Byron Man Indicted in Dog Shooting 
Allmon was indicted today on cruelty to animal charges. He was also indicted for discharging a firearm near a public highway.  Allmon's arraignment has been set for August 29th. Attorneys hope to see the case go to trial in September.

BYRON, Ga. (FOX 5) %u2013 In the central Georgia town of Byron, a man has been charged with felony cruelty to animals.  Police say he shot a neighbor's 8-month-old puppy 14 times(Petition Authors interjection: A silencer was used for 12 of those shots, which is why no one heard anything, but the last 2 deadly shots were without the silencer).

With three dogs and five cats, Toni Smisson is an animal lover and not long ago, she had more cats, but they started disappearing.

Smisson suspected that her next door neighbor, 35-year-old Jason Allmon, had a role in the disappearances, but she said she couldn't prove it.  Smisson said Allmon mounted speakers on a fence aimed at Smisson's yard, and her dogs.

"He would transmit a noise, an ultrasonic frequency into the back yard and its supposed to be anti-bar, but it made [them] bark more," said Smisson.

Last weekend, Smisson's Husky mix, Zoie, jumped a fence.  Smisson said she spotted Allmon with a gun.

"He walked over, pointed a big gun at her and shot her in the head and said 'You've had this coming.'

Byron Police Chief Wesley Cannon charged Allmon with felony cruelty to animals based on surveillance tape from Allmon's home.

"The entire crime is on tape.  In that video, we see no signs of aggression from the animal," said Cannon.

Cannon described the case as a neighborly feud that simply escalated beyond proportion.  Smisson preferred to describe it as bullying.

Michael Chidester, a lawyer representing Allmon said, "Mr. Allmon shot a nuisance animal on his own property.  It wouldn't be a crime if he'd shot a raccoon or a possum.  We don't see why this animal is anything but a nuisance animal.  In our view, Ms. Smisson is just as guilty of animal cruelty as Mr. Allmon is."

According to Mr. Smisson, who has been in contact with me,

he states the following based on the surveillance tape from Allmon's home, (which has not been released):



 %u201CI think that is why the puppy is crying in pain on the video before she was shot two more times in front of my wife and son.  We did not know he had fired so many times and he said to my wife that he had killed her with a hammer while my wife looked over the fence and Zoie was still alive.  My wife fell off the dog house when Mr. Allmon fired the final two shots un-silenced.


The silencer can be seen in the video and two rounds were fired with the silencer removed in front of my wife and son.%u201D 



However, part of the attack was off camera, so there is no way to tell whether or not a hammer was actually used on Zoie.


Mr. Allmon has been in court before for trapping and killing cats and other pets in our neighborhood.  The Byron City Police were summoned by a 911 call but before they got there,  Mr. Allmon made threats to my son and wife while still brandishing the firearm and then he shot our very maimed pet as she lay there crying for my wife to help her

Walt Smisson is currently in the country of Kuwait working with the US military and Operation Iraqi Freedom.  On June 16th, a crazed neighbor, Mr. Allmon, shot one of the Smisson's family dogs in excess of 12 times!  Those 12 shots were with a SILENCER!  The other 2 deadly shots were right in front of Mrs. Smisson and without the silencer.  This was in a residential neighborhood.

Mr. Allmon was quoted as saying, 'You've had this coming,' as he walked over to the dog with gun in hand and shot her in the head twice, his eyes fixed on Mrs. Smisson as he did this.

Mrs. Smisson was less than two feet away from the gunfire and the son a mere 10 feet.  Other children were in the area not to mention Mr. Allmon's own children.  Most of this crime was caught on surviellance tape and is the strongest evidence.  He was charged because of his own security camera footage!

Based on the information at hand, I've taken the liberty of including excerpts from the CODE OF ORDINANCES, CITY OF BYRON, GEORGIA, which are related to this case:


The first relates to the animal cruelty charges:


Sec. 6-3. Cruelty.


It shall be unlawful for any person to willfully or maliciously inflict unnecessary or needless cruelty, torture, abuse or cruelly beat, strike or abuse any animal by an act of omission or neglect or cause or inflict any unjustifiable pain, suffering, injury or death to any animal, whether such animal belongs to such person or to another. However, reasonable force may be implemented to drive away vicious or trespassing animals, and any animal endangering the life or safety of any person may, when necessary, be killed.  (Ord. of 4-4-1988; Code 1987, § 4-14)

The second relates to the illegal use of a silencer:


Georgia Code - Crimes and Offenses - Title 16, Section 16-11-122


 No person shall have in his possession any sawed-off shotgun, sawed-off rifle, machine gun, dangerous weapon, or silencer except as provided in Code Section 16-11-124

So why was this individual not charged for having and using the silencer?


What normal citizen has a silencer?  


How does a normal citizen get a silencer? 


Who approved signed and authorized his use of such a device?


According to Mr. Smisson, Mr. Allmon has been in court before for trapping and killing cats and other pets in our neighborhood.  The Byron City Police were summoned by a 911 call but before they got there,  Mr. Allmon made threats to my son and wife while still brandishing the firearm and then he shot our very maimed pet as she lay there crying for my wife to help her.
 
I have also done some investigating into the City of Byron and have found out the local Animal Control Officer in Byron, Marshal Peacock, likes to break stray dog%u2019s legs, and then shoot them.  Marshal did that to a dog in front of Byron Councilwoman XXXXXX, and needless to say, she was horrified.

But since Marshal is somehow related to the Mayor, nothing will ever be done and no animal will have protection in Byron.  Marshal also tells everyone to just shoot cats.
There may be funding for an AC shelter, but it is not being used for saving animals. I withhold the name of the Councilwoman, for her protection.

On behalf of the Smisson Family, we support these words from Mr. Smisson and we support all those involved in their efforts to prosecute Mr. Allmon, which include:

   It is a sick and disturbed person that does this type of thing and I want everyone to know who he is, where he lives and to watch out for these people. 
I am over here in the Middle East protecting you and our country.  Could you at least provide an inquiry to increase awareness and provide a sense of protection from this beast for my family and neighbors?  I think that if he gets out there will be an escalation in violence toward my wife and children.
I can't protect my family from over here any other way. 

I need your help to ensure he is prosecuted as much as the Georgia codes will allow. (felony, cruelty to animals, reckless endangerment to residents, discharging a firearm in a residential area, terroristic threats, use of a firearm while committing a felony.) I hope at least one of these will stick on his record.  I just can't believe that staying out of harms way over here may be easier than at my own home in Byron, Georgia.
