Abolish the male guardianship system إنهاء نظام ولاية الأمر على النساء

أعلنت حكومة المملكة العربية السعودية تحت قيادتكم الكريمة عن برنامجها الشامل للتحول الوطني، و الذي أكدت فيه التزامها بالاستمرار في تنمية مواهب و طاقات المواطنات و تمكينهن، ولا يغيب عن قيادتكم الحكيمة ما يمثّله نظام ولي الأمر من قيود على المواطنات تؤدي إلى فوات مصالحهن و تقييدها برغبات الأولياء فضلا عن تعريضهن للفقر و الاستغلال و العنف، و بالنظر لمكانة المملكة في العالم الإسلامي فلا يتفق وجود هذا النظام مع الآراء الشرعية المعتبرة و التي تؤكّد على ولاية المرأة الراشدة على نفسها و إقامتها و مالها و كافة شؤونها، كما يعيق هذا النظام تحقيق رؤية التحول الوطني بما يفرضه من أعباء مادية و قضائية و إدارية على جهات الدولة في مواجهة نتائج هذا النظام، سواء في التعامل مع أعباء العنف الأسري أو بطالة النساء و فقرهن أو النظر في قضايا النساء ضد أوليائهن، كما يفرض هذا النظام عبئا على أولياء الأمور حيث تتعطل مصالح النساء حال انشغالهم و سفرهم للعمل أو الخدمة العسكرية أو غير ذلك، وقد أكد وفد المملكة العربية السعودية في مجلس حقوق الإنسان في الأعوام 2008 و 2013 على التزام الحكومة بإلغاء نظام ولي الأمر، و لذلك فإن إصلاح الأنظمة بما يتماشى مع التزامات الدولة القانونية و بما يحقق مقاصد الشرع في ولاية المرأة على نفسها حال بلوغها سن الرشد هو الخطوة الأهم في أي تحول وطني مطلوب، وعليه فإننا نتقدم لسموكم بهذه التوصيات لإلغاء اشتراط موافقة ولي الأمر في حصول المرأة على الخدمات التالية:

استخراج الوثائق الوطنية من هوية و جواز سفر و بطاقة عائلة، و تمكينها من تعديل الحالة الاجتماعية لها و لأطفالها بتبليغ الولادة أو الوفاة أو الزواج

الالتحاق بكافة المؤسسات التعليمية و التدريبية و البعثات التأهيلية و الرياضية

الالتحاق بأي عمل في الدولة في القطاع الحكومي أو الخاص

التنقل سواء داخل أو خارج المملكة

الإقامة و تأجير السكن بما يناسب المرأة بلا إجبارها على الإقامة مع ولي أمر أو محرم

الحصول على أي خدمات طبية أو إسعافية تحتاجها، سواء بداخل منزلها أو في الحوادث المرورية أو في أي منشآت أخرى

مراجعة أي منشآت رسمية أو خاصة، و على الأخص في الشرطة و القضاء و المرافق الحكومية

إطلاق سراحها من السجون أو دور الرعاية أو المصحات التأهيلية

أي قرارات تخص أطفال المرأة من تعليم و علاج و تنقل



و تقبلوا تمنياتنا و دعواتنا بالتوفيق و السداد لكل ما فيه تكريم و بناء لهذا الوطن

In light of the 2030 National Transformation Program that launched under your leadership and in which you committed to the continuous development and empowerment of citizens, the guardianship system can no longer be tolerated. The guardianship system has shackled women to the whims of their male guardians and subjected them to poverty, exploitation, and violence. This guardianship system is inconsistent with the position of the Kingdom in the Muslim world. The majority of reputable Islamic scholars agree that adult women in Islam have free agency over themselves, their finances and properties. Moreover, the guardianship system obstructs the fulfillment of the 2030 Program as it will burden governmental judicial, financial and administrative resources. Civil services are weighed down by women unemployment, domestic abuse, and guardianship annulment cases. The guardianship system is not only a burden on women but also on the men assigned as guardians. When guardians are unavailable due to work, travel or military service, the women under their guardianship are incapacitated. Above all, the Saudi delegation to the Human Rights Council has already promised in 2008 and 2013 the government’s commitment to abolishing the guardianship. Hence this reform is aligned with the Islamic ruling of the majority scholars and the state’s legal obligations to the global community. We as loyal citizens of the kingdom ask your highness to grant women the right to control their lives, through entirely abolishing the guardianship system over women in every aspect of their lives upon reaching the legal age of eighteen. By terminating such a demeaning system, we will be on the right track towards realizing the 2030 Program’ vision and improving the standard of living, as promised, to all. Thus, we request that guardianship approval no longer be a condition for the following:

• Applications for citizen identification cards, passports, and family cards and notifications for marriage, death and birth.
• Enrollments for educational institutes, scholarships, training and sports.
• Applications for governmental and private sector employment.
• Residences and rentals without an accompanying male guardian.
• Domestic and international travel.
• Medical and emergency services within the home, at traffic accidents and anywhere else it is needed.
• Visiting private and governmental facilities such as the courts, police, ministries and others.
• Release from prison, rehabilitation centers, and nursing homes.
• Any medical, travel and educational decisions concerning a woman’s children.
