Newbury Park Residents Opposed to Magoos Application (Case: SUP 2015-70329)

Newbury Park is a peaceful and quiet community of families with elementary to high school aged children who need their neighborhoods to be free of irritating and interuptive loud music so they can get the healthful and restful sleep they need to perform well in school, in after school activities and at home.

Magoos application to transform its family sports grill into a Los Angeles style night club and offering hard alcohol and live entertainment that would bombard our quiet neighborhoods with loud unwanted music until 2:00 a.m. from Thursday through Sunday is in complete opposition to this communities obvious goals.

The noise generated from this atmosphere would be in direct violation of Ventura County Municipal Ordinance No: 4124 Sec 6299-1 'Loud or Raucous Nighttime Noise in Residential zones'

Magoos Sports Grill has long stood as a business supporting Newbury Park Community's Pride and Family values which we have long developed through school pride and youth sports. Magoos has held a proud and welcomed tradition of supporting all of the youth and young adult as well as adult sporting organizations of the Conejo Valley, Moorpark, Camarillo, Westlake Village, Agoura Hills, Malibu and the teams that visit here to compete in sanctioned events. Children and young adults from Elementary School age through High School age, as well as AYSO and sanctioned club sporting events have traditionally come to expect Magoos to be there for them after the game for celebration of hard work and good sportsmanship and a game well played. Newbury Park Community holds a pride in our children that is second to none in its endeavors to encourage our kids to become involved in the community through participation and achievement in sports activities after school. Many hundreds of businesses such as Magoos have long supported the Newbury Park youth, schools and sports activities for decades and decades.

The new owner of Magoos would think it’s okay to just step in change the values of our community by inserting a Los Angeles style night club and offering hard alcohol and live entertainment that would bombard our quiet neighborhoods with loud unwanted music until 2:00 a.m. from Thursday through Sunday, which is in direct violation of Ventura County Municipal Code Ordinance Number: 4124 Sec 6299-1 'Loud or Raucous Nighttime Noise in Residential zones' which states: "The Ventura County Board of Supervisors adopted a Noise Ordinance intended to protect residential communities from loud or raucous nighttime noise. No person shall create within any residential zone of the County of Ventura any loud or raucous noise which is audible to the human ear during the hours of 9 p.m. to 7 a.m. of the following day, at a distance of 50 feet from the property line of the noise source or 50 feet from any such noise source if the noise source is in a public right-of-way."

We do not want our peaceful neighborhoods disturbed by a nightclub atmosphere at all let alone disturbing our children’s right to sleep through 2:00 a.m. four days a week. This type of business does NOT belong in Newbury Park. None of the residents surrounding Magoos establishment want this type of business in our community.
