STOP PROPOSED DANBURY WASTE TRANSFER STATION

Proposed Plumtrees Rd. Waste Transfer Station

Background: MSW LLC (Managing member, Joseph Putnam) first proposed a Waste Transfer Station on Plumtrees Road in early 2007. The application, which was a Special Exception use in the zone, wa denied by the Danbury Planning Commission in 2008. MSW LLC then sued the City to overturn the lawful Planning Commission decision which was upheld by the Courts. MSW LLC then filed an application for a State Department of Energy and Environmental Protection (DEEP) permit. While MSW LLC's application received a preliminary approval in 2012 more than 200 area residents signed a petition requiring DEEP to conduct a formal hearing. The as part of the hearing process DEEP held a public hearing at Danbury City Hall during which local officials and residents spoke against the proposal.

DEEP heard formal testimony in Hartford from the applicant, the City of Danbury presented witnesses and evidence in opposition to the application. Unfortunately, DEEP approved a State Permit for the proposed Transfer Station.

Current Proposal: The application as approved by the DEEP is for a facility nearly three times the size of the 2007 application (34,000 Sq. ft) and will process up to 800 tons per-day generating approximately 466 truck trips per-day. Although DEEP approved a State permit the proposal remains subject to review by Danbury land-use Commissions which will schedule public hearings and potential the Courts.

Potential Local Land-use Issues:

The question before the City land-use commissions will not be whether such a facility is needed or is economically viable in Danbury but instead whether Danbury: (1) should or must change its Zoning Regulations to allow such a facility (this issue may involve litigation in Court); and (2) if the City is required to allow such a use as a special exception, then the specific application will be subject to review and a public hearing process before the Planning Commission.

Main Concerns of Residents:

Increased large truck traffic (466 new trips per day) and traffic safety on Plumtrees Road, Shelter Rock Road and Newtown Road as well as side/feeder roads.

Odors from waste in the facility, from idling trucks lining up waiting to unload waste and from trucks driving through local neighborhoods. Solid and liquid waste dropped/dripping from trucks on local roads.

Noise from truck back-up beepers, dropping of large metal waste containers onto sorting floor, heavy equipment, etc . . . facility will be open for trucks 12 hours a day and for sorting waste 24 hours a day.

Increased vermin and insects.

We will continue this nine year fight against Mr. Putnam, his lawyers, consultants and those who are trying to force this onerous and irresponsible proposal on the citizens of Danbury. We hope to schedule a neighborhood meeting in January and will send notice of the place, date and time to area residents soon.
