I just read the Labor Laws in New Mexico regarding breaks that employers are required to give to employees. Unless you are a nursing mother or under the age of 18 there are no requirements.

We need to change this law to the same as most other states. The employee should get at least a ten minute break for working a 4 hour shift, at least a ten minute break and/or a half hour lunch for every six hour shift and two breaks of at least ten minutes and at least a half hour lunch for every eight hours or longer worked.

The breaks would be while on the time clock and at the employers expense. The lunch half hour would be time the employee clocks out and is free to go wherever as long as they are back in time. If you do not give the employee breaks they burn out, accidents happen more and they tend to quit more often. Especially employees working in retails or food service of any kind need to have breaks.

The employer could give a longer lunch than a half hour and longer breaks if they decide to. The employee cannot chose to not take a lunch and leave early from their shift.
