Josie's Law

There needs to be a change in the Hippa Law regarding our elderly parents that are pre diagnosed with mild dementia or Alzheimer's. I have cared for both my parents from 2006 to now. My Dad had passed in 2010 and little did I know that my mother was diagnosed with Dementia. She was worried as her mother went through the same symptoms and ended up in a state institution back in the day when they did not know how to diagnose the disease. She was worried about losing her independence and therefore did not tell anyone in the family she had been diagnosed.
Her primary care doctor did not disclose any information as the Hippa Law protected her. I got a crash course in dementia. She ended up in a hospital on a trip home from Florida and she did not even recognize her own son. I had to dial 911 and have her admitted to a hospital wondering what was happening.
I also had a truck loaded with our belongings and a car which I had to get home. I went through three days of hell getting things situated and returning to the hospital to get her diagnosis.
I am sure many of us have had to deal with loved ones and this disease. I am wondering why I get all the red tape to just assist my loved one. I submit the POA and health proxy information only to still be told I cannot receive any updates on her condition without proper documentation.
My petition is two fold if we are supposed to be a nation where we evolve and make things better for all involved.

1. I think if a loved one is pre diagnosed with Dementia or Alzheimer's a family member should be contacted and dedicated as the patients health care proxy and given information to assist the loved one to make proper decisions regarding their health and affairs. If no sibling or family member is available their should be someone assigned to their case from the state they reside in.

2. There should also be a national database to file a POA and necessary paperwork that is accessible to health care professionals. There should be a security question system to be answered by the designated representative. This will enable the representative to get updates on their loved ones condition.
