Save my 1914 Heritage Patrol and Fire boat from illegal seizure.

This action is important because it represents the truth. It rights a wrong. The implications are astounding.

What is at stake?

I lose my boat.

I lose my career.

I lose my retirement.

I lose my tools.

I lose all my boat equipment.

I lose all my materials fasteners and hardware.

I lose the work done in the man-hours put into the boat.

My boat is my art, I lose my art.

We all lose the boat’s heritage.

And we all lose future dreams.

Then there are the losses to the Port and its reputation.

 

The Port of port Townsend has illegally deemed my boat (a 55 ft., 1914 Seattle Harbor Patrol and Fire boat named Patrol No.1) a derelict vessel purely for arbitrary reasons (Not the first time, it has happened to others). They did not follow State guidelines.

They did not follow State guidelines. There was no Port policy or procedure in place nor was one provided to me to declare Patrol No.1 a derelict. This is normally done by the Department of Natural Resources when vessels are abandoned. I have spent $185,000 in 5 years rebuilding 80% of her hull and decks after she got crushed by 3 large fishing boats. This was done while I maintained a "payment record" that was always in "good standing" according to the accounting department. I was finishing installing planks in order to get her back in the water when a Port Director who had never met me or seen the boat deemed Patrol No.1 a derelict. They have taken my property, my investment, my livelihood and my life's dream.
Sign the petition to force the Port to rescind their unethical act, return the derelict fee and allow me to finish my boat and so I can go back home to Canada.


What needs to happen next is that the court decision needs to be rescinded.  It wouldn’t be the first time that a court has made a wrongful decision.  The people who can make that change are Sam Gibboney, the Port director, and Steve Tucker and Peter Hanky who are Port commissioners.  All they have to do is admit that my boat is not a derelict vessel and state the truth about my stay in the Port.


If I win I get my boat back and I get to finish it.  My five years and $185,000 will not have been wasted.  My boat is also now my art and my livelihood.  I have already had an identity theft here, I wouldn’t want to lose all I have left in life.  If I lose, the Port keeps my boat and I have no idea what they intend to do with it. Pivarnick has talked about destroying it.

I suppose the best way to make it personal would be for you to pretend that this was happening to you.  It isn’t the first time that we’ve seen someone get bullied.  It probably wont be the last.  It’s said that at one point or other, everyone has been bullied at some time in their life.  It doesn’t get more personal than that.  “A lie is twice around the world while the truth is still lacing up its boots”. The truth will get around sooner or later. This petition is seeking the truth.


My boat is not a derelict, and I just got picked on.  I have to fight for it or I let one man that I’ve never met and has never seen my boat take everything away from me for reasons that I still don’t know.  I’ve been told over and over again that I have no reason to be ashamed or embarrassed or scared yet being human, I feel all those things.  Please help me reverse a very unjust decision and tell the Port of Port Townsend to return my heritage boat back to me please.  Thank you

WOW!! Thank you for your support! I've learned that the Port will be moving my property on July 5, we have to pressure the 2 Commissioners to do the right thing.
