Bring victims of bullying justice in South Carolina

In most states if a child gets bullied or assualted in school, the parents/guardian has rights to press charges on the childs bullier. In South Carolina, parents do not have that right. Only the school has the right to do their own investigation and then decide if they want to press charges.
I believe all parents should have the right to press charges against their childs bullier, especially if they've notified school officials and the bullying still continued.
May 12th, 2015, my 12 year old sister was attacked by her long time bullier. She suffered a broke nose and dislocated jaw, broken ribs, hair that was ripped from her scalp, bruises, scratches, and strangulation. On the second punch she fell unconscious and the bullier continued beating her. The bullier was not charged and he was hardly disaplined because the school said there was not enough evidence to charge him although fellow students have come forth as witnesses.
Since then my sister bullier/attacker has been caught following her and my family along with his mother. My parents had no other option than to put place my sister into a different school district. .
In order to bring justice to victims of bullying South Carolina must change this law so parents have the right to protect their children.
