Call for Public Hearing and Referendum on CVS Settlement

We, the undersigned, are qualified electors in the Town of Clinton.

We hereby petition the Court to reject the settlement agreement reached between Arista Development (Arista) and the Clinton Planning and Zoning (PZC) reached on July 10, 2017. This settlement would permit Arista to have a drive-up window, which requires a special exception in the B-3 zone and is prohibited in an I-1 zone, where the drive-up window would be located. Arista never even applied for any special exception. Therefore, no public hearing has ever been held on the drive-up window issue.

Previously, the PZC had unanimously rejected a site plan application and rejected, by a 6-2 vote, the application to amend the regulations, which would have served to illegally spot zone this parcel. The proposed settlement would actually grant Arista everything it requested under the original illegal spot zoning application.

We believe the proposed settlement was basically extorted. It was obtained by threatening the PZC with a very unattractive building if Arista prevailed in court.

We pray the Court agrees that the people of Clinton have a right to be heard and that this proposal should be placed before the public, first at public hearing, then in referendum.

I attended the "settlement" hearing. P&Z's attorney failed to mention the opposition to the "settlement". I contacted CVS, learned they never even had a contract with Arista. I have now created a new petition to be submitted to CVS. Please consider signing my petition at https://www.thepetitionsite.com/takeaction/541/889/531/.
