrome, Veronica Martinez Salcedo is a 38 year old nanny who has been held in the Placer County, CA jail since May, 2006, charged with the second degree murder of 15 month old Hannah Rose Juceam. Her first trial lasted six months, and ended in a mistrial due to a hung jury. On 12/10/07, the Placer County District Attorney announced that she will be re-tried in April, 2008. Mrs. Salcedo has steadfastly maintained her innocence and has rejected plea bargains. Shaken baby syndrome (SBS) is gaining international attention due to the alarming number of alleged cases as well as recent events scrutinizing the validity of SBS in the UK and Canada. Three symptoms—retinal hemorrhage, subdural hemorrhage, and cerebral edema, have been widely accepted as diagnostic of the “syndrome.” Those symptoms have even been downsized to include as little as one of the symptoms listed above. In recent years, researchers and physicians have conducted further studies and have found that other conditions can mimic what was classically coined as SBS. Exhaustive medical investigations are seldom conducted to rule out other causes such as underlying diseases or conditions. In both Daubert and Frye hearings, SBS has recently been disqualified as a diagnosis able to establish legal guilt. New research needs to be conducted to ensure that no one is sent to prison because of a false accusation. New protocols need to be implemented within social and police agencies to guide investigations of possible child abuse. New standards need to be incorporated at hospitals requiring exhaustive investigations for all possible causes of injury when SBS is suspected. All SBS cases need to be reopened to ensure abuse did in fact occur and was not merely assumed to have occurred. Those who have been wrongly accused should not continue to serve harsh penalities for something they did not do. Unless the innocent are protected from wrongful accusation and conviction, there is no justice. Few defendants can afford the legal costs or the costs for expert testimony, without which convictions are virtually assured. We have known the Martinez Salcedo family for a very long time and I can put my hands to the fire for Veronica regarding her innocence. Afer the tragic loss of her husband, Veronica was just trying to provide a better life for her two kids. Being naive in a new country does not mean she is guilty. This family has already suffered so much pain! How about her two kids? Haven't they suffered enough? Don't we claim to have the best Judicial system in the world? She should be freed caring for her two kids.

Having a degree in criminal justice and study about law in the United States makes me sick to my stomach to find out what they are doing to my dear friend Veronica. I grew up knowing her and her family. I am impressed how she managed to care for her two children after the loss of her husband. I have been around her long enough to know that she would not harm the samllest living creatures than to kill a child. I am sorry for the family that loss there child, but theres more to this than to just blame an easy target who so happens to be an immigrant who decided to come to America to give her kids an opportunity at life. Obviously there was a hung jury prior to her new trial because someone saw the light at the end of the tunnel and knew they were going to convict an innocent person. My heart goes out to her and her family who these past two years have gone to hell and back. I hope they let her go home so she could spend the lost times with her kids and put this behind her.
