Stop the Laguna Village Cell Tower

The Directors of Laguna Village HOA have illegally decided to grant a lease to Verizon Wireless for the purpose of building a cell tower on Laguna Village property. Laguna Village CC&Rs expressly forbid this action, primarily in article 2.5 which states:
The Recreational Common Area shall be improved and used only
for 
(i)Recreational use by the Owners and occupants of Units and their guests,
(ii) vehicular parking. 
(iii) vehicular and pedestrian movement within the Project and 
(iv) beautification of the project, subject to rules and regulations adopted by the Association.,

There are multiple other Code violations within the CC&Rs including articles 2.6, 2.7 & 5.2.


In addition to being an illegal decision,  it is also a controversial act for (4) very serious reasons.

These studies may or may not be accurate, but LVOA's (6) voting directors do not have the proper authority to make these judgements. (LVOA's 7th Director is employed by Verizon Wireless and therefore should not legally participate in these discussions)

3) The payment for this lease is less than 1% of our annual income from dues (around 0.82%), and the total 5 year lease will collect an amount that is less than 0.5% of the combined value of our homes, so, even a 1% drop in property value is far greater than any economic income of the cell tower. In addition, unlike dues paid by home owners, the income from the cell tower is a corporate income that will be taxed, thus lowering the economic benefit far below the apparent 0.82% increase in income. 

4) Such negligent actions will certainly spark further additional political disarray that is similar to that in which Laguna Village has been struggling to escape. Recent conflicts have driven Laguna Village into bankruptcy which is terrible for local economy. Nobody in LVOA ever tries to fight for tragedy, but the fighting always leads to economic tragedy. Do we really need to provoke another economic fight right now? There is already a recall action in place due to this cell tower topic. Stoping this cell tower will be the key factor to stopping another recall effort and lawsuit against the individual directors.

3) I believe that the decision to build a cell tower is not in the best interest of our residents and owners.

4) I personally do not want the cell tower built in laguna Village.
