Please Help Us Get Our Dogs Back

We are trying to appeal a decision made by the courts declaring our male and female Saint Bernard dogs dangerous because they injured a German Shepard that was new to the neighborhood. Although no one saw the fight start, we feel strongly that it was not our dogs since they have never done this to any other dog or person. However, in Virginia, the Dangerous Dog Law says that it only takes one time to declare them dangerous if it happens off of our property. The female was pregnant at the time and was probably protecting herself and unborn pups when attacked. The male would have naturally helped her as he is very attached to her. They have been impounded and in order for us to get them back after the court appeal, we will have to abide by some very strict and expensive regulations. We not only have to register them as dangerous, we must also, keep them in a special kennel, pay fees each year, have them on a leash and muzzle when out, spay and neuter, and carry $100,000.00 liability or surety bond on each dog. Our county euthanizes every dog that is declared dangerous and that is the bulk of the animal control officer's job. If a dog harms a person, it is declared vicious, and euthanized. We want our dogs to be given a second chance as they are very dear to us and our children. Hopefully, this will be the start of getting the law amended so family pets will not be killed needlessly.We know this is happening to family pets in our county on a daily basis.
We, therefore, request that Prince Edward Circuit Courts return the two Saint Bernard dogs to their owners without being deemed dangerous dogs and an effort be made to amend the law so that given the circumstances some dogs will have a second chance.
This petition will be submitted to the Prince Edward Circuit Court on May 13, 2008.

I am going through a similar situtation right now. My dog bit a girl who came into my home without me knowing. I was in the bathroom and heard my dog (which is a boxer) bark. I ran into the front room and he was sitting there just looking at her. I went to see if she was alright and she ran outside so I followed her to her mother and told her what happened. It left a mark and bled a little and her mother said she thought it would be okay. I told her I was willing to pay for any injuries. The next thing I know, my doorbell rings. Guess who? APO was there to pick up my dog for quarantine- 10 days at 25 dollars a day. That's right I had to pay $250 to get my dog out. Not only that but the little girls mother told APO that my dog chased her out the door. Then how come she was in my front room. The mother had sent her over to borrow my cell phone ignoring the sign I had posted "Beware of Dog" On top of that I have to pay $215 dollars a year for registration. I had to get him microchiped and I have to carry $100,000 surety bond just to have him. Rediculous. APO tried to talk me into having him put down and his head removed. He thought he had me because we didn't have all this money up front. Lets just say, he was a little disappointed when I called him to tell him that our prayers were answered and the money came available (thanks to my dad who just loved our boxer). So does this mean that if someone came into my house and tried to hurt me and my dog attacks him that I'm liable. I bet so. Anything for people to get money. That's all they care about. Well they can have my money because that dog means more to me than that.

I'm sorry for what you have to go through and I hope all ends well.

Another case were responsible owners & loyal pets are judged because of a blanket law, regardless of the circumstances. Come on, where's the evidence these dogs are vicious? No one saw what triggered the fight. It's obvious & more logical they were defending themselves & each other. How can defense be judged as aggression?

Dogs like people have arguments, it was nothing bad, and since nobody saw the fight starting and those two dogs have never done anything like that. I think they should have a sencond chance.

since the owner of the other dogdoes not hold crutches you shouln't either. And the vet bill has been paid by the owner of the St bernhards. So rethink your decision, laws are not always catering for all situations.

The dogs are innocent and there is no solid evidence that the dogs commited any act of violence. Just another bent judge I guess.

Im sick and tired of these judges who think they know how to pass judgement when of course they don't.

If no one saw the fight then it is in NO WAY fair to blame the dogs that were uninjured. Saint bernards have thicker coats to protect from teeth and claws that would leave marks. Also Saint bernards are not known to be vicious dogs, while alot of german shepards are known to bite.

Seeing as the owner of the injured dog isn't pressing charges, maybe he/she know more than they are letting on. Sounds like maybe they saw their dog attack the others and don't want there dog labled vicious, hopefully its been checked to see if the Sheperard has been known to bite or attack. Also the other owner may not be pressing charges because THEY FEEL GUILTLY about the whole thing.
