Elevate Criminal Charges Against Susan A. York

On October 15th, 2015, 17 year old Sarah Monte Banuelos was tragically killed in a wrong way vehicle collision on the 91 West Freeway in Carson, California. The driver of the wrong way vehicle, Susan A. York, is due for arraignment on May 31st, 2016 at the Compton Courthouse where she will plead guilty or not guilty to the charge brought against her. As stated in the police report, York knowingly and intentionally drove the wrong way on the freeway. She was not under the influence of any drugs or alcohol at the time of the collision and she had no prior history of mental illness.

At the moment, York is being charged with PC 192(c)(2) Misdemeanor Vehicular Manslaughter; However, in order for the Banuelos family to receive any sort of justice from Sarah's senseless and tragic death, we must convince the court to elevate the charge brought against York. At the very least, York should be charged with PC 192(c)(1) Vehicular Manslaughter with Felony Gross Negligence.

17 year old Sarah Monte Banuelos was tragically killed in an auto collision involving a wrong way vehicle on the 91 West Freeway in Carson, California on October 15th, 2015. Sarah was returning home from a trip to Disneyland with her cousin and infant nephew when her cousin noticed headlights traveling in her direction. The wrong way vehicle was driven by Susan A. York. Sarah's cousin attempted to swerve to the left towards the barrier to avoid collision, but York's vehicle continued straight resulting in a head on crash. Her cousins vehicle spun uncontrollably to the right where it was struck again by a passing vehicle. The second collision caused her cousin's vehicle to spin uncontrollably back to the left where it made contact with the barrier and came to a rest.

Unfortunately, Sarah suffered fatal injuries due to the force of impact and was pronounced deceased on scene; All other parties involved, including York, were able to exit their vehicles. York was not found to be under the influence of any drugs or alcohol at the time of the collision. York had neither seen a psychiatric doctor nor had a history of mental illness.

After 7 months of thorough investigation and reviewing of witness statements, it was determined that York knowingly and intentionally drove the wrong way on the freeway. It was recommended in the Police Report that York be charged with PC 192(c)(1) Vehicular Manslaughter with Gross Negligence.

Dependent upon evidence, PC 192(c)(1) Vehicular Manslaughter can carry a Misdemeanor Gross Negligent Charge or a Felony Gross Negligent Charge.

Regrettably, the Los Angeles Court has decided to charge York with PC 192(c)(2) Misdemeanor Vehicular Manslaughter.

Both PC 192 (c)(1) Vehicular Manslaughter with Misdemeanor Gross Negligence and PC 192(c)(2) Misdemeanor Vehicular Manslaughter carry the following potential consequences:



  • Misdemeanor probation, 

  • A sentence of up to one (1) year in county jail, and/or

  • A fine of up to one thousand dollars ($1,000).


PC 192(c)(1) Vehicular Manslaughter with Felony Gross Negligence Charge carries the following potential consequences:



  • Felony probation, 

  • Imprisonment in the California state prison for two (2), four (4) or six (6) years, and/or 

  • A fine of up to ten thousand dollars ($10,000).


It is our mission to make certain that Susan A. York pleads guilty to PC 192(c)(1) Vehicular Manslaughter with Felony Gross Negligence.
