Repeal Judge Tamara L. Mosbarger

    Judge Tamara L. Mosbarger has let off multiple violent criminal offenders in Butte County even though in all of the cases the DA and the psycological behavioralists believed the criminals should serve prison sentences. Two recent cases that made me set out and start this petition are the cases against ex CHP Jacob Duenas on February 2nd and the case against Jared Flower. Duenas was found guilty of molesting a 10 year old boy while on probation for a prior similar charge. The DA recommendation was a prison sentence. The county had a psychologist, independently commissioned by the court, who made a finding that Mr. Duenas was a pedophile and a sexual predator and regardless of that, the judge sentenced Mr. Duenas to 180 days in county jail and probation. Also keep in mind that Duenas was already on probation for a similar charge. A 14 year old girl. While on probation he pulled another charge for sex with a 17 year old. Jared was 25 at the time and the DA recommendation was 6-8 years in prison.     8/14/2018: A sexual predator previously sentenced in Butte County to jail and probation for molesting a ten-year-old boy was found guilty of child rape Monday, his fourth victim without having to serve any prison time thus far.
    Jacob Mark Duenas, a former Monterey County-based California Highway Patrol officer, was found guilty on Monday of raping an 8-year-old boy while he was striving to become a law enforcement officer.
    Duenas, 37, was fired from his CHP job in Salinas after he pleaded no contest to molesting two girls, ages 13 and 14, in 2008. He was a CHP officer at the time of the abuse.
    He served no jail time in connection to the Salinas case and was required to register as a sex offender.
    A few years later, he was arrested again, and pleaded no contest to molesting a 10-year-old boy in Chico, California in 2014.
    A court-appointed psychologist, Dr. Daisy Switzer, testified that Duenas was a sexually violent pedophile.
    He was sentenced to serve 180 days in jail and five years probation.
    At the time of the sentencing, Butte County Deputy District Attorney Matt Taylor told KRCR-TV, "My feelings on the sentencing are summed up in one word: surprised. What makes this case unusual is that you have a psychologist, independently commissioned by the court, who made a finding that Mr. Duenas was a pedophile and a sexual predator. And regardless of that, the judge sentenced Mr. Duenas to probation."
    Now that Duenas has been found guilty of committing sex offenses against a fourth child — this time raping an 8-year-old boy — Duenas will likely be sent to prison for the first time.
    Duenas' sex crimes against children date back to when he was 18 years old and studying to become a law enforcement officer. He was living in a house in Gig Harbor, Washington, when he repeatedly raped an 8-year-old boy who was also staying at the house in the summer of 2000, according to testimony at his latest trial.
    Duenas was arrested in connection to the 2000 case in November of 2017.
    The Gig Harbor victim testified that he was humiliated and scared. His personality changed as he became more angry and isolated himself. He did not tell anyone about what happened to him until years later.
    Duenas' aunt testified that Duenas admitted to her that he was "good at" secretly sexually abusing children without others finding out, and that he said, "I have been fighting demons for years."
