Petition in Support of Immigrants in Portugal Wishing to Return to Their Home Countries

Introduction:

On behalf of immigrants residing in Portugal, we hereby express deep concern regarding the current situation of insecurity and hostility that immigrants, as well as other minorities such as LGBTQIA+ individuals and religious minorities, face on a daily basis.

Context:

Since the rise of the far-right, fueled by fear-mongering and hateful rhetoric from political figures, inciting hatred against immigrants, LGBTQIA+ individuals, and religious minorities without any retraction or governmental sanction, immigrants have been increasingly targeted with acts of hatred, violence, and discrimination, blatantly violating fundamental rights enshrined in the Constitution of the Portuguese Republic (CRP), namely:

Article 13 (Equality): "All citizens are equal before the law." Principle of Non-Discrimination

Article 25 (Right to personal integrity)

Article 27 (Right to freedom and security)

Article 153 (threat to physical integrity)

Aimed at protecting the legal good "personal freedom", protected under Articles 26 and 27 of the Constitution, the crime of threat is provided for in Article 153 of the Penal Code.

Xenophobic, racist, and intolerant rhetoric promoted by extremist groups, including well-known public and political figures with a history of violence against minorities, in flagrant disregard of Article 240 of the Penal Code (CP) which criminalizes "Discrimination and incitement to hatred and violence," has fostered an atmosphere of fear and uncertainty among immigrants. In the current reality, where trust in law enforcement is nonexistent, this is why thousands of immigrants choose to seek support from associations rather than resort to authorities.

In this alarming context, many immigrants feel increasingly insecure and unable to remain in Portugal. The lack of effective response from authorities and the government's inaction in addressing and resolving this issue, in disrespect of its duties enshrined in the CRP, are contributing to this sense of helplessness and despair.

Many immigrants wish to return to their home countries where they hope to find greater security. However, due to precarious economic conditions, they face difficulties in covering the expenses associated with returning, such as airfare and resettlement expenses.

In this regard, we urge the Portuguese government to establish a fund to financially support immigrants who wish to return to their home countries but are facing financial difficulties in doing so. This fund would help cover travel and reintegration costs, allowing them to restart their lives safely.

Furthermore, we request that the government take urgent measures to combat xenophobia, hate speech, misinformation, and violence against immigrants, including:

Implementation of stricter laws to punish hate crimes and threats to physical integrity, in line with Article 240 of the CP.

Concrete actions to dismantle extremist groups that propagate hate speech and violence, in compliance with the duty to protect public safety.

Promotion of public policies that encourage integration and social inclusion of all citizens.

Conclusion:

We appeal to the sense of justice, humanism, and responsibility of the Portuguese government to ensure the safety and well-being of all citizens, regardless of their origin, sexual orientation, religion, or political orientation.

Apoio a Imigrantes em Portugal que pretendem regressar aos países de origem.

Introdução:

Em nome dos imigrantes residentes em Portugal, expressamos por este meio a profunda preocupação com a atual situação de insegurança e hostilidade que os imigrantes, e outras minorias como LGBTQIA+ e minorias religiosas enfrentam diariamente. 

Contexto: 

Desde que a extrema direita ganhou notoriedade, devido a discursos de apelo ao medo e ódio por parte de agentes políticos, e desta forma incitando o ódio contra imigrantes, pessoas LGBTQIA+ e minorias religiosas, sem que haja qualquer retificação do discurso ou sanção por parte da justiça e do governo, os imigrantes têm sido alvo de crescentes atos de ódio, violência e discriminação, em clara violação dos direitos fundamentais consagrados na Constituição da República Portuguesa (CRP), nomeadamente:

Artigo 13.º (Igualdade): "Todos os cidadãos são iguais perante a lei." Princípio da Não Discriminação

Artigo 25.º (Direito à integridade pessoal)

Artigo 27.• (Direito à liberdade e à segurança) 

Artigo 153 (ameaça à integridade física) 

Tendo por objeto de proteção o bem jurídico «liberdade pessoal», protegido nos termos dos artigos 26.º e 27.º da Constituição, o crime de ameaça encontra-se previsto no artigo 153.º do Código Penal. 

A retórica xenófoba, racista e intolerante promovida por grupos extremistas, com membros conhecidos do público e da classe política, com passado de violência contra minorias, e em flagrante desrespeito pelo Artigo 240.º do Código Penal (CP) que tipifica como crime o "Discriminação e incitamento ao ódio e à violência", tem alimentado um clima de medo e incerteza entre os imigrantes. Na presente realidade, cuja confiança nas forças de autoridade é inexistente, sendo este o motivo pelo qual milhares de imigrantes optam por procurar apoio nas associações e não recorrer ás autoridades.

Neste contexto alarmante, muitos imigrantes, sentem-se cada vez mais inseguros e incapazes de permanecer em Portugal.

A falta de resposta efetiva por parte das autoridades e a inação do governo em enfrentar e resolver este problema, em desrespeito pelos seus deveres consagrados na CRP, estão a contribuir para esta sensação de desamparo e desespero.

Muitos imigrantes desejam regressar aos países de origem, onde esperam encontrar mais segurança. No entanto, devido às condições económicas precárias, enfrentam dificuldades em custear os gastos associados ao regresso, como passagens aéreas e despesas de reinstalação.

Nesse sentido apelamos ao governo português para que crie uma bolsa de apoio econômico destinada a imigrantes que desejam regressar aos seus países de origem, mas que enfrentam dificuldades financeiras para o fazer. Esta bolsa ajudaria a cobrir os custos de viagem e de reintegração, permitindo-os recomeçar as suas vidas em segurança.

Além disto, solicitamos que o governo tome medidas urgentes para combater a xenofobia, o discurso de ódio, desinformação e a violência contra imigrantes, incluindo:

Implementação de leis mais rigorosas: para punir os crimes de ódio e as ameaças à integridade física, em consonância com o Artigo 240.º do CP.

Ações concretas para desmantelar grupos extremistas: que propagam o discurso de ódio e a violência, em cumprimento do dever de proteger a segurança pública.

Promoção de políticas públicas que incentivem a integração e a inclusão social: de todos os cidadãos.

Conclusão:

**Apelamos ao senso de justiça, humanismo, e à responsabilidade do governo português para garantir a segurança e o bem-estar de todos os cidadãos, independentemente da sua origem, orientação sexual, religião ou orientação política.
