SEC and Judge Alison Nathan Please Treat Elon Musk fairly!

I also fully support the settlements agreed today and believe that the prompt resolution of this matter on the agreed terms, INCLUDING THE ADDITION OF TWO INDEPENDENT DIRECTORS TO THE TESLA BOARD and the other governance enhancements at Tesla, is in the best interests of our markets and our investors, including the shareholders of Tesla.

I believe that attempting to dilute or reduce Elon Musk's control over Tesla is not in the best interests of the environment, the citizens of the U.S., or almost all investors. Elon has made a long series of brilliant strategic decisions is support of his goal expressed in this recent tweet:
"Tesla exists to help reduce risk of catastrophic climate change,
which affects all species on Earth. Even if your faith in humanity is
faltering, this is worth caring about. Support makes a difference."

Look at his decision to build Tesla's Gigafactory 1 (a lithium-ion battery factory) in Storey County, Nevada, U.S. Tesla expected that Gigafactory 1 would reduce the production cost for their electric vehicle battery and Powerwall and Powerpack packs by 30%. Tesla partnered with Panasonic to build the battery cells. It took a while for Panasonic to agree because initially they didn't believe that the cost reduction estimates were realistic (turned out to conservative) and they had doubts about demand.

Grid battery storage is a crucial technology for the environment. It's clearly crucial for the deployment of renewable (intermittent) energy sources but battery storage also reduces the fossil fuel required to power the grid by 30-50% because batteries can exactly match demand.

The two biggest obstacles to greater deployment are cost and supply both of which the Gigafactory is starting to address.

For the U.S. public in addition to the environmental and reduction in the costs of grid power Tesla is currently planning to employ 10-20k people at the Gigafactory. When it was announced many experts thought that large scale battery production in the U.S. would never be competitive with China.

For investors one example of the impact of the Gigafactory
Daimler's truck doesn't compare favorably to Tesla's electric semi
truck prototypes, which the company claims can travel up to 500 miles with a 80,000-lb full capacity.

"At the launch event for the eActros test fleet today, Daimler's head
of trucks, Martin Daum, told reporters that he has doubts about Tesla achieving those specs:
"If Tesla really delivers on this promise, we'll obviously buy two
trucks — one to take apart and one to test because if that happens,
something has passed us by. But for now, the same laws of physics
apply in Germany and in California.""

Elon and Tesla have frequently missed their schedules but they have never missed on battery range.  As an investor you couldn't
invent that misguided level of skepticism.
There are two remaining classes of Tesla investors. Innocent shorts and shorts relentlessly pushing an exaggerated negative narrative. If the SEC is concerned with protecting innocent short investors they should go after the people who are pushing an exaggerated negative narrative.

I'm not trying to claim that Elon did not make a mistake. But I don't believe that he was intensionally trying to mislead investors.
