Punish dr.Radu Niculae, Vet Accused of Killing Hundreds of Dogs by “Castration”

Under the medical-veterinary services contract signed with SPU (Salubritate Publica Urbana Curtea de Arges SRL - Urban Public Sanitation Curtea de Arges Ltd.) under the umbrella of the City Hall Curtea de Arges, the vet RADU NICULAE, in 2012, of the 991 stray dogs declared he castrated, on average 500 were female.

THE MAJORITY OF THE FEMALES DIED ON THE STREETS OF THE TOWN, IN UNIMAGINABLE PAIN, IN A MAXIMUM OF TWO MONTHS FROM THE NEUTERING.

The operations of dog neutering were erroneously and faultily conducted – severe veterinary malpractice - thus the majority of the dogs had severe medical problems, that in the most cases ended up with the death of the animals.

The saved animals were only the ones that were subsequently transported by the citizens to private veterinary cabinets or to associations of animal protection.

The National Federation for Animal Protection, FNPA, from Romania sent a complaint to the College of Veterinarians of Romania (CMV) requesting the cancellation of his right to practice veterinary medicine until the moment of cancelling his right to profess.

In spite of all evidence provided by FNPA (medical certificates of doctors in veterinary medicine who reoperated suffering animals and who certified as to the faulty operations conducted by vet Radu Niculae, testimonies of citizens, photo and video materials from the time of the surgical re-intervention) the County Commission of Ethics and Litigations Arges within the College of Veterinarians Arges decided, by Decision no. 5/2013, that “there are no elements to prove that the Code of veterinary medical ethics was infringed” by vet Radu Niculae!

FNPA contested this decision at the Superior Commission of Ethics and Litigations within the College of Veterinarians Bucharest, from whence no verdict has come yet and where persists the same tendency to ignore this case but also a strongly tendentious attitude.

We consider it an unbearable situation for this case not to be solved, that the College of Veterinarians from Romania supports by its passive and protective attitude fellows who kill en masse, by lack of professionalism, lack of medical interest, of respect to animals, lack of moral conduct and compassion.

These horrendous crimes would immediately lead in another country to the cancellation of both the right to profess and to the deprivation of liberty of the perpetrator.

According with our information the National Federation for Animal Protection, FNPA, from Romania:

-          Noticed the irregularities found both to the Curtea de Arges Town Hall and the SPU as well as to the other authorities with competence to take measures for the remedy of the situation and/or sanctioning of the plaintiff: DSVSA Arges (which suspended the activity of the Town Hall dog shelter two times), the Police, the CMV;

-          Transmitted a notification to vet Radu Niculae requesting him to stop the activity of animal neutering indicating the fact that otherwise they will appeal to the support of the competent courts of law;

-          OFFERED FREE SERVICES of reoperation of all the “neutered” dogs by vet Radu Niculae and of neutering non-neutered females but the Curtea de Arges Town Hall and the SPU company refused the free services but preferring to continue to pay the services to SPU and the vet from the local budget;

-          Submitted a CRIMINAL COMPLAINT against the vet Radu Niculae. Around 60 written declarations that incriminated the vet Radu Niculae were given by citizens to the Police of Curtea de Arges in the stage of the case research!

The stray dogs’ management in the town of Curtea de Arges is conducted by SC Salubritate Publica Urbana Curtea de Arges SRL (Urban Public Sanitation Curtea de Arges Ltd.) (SPU) that has a contract of providing medical-veterinary services with Radu Niculae- Veterinary Medical Cabinet.


Under this contract vet Radu Niculae (reg. Certificate VPC 1305/2004, certified number 716) neutered during 01 April-31 October 2012 a number of 991 stray dogs, e cashing for the services provided the sum of 51.561,50 Lei.


Of the 991 dogs declared as neutered, on average 500 were female.


According to the information received, THE MAJORITY OF THE FEMALES DIED ON THE STREETS OF THE TOWN, IN UNIMAGINABLE PAIN, IN A MAXIMUM OF TWO MONTHS FROM THE NEUTERING.


From the ex propriis sensibus findings it results that:


-          The operations of dog neutering were erroneously and faultily conducted – severe veterinary malpractice - thus the majority of the dogs had severe medical problems, that in the most cases ended up with the premature death of the animals (these actions being of such a nature as to be included in the action of a criminalnature)


The saved animals were only the ones that, noticing the very precarious state of the bitches brought back (in 2012) from the Town Hall dog shelter after the neutering, were transported to private veterinary cabinets or to associations of animal protection, with an eye to treating, the veterinary physicians reoperating them and confirming, by medical certificates included, the faulty way in which the neutering operations were conducted by vet Radu Niculae.


-          The veterinarian Radu Niculae unjustly appropriated, with the help of SPU, the performance of neuterings basically achieved by private persons, of some of the stray dogs, with the purpose to obtain, by the contract signed with the Curtea de Arges Town Hall, potentially undue revenues.


We inform you that the National Federation for Animal Protection, FNPA, from Romania:

FNPA sent a complaint to the College of Veterinarians of Romania (CMV) requesting the cancellation of his right to practice veterinary medicine until the moment of cancelling his right to profess.


In spite of all the submitted evidence:


-          The medical certificates of the veterinarians/doctors in veterinary medicine who reoperated seven suffering animals and who certified as to the faulty operations conducted by vet Radu Niculae. Two medical certificates were issued by the Faculty of Veterinary Medicine from Bucharest – the Department ofSurgery


-          Testimonies of 12 citizens from Curtea de Arges


-          Table with signers containing personal references to the persons who supported the complaint


-          Photo and video materials from the time of the surgical re-intervention


The County Commission of Ethics and Litigations Arges within the College of Veterinarians Arges decided, by Decision no. 5/2013, that “there are no elements to prove that the Code of veterinary medical ethics was infringed” by vet Radu Niculae!


FNPA contested this decision at the Superior Commission of Ethics and Litigations within the College of Veterinarians Bucharest, from whence no verdict has come yet and where persists the same tendency to ignore this case but also a strongly tendentious attitude.


These horrendous crimes would immediately lead in another country to the cancellation of both the right to profess and to the deprivation of liberty of the perpetrator.


We consider it an unbearable situation for this case not to be solved, that the College of Veterinarians from Romania supports by its passive and protective attitude fellows who kill en masse, by lack of professionalism, lack of medical interest, of respect to animals, lack of moral conduct and compassion.


With an eye to the flagrant infringement of:


-          Law no. 205/2004 regarding animal protection (with the subsequent changes and completions) - that make the facts presented as being of a criminal nature and are punished with penal fine or prison


-          The medical-veterinary Ethics code and the veterinary physician’s Status, whose provisions are mandatory in exercising the profession of veterinary physician


-          Law 160/1998 for the organization and exercising of the profession of veterinary physician (with the subsequent changes and completions)- that state that “the Quality of member in the College of Veterinarians of Romaniaand the exercise of the profession of veterinary physician become unworthy and are suspended for the performance of certain activities that counter the norms of the veterinary –medical Code of ethics.”


WE REQUEST THAT YOU URGENTLY TAKE THE MEASURES TO CANCEL THE RIGHT OF VETERINARIAN RADU NICULAE TO PROFESS, AND TO PUNISH HIS DEEDS ACCORDING TO THE LAW.
