Law Enforcement Officers operating within the borders of the United States, operate with the knowledge that acts of police brutality, crimes against society, and acts of deprivation of rights will result in "Paid Vacations."
A "Justice for Freddie Gray Act" shall:
1. prohibit the disbursement of funds to any employee acting under a flag of color currently on administrative leave without pay.
2. prohibit a change in the rule of law allowing an employee to remain on duty or at post who is accused of a crime punishable with a felony.
The attorney general for a State or its appointed authority may, in its discretion, place an employee on administrative leave with pay. Administrative leave with pay is to be used only in circumstances where the employee has been found to have committed an act of heroism, courage, or demonstrates an act above the call of duty. Compensation for administrative leave with pay shall be equal to the employee's base rate of pay. The length of administrative leave with pay is solely at the discretion of the appointing authority, but shall not exceed 60 days or the length of the situation for which the leave was granted. An appointing authority may also grant administrative leave with pay of two days or less for employees who are moved in accordance with transfers.
The attorney general for a State or its appointed authority, in its discretion and following a review of all evidence, from all involved parties, shall place an employee on administrative leave without pay if, sufficient evidence exists which demonstrates, by definition of Statute, a violation of law that is punishable as a felony. If the employee subsequently is not found guilty of a felony, in an open court of law, with which the employee is charged or any other felony, the appointing authority shall pay the employee at the employee's base rate of pay, plus interest, for the period the employee was on the unpaid administrative leave.
The Act Shall prohibit a change in United States Law, State Law, Local Law, Union bylaws, procedures and/or rules which would otherwise allow an officer subject to suspension or administrative leave without pay to remain on duty or at post.
Any administration, agency, department or union, causing or procuring an employee to continue on duty or at post, who has sufficient evidence against him/her defining a violation of law punishable as a felony shall result in an immediate administrative leave without pay and/or impeachment, for the crime of conspiracy and/or accessory after the fact, of the administrator of the administration, agency, department or union.
Penalties may be imposed by the United States Department of Justice shall not exceed a fine of $10,000.00 or imprisonment for a period not to exceed 10 years.
