Justice for a Father

My brother, Larkin Forney (b. 7-7-77) is a survivor of TBI (traumatic brain injury) sustained in 1986.  He is  a college graduate (CCV, 2008) and a father trying to rescue his 6 year old daughter from her abusers (her mother, stepfather and others).
He is wrongfully labeled a sex offender by the state of VT, due to the lies of one of the mothers friends--who was underage at the time, but disclosed her age as 17.  Kristen Place (the mother's friend) pursued him and initiated sex with him in 2002. Since his release from prison in 2005, she (the court-appointed "victim") has  stalked him and filed numerous false reports and continues to lie about him in a court of law--and for some reason, they allow it.

The truth is obvious.  Her lies are blatant.  Larkin Forney DOES NOT deserve to be labeled and treated as a sex offender. I stand beside my brother because he has the truth on his side, and what Kristen and others have done is beyond wrong.  Lies destroy lives.
What this has done is allow for the abuse of his 6 year old daughter to continue at the hands of the mother (Kristen's friend).  The court (the judges) and others walk all over his rights and give him no voice in the court on behalf of his daughter.  The mother is in contempt over 40 times but nothing is done....Even when her now husband tries running me over in front of my niece, nothing is done (there is a video on http://www.voicesforvermontchildren.com/) (check out the other petition for his daughter, "Abusive Mother continues, violence escalates..." )

Somebody with a label of sexual assault on a minor is not necessarily someone who has sexually assaulted a minor---in my brother's case it was consensual sex twice with a lying, sexually active and malicious teenager with motives to get him in trouble with the law. 

The associated press did an article on Larkin running for State Senate in 2008. The title was 'Sex Offender runs for Senate'.  He did this because he does see and want change in the system, but he also did it to expose his situation in the hopes to  end the abuse of his daughter and him. 
There is a picture of my brother and myself campaigning in Burlinton.   I stood/stand beside my brother and  exposed myself to millions of people by supporting a "sex offender" because he has the truth on his side.  And the truth does matter.
  This label is damaging and the way our "justice" system handles "sex offenders" is disgusting, because they don't even address the real epidemic of child abuse that starts in the home.  The system and society refuse to address the epidemic of female (sexual) abusers and the lives of innocent children that are destroyed and lost because of this lack of appropriate attention.  A person who molests a child (what is happening to Larkin's daughter at the hands of the mother) is a child molester.
Because of this label attached to my brother, that is what some people see him as---which is far from the truth.
They do not understand that this is a blanket label and does not describe the circumstances surrounding him or this label.  Many other men are falling victim to the "justice" systems' witch hunt on "sex offenders"... and underage sex.
and because their attention is here---innocent abused children (like my niece) and those advocating for them are ignored.  The state does not want "Sex offender father helps free daughter from abusive mother" to be a headline, because that would not be good business for the polititians, lawmakers, or justice or prison systems....
THIS IS NOT JUSTICE.  And Larkin Forney's daughter (and many others) continues to suffer because of it.

Police and judges and others in the system are individual people....and people can and will be  biased.  People with power can and may  abuse it--there is no accountability for those in positions of power.

Larkin has gone through a lot and accomplished a lot, and he deserves the chance to get these events from 2002 off his record.

To knowingly place an innocent little girl in the hands of an abusive mother is inconceivable. The "justice system" clearly has no intention of protecting the welfare of the child, because if they did they would not allow her to remain with this woman who calls herself her mother. This is why I believe that dealing with "sex offenders" should be taken on a case-by-case basis. Larkin Forney is obviously no threat to his child.

I was also just told by a Superior Court judge that 'the system can't give me the relief I want or need.' Then the system has no business in my life, and this should be off my record, because it is just part of a conspiracy, and I can even show how the Vermont Supreme Court, with evidence, got a ruling wrong, and this will just cost taxpayers more in the long run, because the Superior Court also made note how I file so much in all courts, because 'the system can't give me [or my daughter] the relief I [we] want and need.'

My brother has been wronged by people who are abusive and a system that is equally abusive... I have watched it happen. I didn't speak to my brother for several years, but I stand beside him now, because the system perpetuated and helped create tragedy in his (and our) life. And he is the one who got his life back together--using HIS EFFORTS and his desires to reach his goals. I have watched probation officers, lawyers, prosecutors and witnesses lie in a court of law. I have gone to court at least 50 times--and it's not what you see on TV. It is here, that your rights are violated. My brother is the one who gets punished even when he has done nothing wrong. The system isn't about justice at all--it's a business, it's about profit. (25 year minimum for sex offenders would guarantee 1 million for the state of VT prison system....but does it make VT safer? Absolutely not.) only a little over 10 years ago, the prison population in the U.S. was 1 million. Now it's over 2 million and the majority of those in prison have had a TBI or brain injury. Instead of treating survivors like criminals, they (as well as every other human) should be treated with compassion and care. Instead of being so concerned about our economy---we should be concerned about where our money is going---such as The prison Industry (which is larger than the tobacco industry.). And prison only makes our society more violent, costing us not only our money, but our well-being and quality of life. Every 21 seconds a person in American sustains a brain injury---many from abuse, others from car accidents, sports, falls, etc. Most injured veterans have sustained a TBI. We do not have ANY systems that appropriately help those who survive an injury and their family. Instead, they are relagated to "the system..." and seemingly trapped there forever.... but I hope not---this has been a long struggle... Peace, Love and light.
