writ petition under article 249A against FIR 06 DATED 02-01-2018 GULGAST POLICE STATION MULTAN.
The applicant hold a electronic shop in G-9 Markaz (Karachi Company) Islamabad deal in electronic items etc with Dawlance Rawalpindi Brach since 2006.
That applicant is doing his honestly and millions rupees of business on record which applicant paid to the concerning company for purchasing electronic items off and on.
That according to customer of company the applicant submitted advance cheques of difference amount to company the reason that whenever the goods are delivered that the said may can present in the bank for payment of invoices.
That it is what to mention that all the business was carried out at Islamabad from Rawalpindi sales office hundred of million are paid to Rawalpindi Dawlance sales Branch and same delivered the electronic items are my demand order.
That not a single transaction or deal was done any other office like Lahore or Multan. But astonishingly sales officer Muhammad Arshad khan presented the cheuqe given by the applicant which was the record of Rawlapindi Sales office and same was liable to take any action against the applicant but with malafidy intention the said sales officer present the cheuqe at Lahore and moved an application to Shadman Police station Shadman Lahore in result FIT No 570/17 Dated 14-12-17 was launched against the application.
That in connection of above said FIR No 06 DATED 02-01-2018 GULGAST POLICE STATION MULTAN by the Mr Sajjad Bashir Bloch who hold a law office Dawlance sales office Multan moved same application on same ground to Police station Gulgist Multan whereas applicant carried on any business with the Multan Dawlance sales office .
That both FIRs are lunched with baseless and mollified intention only to harse the applicant with out any reason.
That applicant was arrested by the Multan police from the Lahore when the applicant was present in the Lahore in the court of Mr Muhammad Yasir Nadeem Razaq Add Section Judge to confirm the Pre arrest for the FIR which was launched by Lahore police station.
The Multan police arrest illegally and took the applicant to Multan police station Gulgasit Multan and confirm the applicant in the police station with out any legal proceding after four (04) days the applicant taken by the police to concerning magistrate who send the applicant to Judicial custody.
The applicant avail after arrest bail from the Multan.
That the both learned additional section judges Lahore and Multan,s finding is same that, because no any transaction was carried on Lahore or Multan therefore applicant is allowed after arrest / before arrest.
In above circumstance’s it is requested that an investigation may taken to make transparent the case and take legal action against galti person or department
