Demand to stop tyranny of Austrian Authorities against the anticancer preparation NSC-631570

We, the undersigned, support Complaint No. OTP-CR-280/13 of 17th September 2013, sent by Dr. Wassil Nowicky to the International Criminal Court for Human Rights in The Hague (The Netherlands), against the actions of Austrian Authorities for their failure to act in the case of the registration of the anti-cancer drug NSC 631570 (in contravention of Article 265 of the Treaty on the Functioning of the European Union) as well as against the violation of Article 7 (2b) of the Rome Statute of the International Criminal Court (crimes against humanity: deprivation of access to medicine).

Application was made in 1976 for the registration of the anti-cancer preparation NSC 631570. According to legislation in force at the time it should have been registered immediately and automatically because it is made of up two starting substances which had already been registered (Thio-tepa and celandine alkaloids) and its proven selective effect is a clear therapeutic advantage over these starting substances.

However, this application has still not been dealt with by the Austrian Authorities despite a judgment against the Republic of Austria in this matter by the European Court of Human Rights

Clinical studies have shown that the survival rate (up to 21 months) for patients with colorectal cancer treated with NSC 631570 was 78.6% but only 33.3% in a corresponding control group of patients treated with chemotherapy. The use of NSC 631570 with children cancer sufferers who had already exhausted all other conventional treatment types brought about complete remissions in 64% of cases. Doz. Gansauge from the University of Ulm (Germany) proved that after using NSC 631570 patients with pancreatic cancer live for more than five years, while medical statistics show that after standard treatment patients with such a diagnosis live for 4-6 months and only 3% of patients achieve a five-year survival rate.

NSC 631570 has been presented at specialist congresses about 300 times since 1983 and its efficacy, safety and quality have been tested and demonstrated by about 200 scientists from various universities and research institutes around the world. Around 300 specialist publications have been dedicated to NSC 631570 and 180 of them can be seen on PubMed.

The continuing refusal of the Austrian Authorities to register the unique anti-cancer medical preparation NSC 631570 is a violation of one of the fundamental human rights – deprivation of access to medicine for seriously ill people and especially children.
